SUBJECT': SECOND PHASE ALLOCATION SYSTEM STATEI@NT OF THE MATTER: The City Council considered the attached Second Phase Sewer Allocation System at their workshop session of Tuesday, September 11, 1979. At that time the Council requested an additional tie breakkr be added to the point system for all cases. The tie breaker concerns System. projects which were accepted and rated in the First Phase In addition it will be necessary for the City Council to establish a deadline for accepting applications, approximately 30 days from tonight's meeting. Staff recommends Friday, October 19, 1979 at 5:OO P.M. as the deadline for receiving applications. FOP34 - PLANNING 79 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 5933 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AUTHORIZING THE ISSUANCE OF SEWER CONNECTIONS PERMITS PURSUANT TO THE SECOND PHASE SEWER ALLOCATION SYSTEM WHEREAS, Chapter 18.05.030 of the Carlsbad Municipal Code imposes a moratorium on the issuance of sewer permits and building permits due to the lack of sewer treatment capacity; and WHEREAS, said Chapter authorizes the City Council to adopt an allocation system, which provides for the issuance of a limited number of sewer and building permits as an exception to said moratorium; and WHEREAS, the City Council wishes to adopt a fair and equitable system for allocating any additional sewage treatment capacity which may become available in the future, pursuant to the authority of Section 18.05.030 of the Carlsbad F4unicipal Code; and WHEREAS, a Council Committee has worked for many weeks in an effort to devise a fair and just system to allocate any future capacity, and has produced a Second Phase Sewer Allocation System; and WHEREAS, the Planning Director has determined that said system will have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed. Council has considered said Negative Declaration and finds that the requirements of the City of Carlsbad Environmental Quality Act have been satisfied in regards to said system: and The City // 1 2 3 4 5 6 7 B 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, a noticed public hearing has been held on the system and after full and complete consideration, the City Council has determined it to be in the public interest to adopt a system which can be used for a second phase allocation of additional sewage treatment capacity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That pursuant to the Carlsbad Municipal Code Section 18-05.03 the City Council hereby adopts the Second Phase Sewer Allocation System as set out in Exhibit "X", dated September 7, 1979, attached hereto and made a part hereof, 3. It is the intent of the Council in adopting said system to adopt a framework which can be used to fairly and equitably allocate some or all of the additional sewer capacity which the City may acquire. In adopting this system, the City Council does not obligate itself to allocate all or any part of the available capacity pursuant thereto. Prior to approval of the Second Phase Sewer Allocation Permits, the Council may find it necessary to further amend the allocation system, The system is subject to change and may or may not be used in the future if additional amounts of sewer capacity becomes available. 4, As a part of the Second Phase System, the City Council has provided special rules which apply to building permits issued pursuant to the sewer allocations made under this system. Those rules provide that building permits must be taken out promptly and processed diligently to conclusion or they will be void. This action is unique local circumstances resulting from the sewer moratorium. In order to insure that th necessitated by the City's building and available amount of sewer capacity is utilized in the best interest of all the citizens of Carlsbad, the Council wishes to insure that sewer permits, when issued, will be used as soon as possible and will not be stockpiled thereby denying other, perhaps more worthy, projects an opportunity to proceed. The Director of Building and Housing is hereby directed to file a copy of this Resolution with the State as necessary to justify the deviation from the Uniform Building Code necessitated by special local conditions. 5. The City Council has determined that it is necessary to collect a special fee as a condition of the issuance of a sewer allocation permit application to the Second Phase Allocation System. The fee will be in addition to all other fees required for the issuance of building and sewer permits. Objectives The sewer allocation system contained herein is intended to provide a framework within which the City Council can make some judgments regarding the allocation of a limited amount of sewer capacity which may become available. This system is designed to meet the following City objectives: A. To fairly and equitably allocate a limited amount of sewer capacity among competing demands. B. To coordinate development with needed public improvements. C. To maintain and enhance levels of City services (infilling). D. To preserve and/or enhance the efficiency of service delivery systems to allow time to provide public facilities adequate to meet expanded service needs. E. To renew and maintain existing urban areas. F. To accommodate reasonable amounts of development of vacant land within existing urban areas. I. i 11. Available Sewer Capacity: It is estimated that the second phase sewer allocation-system will have 1,000 equivalent dwelling units and 246,000 gallons of sewer treatment capacity to be considered for allocation, This capacity may be distributed on the basis of the criteria contained within this document, The amount of sewer capacity required for any particular project shall be determined pursuant to Section 13.08.081 of the Carlsbad Municipal Code. 111. Purpose and Intent A. The guiding criteria for the application and interpretation of this system shall be to maximize the overall community benefits for the City of Carlsbad. B. This sewer allocation system is for those portions of the City of Carlsbad which are located within the Carlsbad sewer service area. 9/79 , IV. Land Use Distribution: --,-.,.- The following distribution of sewer capacity by land use cate- gory is established for the second phase sewer allocation system, Percentage to be applied Actual to available EDU's EDU ' s A. No applications will be accepted until a plan is adopted for the Village Redevelopment Project Area. -2- SI 150 150 ' 150 . 100 100 100 100 50 .. 20 80 9/79 '2. 