APPLICANT: CITY OF CARLSBAD. WHEREAS, on July 11, 1979 a duly advertised public hearing was held before the Planning Commission in the manner prescribed by law to consider a change of zone for the placing of the Q Overlay Zone on property presently zoned R-P (Residential- Professional) , located as shown on the map marked ZC-204, Exhibit A, attached hereto and made a part hereof; and WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1532 recommending said zone change which is herewith referred to and made a part hereof; and WHEREAS, on August 7, 1979 the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed change of zone; and WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environment, and a Negative Declaration has been prepared and filed in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972 and the California Environmental Quality Act; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: + • * 1 2 3 4 5 6 7 8 9 10 11 o 12 • § § 13 of < 8 o-Esj* 14 f^ ^3 ^ml isu. • -i 2 H *" m . 1 fi.Z £ 8 Q -1-0Ml Z N <fo jc - § l| | 17 1 ° 18 19 20 21 22 23 24 25 26 27 28 CO Co 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission in the aforementioned Resolution No. 1532 constitute findings of the Carlsbad City Council. 3. ELM AVENUE, WEST OF HIGHLAND. APPLICANT: CITY OF CARLSBAD. The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 21 of the Carlsbad Municipal Code is amended by the amendment of the zoning map to grant a change of zone (ZC-204) for the placijig of the Q Overlay Zone on property presently zoned R-P (Residential- Professional) located as shown on the map marked ZC-204, Exhibit A, attached hereto and mads a part hereof. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen day after its adoption. INTRODUCED AND FIRST READ at a meeting of the Carlsbad City Council held on the^jLcj^day of August / '1979 and thereafter PASSED AND ADOPTED at a meeting of said City Council held on the 4th day of September / 1979, by the following vote, to wit: AYES: Councilmen Packard, Skotnicki, Anear, Lewis and Councilwoman Casler NOES: None ABSENT: None ATTEST: "RONALD C.
