A Public Hearing to hear protests to the assessments of costs of the City abatement of
weeds is required. The list of names, parcels and due amounts contained in the
Resolution was posted at City Hall on August 3, 1979. The amounts due the City after
appropriate Council action will become liens upon the property for the following tax
year.

SUBJECT: 1979 Weed Abatement Program
May 7, 1979, I mailed a total of 511 informational letters to property owners
regarding this year's Weed Abatement Program. The letter defined the program in
detail. A returnabl~ card was included to authorize the City to abate and bill
the owner for the cost of abatement, plus the $10.00 administrative fee. A con-
tractors list was included to allow the property owner to contact a contractor
and make arrangements to abate their property.
On June 5, 1979 the City Council adopted Resolution No. 5802 declaring weeds and
rubbish ; n the City a nuisance. June 6, 1979, a fi na 1 notice was sent to the
property owners who had not abated their property prior to the declaration of the
nuisance. June 19, 1979, the City Council held a Public Hearing to hear objec-
tions from the property owners regarding the program. At the conclusion of the
Public Hearing, Council adopted Resolution No. 5811 and directed you to abate the
nuisances. June 21, 1979, I instructed private contractors to abate the nuisances
as declared.

reimbursement to the City. $1,517.50 reflects the unpaid balance of property

WHEREAS, on June 5, 1979, this City Council adopted Resolution
5002 pursuant to Government Code Sections 39501-39588 declaring weeds,
8 rubbish, refuse and dirt on the real property described therein to be a
9 public nuisance and ordered the said weeds, rubbish, refuse and dirt abated
10 by the Director of the Utilities/Maintenance Department of this City; and
11 WHEREAS, pursuant to said resolution a hear~ng was held by said
12 City Council, and thereafter said City Council adopted Resolution Ho. 5811
13 di rec ting the Ut i 1 i ti es/Maintenance Di rector to abate the nui sancc by removd 1
14 of the weeds, rubbish, refuse and dirt on the real property described in
15 said resolution; and
16 ··w1-1EREAS, California State Government Code, Section 39560, et seq.,
17 requires that a report of the cost of such al>at1:ment b~ submitted to the
18 City Council for consideratii:in and confirma~ion fol101~in9 a public hearir,g,
19 and the Utilities/Maintenance Director has kept the required accounts and
20 has submitted his report to the Council for confinnation; and

l WHEREAS, at the appropriate time and place Sdid report was
2 received and considered for confirmation by thi~ City Council, at which
:; time ,'111 protests and objections were heard, and this City Council gave
4 all persons present an opportunity to ,be heard in respect to any matter
5 relating to said abatement work; and
6 WHEREAS, all person; de:,iring to be heard have been heard by
7 ~his City Council;
8 NOW, THEREFORE, BE IT h~~OLVED )Y the City Council of the
9 City of Carlsbad as follows:

1. That the above recitations are true and correct.
2. That the abatement work, the report submitted to this Council,
12 and the posting of the Notice of the Time of Hearing on said report were
13 duly and re~ularly performed in the manner and time required by law.
14 3. That all protests and objections, other than t~ose
15 heretofore allowed and deleted from said raport, if any_, were and are
16 hereby overruled and denied.
17 4. That said report, a copy of which is on file in the office
18 of the City Clerk, and by this ref(~ence made a part hereof, is hereby
19 confirmed, and each of the amounts set forth therein are hereby assessed
20 against the parcel of rea 1 property shovm with said sum and sha 11 constitute
21 a special assessmeht and a lien against such parcel of land.
22 5. The City Clerk is hereby directed to forward a certified
23 copy of this resolution, together with a c-,;p) of said report to the
