HomeMy WebLinkAbout1979-11-06; City Council; 5993-1; LCWD effluent disposal lineCITY .OF CARLSBAD AGENDA BILL NO. 5993 Supplement No. 1 DATE : November 6, 1979 DEPARTMENT : City Manager Subject: I I LEUCADIA COUNTY WATER DISTRICT - EFFLUENT DISPOSAL LINE Statement of the Matter At the October 16, 1979 Council meeting, no action was taken on Leucadia County Water District's request for authorization from the City to install a'l4-inch diameter pipeline in the street right-of-way (La Costa Avenue) north of Lanakai Mobile Home Park and in a 30 foot sanitary easement parallel to the AT&SF right-of-way from the northeast corner of Lanakai to the Encina Water Pollution Control FaFility. Staff was directed to determine if a eo-terminus easement existed and if one did not, the matter was to be returned for Council consideration. The City Attorney and the City Engineer are of the opinion that a co-terminus easement exists and that no further action of the City Council is required. -.. .,.. Council Action: 11-6-79 The matter was filed. .- MEMORANDUM DATE : TO : FROM: SUBJECT : October 23, 1979 Mayor and City Council City Attorney LEUCADIA COUNTY WATER DISTRICT SEWER EASEMENT As directed by Council on October 16, 1979, our office has undertaken to analyze the status of easements belonging to the City and Leucadia County Water District on the same property. After reviewing the language of the deeds granting the easements, and after reviewing the maps prepared by the City Engineer; we are of the opinion that both the City and Leucadia County Water District have valid easements and that the exercise by either entity of their rights under the easement should not cause conflict. We concur with the determination of the City Engineer as stated in his memo to us dated October 18, 1979. ty Attorney DANIEL -HENTSCHKE, Assistant City Attorney MEMORANDUM TO : City Attorney FROM : City Engineer DATE : October 18, 1979 SUBJECT: SEWER EASEMENT FOR THE LEUCADIA COUNTY WATER DISTRICT The Engineering Department has reviewed the package of sewer easements provided by the Leucadia County Water District to substantiate its right to construct, maintain, etc. a sewer line north of La Costa Boulevard along the east side of ATSF right-of-way. The easements are plotted on the attached sketch and coincide exactly with the ease- ments held by the City of Carlsbad. The recording dates of both the City and the district's easements are within four months of one another with the City's recording being earlier with one exception. In my opinion, the LCWD has a valid easement in which to construct its sewer line to the Encina Treatment Plant. LE:mmt Attachment