3. f After adoption of the plan applications for the initial allocation will be accepted only from the "core area" (Exhibit A) for a period of 6 months. At the end of the 6 month period, the Village Redevelop- ment Project Area Committee will be asked for recommendations re- garding opening applications to the entire project area (Exhibit B). Applications for sewer permits will be divided by use in accordance with the above categories and applicant is limited to one category for any one project. Projects in each category will be rated against other projects in the same category and seperate allocations will be made within each category. The Community Facilities and Contingency categories are designed to reserve sewer capacity rather than allocating fixed amounts immediately as the other land use categories. It is anticipated that between now and when optimum sewer capacity is available, there will be a continuous need for capacity in the various land uses identified in these categories. It may be necessary to establish a separate allocation system for these categories if a high demand occurs; however, at thjs time, it is anticipated that these will be handled on an "as needed" basis by a case-by-case evaluation by the City Council. The only exception to the City Council allocating these categories based on community need and the public welfare, is that the City Manager shall have authority to issue sewer connection permits for failing septic tank systems, V. Procedures for Applying for Sewer Permits Under the Second Phase Allocation System It is assumed that there will be more applications for sewer allocations than there is available capacity. Therefore, five qualifications are established which must be satisfied at the time of application in order for the application to be considered. It is the judgment of the City Council that only projects which can meet these qualifications should be eligible to participate in the allocation under the second sewer allocation. These qualifications are also intended to screen applications in a pre- liminary way to provide a reasonable guide to save unnecessary engineering and design costs for a proposed project where there is little chance of the praject qualifying for a sewer allocation permit, The qualifications are as follows: 1. To be eligible residential projects must be within the infill area as shown on map marked Exhibit C, attached hereto, or be found to be a logical extension -3- 9/79 2. 3. 4. 5. of developed areas located outside the infill area and must be proposed for development in a manner similar to the developed areas to which they are adjacent, No existing projects with septic tanks, may apply for sewer under the allocation system. The project shall be on property where all required public facilities are existing or can be satisfied by City Council Policy Number 17. In no case will a project create a need for public costs for City facilities to service the site such as streets, sewers, etc. Applications for a project under this system shall be limited as follows: Commercial Office, 10 EDUs Commercial General, 20 EDUs Residential, 35 EDUs The City Manager may authorize the acceptance and pro- cessing of applications which exceed the limits by no more than 10% upon a determination that it is necessary to avoid undue problems to the project in the areas of engineering or construction. Individual financing arrange- ments shall not be considered. Application will not be accepted for projects within-the area covered by the settlement in the Grove litigation. No allocation in excess of these limits stated in qualification number four will be made to any one project. For land use categories without limits the Council may defer allocation if one or more applicant seeks a disproportionate share of the available capacity. In that event the Council may revise this system or otherwise proceed as they consider appropriate. Applicants for projects which apparently qualify under the cate- gories listed above, shall then prepare the following information as the official application for a second phase sewer allocation I permit. 1. Documents Reauired for Submittal: The following documents are required to provide suffi- cient information to accurately rate the application, and to determine if the proposal meets Code requirements, Errors or omissions may cause disqualification. a) Application, (Exhibit D) b) Questionnaires for qualification. The deadline for filing applications is the close of the business - -- day on . Applications shall be filed with the Planning Department. Applications may not be made for the contingency or redevelopment categories as a part of the initial allocation under the second phase system. VI. Staff Evaluation After the closing date for receipt of applications a staff com- mittee consisting of the Public Works Administrator, City Engineer, Director of Building and Housing and the Director of Planning, shall evaluate each application in accordance with the provisions of this section. The cornhittee shall prepare a report for the City Council. The report shall show which projects in the judg- ment of the committee meet the qualifications of Section V. The project shall be placed within the’appropriate land use categories. If applications in any category exceed the capacity available to that category, they shall be evaluated and ranked by staff based on the point system as set out in the point rating system attached hereto as Exhibit F, G, H and made a part hereof. The report shall also show a point total for each project and a priority list of projects from the one with the highest total to the one with the lowest total for each land use category. Finally the report shall recommend which projects in each category should receive a sewer allocation permit. The report of the staff committee shall be mailed or otherwise made available to all applicants prior to the City Council hearing, VII. City Council Action The City Clerk shall set a public hearing before the City Council to consider the staff committee report. After completion of the public hearing on the report, the Council shall first consider and resolve any disagreenrents between applicants and staff in regard to the qualifications of Section V. The Council shall then eliminate from further consideration for permits under this second phase allocation all projects which do not meet the Section V qualifications, -5- 9 f79 I A The. If the Council is not satisfied that the results of the rating