Mgr, - = SITE DEVELOPMENT PLAN 79-3 : APPELLANT:COUNCIL!JIAN SKOTN: Subject: Statement of the Matter The City Council, at your meeting of September 18, 1979, directed the City Attorney to prepare the necessary documents approving Site Developnent Plan 79-3. A resolution in that regard is attached. In accordance with your direction, a condition requir- ing compliance with Council Policy No. 17 has been added. Exhibits Resolution No. 5-950 . Recormendation If the City Council concurs, your action is to adopt Resolution No.59 6-0. NOW, THEREFORE, BE IT RESOLVED by the City Cou'izcil the City of Carlsbad as fol-Lows: A. That the above recitations are true and correct B. That the findings of the Planning Corrsnission in Resolution No. 1543 constitute the findings of the City Council with the exception of Finding 2.F. which has been revised as follows: "2.F. At this time, the City Council is not prepare to find thak all other public facilities necessary to sex The City Council has, by inclusion of an appropriate conditic required that the project contributed to the costs of suc facilities. Since the development will pay its proportic share of the public facilities which it will. require, the City Council is satisfied that the requirements of the public facilities element of the general plaiz have been satisfied." 1 this project will be available concurrent with need. I That the City Council grants the appeal and aff the decision of the Planning Commission to approve the Si Development Plan (SDP79-3) subject to the following revis conditions of approval: I I "1. SDP 79-3, Phase I, is approved as shown on Exhj dated August 6, 1979 and on Exhibit B, dated June 27, 19; file in the Planning Department and the project shall be constructed as shown thereon. The Phase I1 Alternatives shown on Exhibit A are not approved by this action. The1 are only shown for reference. Any future phases will rec the approval of the Planning Commission. i 2. Prior to the issuance of building permits, lanc and irrigation plans shall be submitted to the Planning I ment for review and approval. 3. The applicant shall install a sidewalk contiguc the existing curb and street lights along the Pi0 Pic0 f: of the project to City standards and the satisfaction of City Engineer. 4.
