J .J I, SUBJECT : OFFER TO DEDICATE A 10 FOOT (IMPROVED 5 FOOT) BEACH ACCESS AT OCEAN STREET AND CEDAR AVENUE TO THE CITY STATEMENT OF ?HE MATTER: The City has received the subject request from the property owner in fulfillmc of a Coastal Commission condition of approval. In the offer of dedication (a it is stated that the offer must be made to the City. Actually, the Coastal Commission Condition could be met by an offer to dedicate to any "public agen or private association". However, given the circumstances of the subject req staff feels that the offer of dedication to the City is appropriate. It shou noted that the Counci 1, if it is decided. the dedication is not acceptable, wo be eliminating the possibility of continued public access in this location. The Council may recall a similar request about one year ago. In this case th Commission had required a dedication of access on Ocean Street at the terminu Beech Avenue (McMahan). One of the major problems was that the required acce ment width was a total of 5 feet. This would have resulted in only a three. f improved walkway. The narrow access, combined with the fact that existing st were immediately adjacent, led Council to decide the dedication was not in th best i nterest. The positive aspects of the subject request are that the easement is 10 feet accessway is improved with an existing 5 foot concrete walkway. (developed as the motel to the south). The walkway has been in use by the public for somet no reported problems. The property adjacent to the north is vacant and if de will have the walkway to consider in planning and design. Staff has consulted with the Parks and Recreation and Engineering Department! ing the offer of dedication. The Engineering Department has indicated suppol acceptance of the offer. The Parks and Recreation Department has expressed i qual i fi ed support. In checking the condition of the existing stairway, Parks and Recreation foul disrepair. As an example, the easement ir question, after inprovemerit, would leave a passageway possibly no wider than three feet, requirement of retkining walls, fencing, and handrails, This will vary depending on the topography. The Coast Commission in requiring these accesses, does not look at them in terns of future City responsibility or improvement requirexents, municated to the Ccsmission. In this particular case, sufficient space was available to provide -ten feet, which is the minimuan we should accept. I strongly support the concept that the beach below the mean high tide line is public and therefore the public should have reasonable and appropriate access to that beach. However, in its eagerness to provide public access the Commission designated a number of easements that were totally inappropEiate ,. The Cedar Avenue access was a requirement placed on the expansion of the adjacent existing motel, While the motel expansion appears to be completed and landscaped, the stairway remains unimproved.