system meet the objectives and purposes and intent of the system, the Council may amend it as they consider necessary in the public interest. When the Council is satisfied with the findings and the ranking of the projects, they shall adopt a list of such projects which shall become the basis for issuing sewer permits and building permits within the Carlsbad sewer service boundaries. Inclusion of a project on the approved list shall constitute authorization pur- suant to Municipal Code Sections 18.05.030 and 21.49.030 for the exception of that project from the building and planning moratoria imposed by Chapters 18.05 and 21.49 of the Code. Permits and Fees The successful applicant within the allocation system shall be required to perform in the following manner in order to obtain and retain a sewer permit: A. For property requiring discretionary permits, i.e.? tenta- tive tract map, PUD, condo permit, variance, CUP, etc., application for such permit shall be filed within sixty days from City Council action approving the list of projects eligible for sewer allocation. The applicant must dili- gently pursue his permits to a final decision. B. Application for building permit must be filed within forty-five days after Council action approving the list of eligible projects for those projects not requiring further discre- tionary permits, or within sixty days after final City action on the discretionary permit. pursue his permits to a final decision. The City Council may extend the time for building permit applications an additional sixty days for major projects. If the applicant cannot meet these deadlines, he should so indicate on the application for a sewer permit. The applicant must diligently -6- 9/79 . c. D. E. F. G. Applicant shall also pay a Public Facility fee as may be adopted by the City Council. The applicant must take out his building, sewer and other necessary permits within 20 days after mailing of written notice by the City that plan check for the building permit is complete and that the building permit is ready for issuance. shall be made within such time limits as the City Manager may establish. After issuance of a sewer permit by the Engineering Depart- ment, construction shall commence within 120 days and be diligently pursued without interruption until completed. If construction does not progress in a reasonably timely way, or is interrupted for any period in excess of 120 days the building permit and sewer permit will be void. All fees shall be non-refundable. If revisions to the plans are required they *. If a building permit is voided, application for a new building permit may be made which will only be issued if the project qualifies for a new sewer allocation pursuant to such system that the Council may adopt in the future. Sewer permits shall not be transferred to another project. Failure to comply with these requirements will void the allocation, NOTE TO APPLICANTS This second phase sewer allocation system is adopted based on an assumption that the City will have available some additional sewer capacity. This assumption is based on engineers' estimates and the resolution of litigation. The true facts are difficult to determine, the assumptions which underlie the system are sub- ject to change, and the litigation settlement may not be finally concluded. There is no guarantee that a project, which apparently qualifies for an allocation pursuant to this system, will actually receive a sewer permit. Further, there is no guarantee that the issuance of a sewer allocation permit will ensure that capacity will in fact be available at the time of building permit or occupancy. Sewer which is available when an applicant applies for discre- tionary approval may not be available when application is made for building permit. in the plant, and must be governed by the City Councils' deter- mination of availability of capacity at the time the hookup is made. The fact that an allocation is made for a project requir- ing discretionary approvals shall have no effect on the City's consideration of such approvals. Except for events beyond the control of the City Council, it is the policy of the City Council that an allocation made to an applicant who complies with the requirements of the Second Phase Sewer Allocation System and all other applicable laws and ordinances will not be rescinded or reallocated to another person. My coments to you would be as follows: 1. The criteria that is used such as the distance to schools and distance to parks, bears no relationship ttt the planning criteria which is used to locate these facilities, For instance various school sites are delineated on the Carlsbad General Plan and it now turns out t'nat if you are not within 3/8 of a mile from one of these sites, you are in effect pen- alized on your point system, On the otner hand if one lived next door to a noisy gramar school, he would. be rewarded with three points and then would have a very undesirable location for a residence, As a matter of fact, he might even be required under a full E111 to use some noise attenuation measures to mitigate the noise. Also 1 night point oat that ktte trzmspsrtation route as shown on the accoqaaying maps, that are in the City Hall, have severzl. errors, I have examined the accompanying map in the Laguna Riviera area and find that the transpor- tation nap particularly, is in error as the bus route goes up Valencia Avenue to Hillside and then eastward to Kelly Drive wherein the maps presented to the City Council show the bus route continuing around Park Drive to an eventual. intersection of Kelly, Page Two Re : September 17, 1979 Proposed Sewer Allocation System You raised some questions as to what routes the buses actually took a-d I personally observed on Saturday, Sept- ember 15th, at approximately 35 minutes after the hour, bus $20 on the route I have described, I know this sounds picky, but it is possible that one point would make the difference between obtaining the proposed sewer allocation or not. I would also like to take exception to the map which shows our proposed development, which is on the west side of Valencia, over a quarter of a mile from the pa~k site that we dedicated to the City of Carlsbad as part of the Laguna Riviera development, The park site is actually 1150.5 feet froa the site, The par,?: and recreation nap shows this property to be over a quarter of a mile away wherein by the accompanying map it is readily ascertainable as it is well within a quarter of a mile away.
