STATEMENT OF THE MATTER
Newport Shores Builders, developers of Carlsbad Tract No. 72-34
inadvertently built a home over 3.5 feet of a 15-foot sewer eas
ment granted to the City. They are now requesting this quitcla
of 3.5 feet by 59 feet of easement as shown on Exhibit "A".
Authorization for the Mayor and City Clerk to execute a Quitcla Deed is required.

SUBJECT: QUITCLAIM OF PORTION OF SEWER EASEMENT
IN CT 72-34 (NEWPORT SHORES BUILDERS)
The developer of this tract inadvertently built a house
over 3.5 feet of a 15 foot wide sewer easement granted to the City. this area, reducing the easement width to 11.5 feet adjacent to the house. The sewer pipe is located approx imately 6 feet from the property line and, therefore, thi house remains clear of the pipe.
Most sewer easements in the past have been 10 feet or 12 feet in width. The present requirement of 15 feet is to allow room for heavy equipment in case a line needs replacement. The sewer pipe adjacent to the house is encased in concrete which should preclude any maintenanc problems requiring pipe replacement.
The requested quitclaim will not endanger the house nor adversely affect the interests of the City.
They are now requesting a quitclaim of

Gentlemen:
As 1 indicated to you yesterday, we have a problem on Lot
270 In Tract 72-34 (The Seaport). This lot is at the end of
Columbine Drive and abutts the future Phase 5 (tentative 79-4).
It is burden with an easement on each side on the north side
by a 15O sewer easement and south side by a 10' storm drain
easement and hence the problem.

The house that has been built
The sewer at this lot is 17' deep and encased in concrete
for the lots distance. The house is two feet into this easement.
Please see the attached drawings.
To solve this encroachment problem, we wish to request that
the City quite claim the two feet to Newport Shores Builders
thereby clearing title on this lot.
