SUBJECT: CT76- I8 OFF SITE WATER LINE EASEMENTS
MAY STORES SHOPPING CENTER
STATEMENT OF THE MATTER
The City has required, per Condition No. 8 of the tentative map approval for CT76-18
adopted 9/2/77, that May Stores extend the water line at the west end of the expansion
area up along the future Monroe Street right-of-way and connect to the existing 12"
water line at the end of the existing Monroe Street. To fulfill this condition, it is
necessary that easements for water line purposes be granted to the City by the two property
owners over which the line is to be constructed: Grove Apartments Investment Company and
Kamar Construction Company.
In August of 1978, the City secured an easement for the lower half of the off site water
line over the Grove property; however, due to the rains occurring that year and the year
before, the water line design was relocated to avoid conflicts with newly eroded slopes.
In order to keep the water line easement consistent with the proposed construction, staff
is offering for Council's approval a revised easement which will be in line with the
redesign of the water line together with a quitclaim deed which will relinquish the City's
rights to the existing easement back to the property owner. Grove Apartments Investment
Company has included a letter with the easement stating the conditions under which they
are offering the easement. Basically, they are requesting the opportunity to locate and
install tees and valves at future water line locations and to be notified of the starting
date of construction by the City.
Staff is also offering for Council's approval a water line easement over the Kamar Construc-
tion Company's land at the upper end of the proposed off site water line.

A GRANT DEED FROM GROVE APARTMENTS INVESTENT COMPANY
FOR AN EASEMENT FOR PUBLIC WATERLINE PURPOSES-
WIlEEAS , Grove Apartments Investment ComPanv has submitted a
Grant Deed conveying an easement to the
City of Carlsbad for public waterline purposes ; said Deed
is on file in the Office of the City Clerk and is incorporated by
reference herein; and
WHEREAS, the City Council of the City of Carlsbad has
determined it to be in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed conveying an easement :: to
the City of Carlsbad for pub1 ic waterline purposes , is
hereby accepted.
3. That the City Clerk is herehy authorized to cause the
original Deed to be recorded in the Office of the County Recorder
of San Diego County, State of California, with the appropriate

Re: Waterline Easement in Future Monroe Street
Enclosed for use upon the recordation of the final map for Carlsbad
Tract No. CT 76-18 is a fully executed easement for a waterline in the portion of future Monroe Street owned by Grove Apartment Invest- ment Co. We are furnishing this easement on the condition that we have the right to designate a number of locations determined by us where capped 12"xl2"x10" tee connections will be installed as part
of the construction of the waterline. We will pay the full cost of
the tee connections and their installation. In order that construction of the waterline shall not be delayed, we agree that if we desire to exercise such right, we shall make such designation not later than thirty (30) days after we are given written notice of the date con-
struction of the waterline in future Monroe Street is scheduled to begin. In connection with granting this easement, we also grant The May Stores Shopping Centers permission to grade on our property in order to install this water line. We would appreciate your acknowl- edging receipt of this letter by signing the enclosed copy of this
letter where indicated below and returning it to us.
