Statement of the Matter
On Friday, August 3, 1979, the City of Carlsbad Personnel
Board convened to hear a continuation on an appeal from Mr. REGINALD PINES, Water Serviceman, CETA, City of Carlsbad.
The recommendation of the board regarding this appeal was that the City Manager's action to dismiss Mr. PINES be reversed. The board's recommendation is shown on the attached letter.
To preclude reproducing a great number of copies, a transcript is available for City Council review in the Personnel Department.

SUBJECT: Carlsbad Personnel Board Hearing Re: REGINALD PINES
The Carlsbad Personnel Board convened at 5:30 p.m., August 3, 1979 in the City Council Chambers to conclude the appeal of Mr. PINES initiated on February 28, 1979.
At the February 28, 1979 hearing, the Board's vote was unanimous in recommending that the Council not uphold the Manager's decision to terminate the appellant, but that the appellant should be placed on probation for three (3) months subject to the following conditions:
1. That the appellant's attendance, tardiness and work performance be closely monitored and documented and;
2. Appellant be returned for final review by the Commission
on Friday, June 15, 1979.
At the August 3, 1979 hearing the Board's vote was unanimous and we recommend that:
1. The appellant should be retained in the service of the City
and the notice of termination is overruled on the basis of the employee's performance evaluation reports presented.
The second item (referenced discrimination) to come before the Board has been granted continuation at the request of Mr. J. K. IRVING, Council 36, AFSCME, AFL-CIO, representing Mr. PINES. The City has no ranting the above continuation.

an apology from Mr. BERTELSEN or Mr. GREER.
3. That Mr. PINES has been adequately compensated for tke
work performed.
4. That Mr. PINES has not been denied equal employment
opportunity.
5. That Mr. PINES has not been denied his civil rights.
Based on these findings the board unanimously recommends that the

grievance be denied and that the decision of the City Manager
be upheld. ..
