CONSTRUCTION OF MAGEE PARK - CONTRACT NO. 1069 SUBJECT:
STATEMENT OF THE MATTER
On July 17, 1979, the City Council approved plans and specifications and authorized the City Clerk to invite bids for the construction of Magee Park. Sealed bids were opened at 4:OO p.m. on August 28, 1979 by the City Clerk. Nine bids were received and are shown on the attached Bid Summary. Bids ranged from $177,664 to $235,883. The low bid was sub- mitted by Michael Straub, General contractor of Carlsbad, in the amount of $177,664, which is $2,826 less than the Engineer's estimate of $180,490.
Budgeted funds are allocated in the amounts of $100,000 from the General Fund, Account No. 01-170-3020, and $57,865 from Federal Revenue Sharing, Account No. 22-170-3020, for a total of $157,865. To complete the entire project as bid, the Parks and Recreation Director has recommended using
$5,000 in Park-in-lieu funds allocated for Hosp Grove and $14,799 from
Park-in-lieu, Area No. 1 funds.

SUBJECT: Cistern at Magee House
The Parks and Recreation Commission,at their meeting of August 20, 1979 discussed the issue of the cistern at Magee House. The Historical Society, at the suggestion of Allan Kelly,
suggested reactivating the cistern as a means of saving water and bringing the issue of water conservation to the attention of the public.
The Commission, as well as staff, believes that while this sug-
gestion has some merit, it would not be practical from a safety or liability standpoint. The Commission recommends leaving the cistexnfilled with dirt and possibly putting up a false top and pump. This would draw attention to its intended use, without being a liability to the City.
The Historical Society will be informed of the Parks and Recreation Commission recommendation.

contract with no compensation to the contractor for the deletion. These
are shown as items 2 through14 on the Bid Summary.
During the bidding process, several clarifications to the plans and speci-
fications were required to be made in three addenda and changed the Engi- neer's estimate to $180,490. The last addendum was issued on August 16,
1979 and included changing the bid opening date to August 28, 1979.
Nine sealed bids were received and opened by the City Clerk at 4:OO p.m. on August 28, 1979. The bids ranged from $177,664 to $235,883. The low
bid, which includes retention of the 13 deletable items, is $177,664 from
Michael Straub, General Contractor, of Carlsbad.
In consultation with the Parks & Recreation Director, it is recommended
that the park be fully developed as delineated in the plans and specifi-
cations.
