Three of .the sewer categories (Single Family - less than 4 units; Office; & Industrial Expansion) had $. less requests for EDUs than EDUs assigned, therefore staff did not rate these categories and recommends allocation as requested. General - Commercial category had two applications disqualified, resulting in less requests for EDUs than EDUs assigned, therefore staff recommends that sewer be allocated as requested 'by qualified applications. Three . categories (Single. Family; Multiple Family; & 'New Industrial) had more requests than EDUs available and were rated by staff. However, it should be noted that there were inconsistencies made by the applicants in the filing of the applications, as well as ambiguity in the application itself (see attached memo to the City Manager, 11/15/79). There are a tdtal of 1000 EDUs in the Second'Phase Sewer Allocation Program. The City Council made a total of 850 EDUs available for allocation in these sewer categories. Hagaman, Planning Ron Beckman, Director of Public Dick Osburn, Building Director RE : SECOND PHASE SEWER ALLOCATION Introduction The Second Phase Sewer Allocation rating is complete and ready for City Council review. All applicants for this allocation, plus all persons that have indicated interest in sewer allocation have been noticed by mail of this review. All of the categories are ready for allocation. Three of the categories (single family less than 4 dwelling units, office, and industrial expansion) have less requests for EDUs than EDUs assigned. Staff did not rate these categories and recommends that sewer be allocated as requested. General - commercial was rated because there were more EDUs requested than assigned. However, two of the applications were disqualified because they requested over the maximum EDUs. The EDU requests of the qualified general commercial is less than the number available. Staff recommends that sewer be allocated as requested to qualified applications. The single family, multiple family, and new industrial categories have more requests for EDUs than EDUs assigned. Therefore a rating was necessary. However, some questions did come up during staff's evaluation and rating of these applications, but, by strictly using the data as submitted, staff was able to complete the ratings. This is consistent with the allocation of the First Phase Sewer Allocation Program. Nevertheless, it must be recognized that there are differences in the way applications were prepared and these differences do affect the ratings. For example, some applicants divided their projects into phases and submitted seperate applications for each phase. This allows the total project to be greater than the maximum EDUs permitted for individual projects and gain more points on the EDU rating. Staff evaluated each application seperately, regardless of how many projects per lot. Also, it appears that not all applications were for the correct number of EDUs to serve the stated use or the proposed building. They were both high and low. Staff evaluated the applications based on the information provided by the applicant and presumed it was correct. It may be that some applicants will not be permitted to build the size building they indicated on the sewer applications, or that there will be a surplus of sewer from those that over estimated their needs. Two of the questions on the application were hard to evaluate. The question on value of property for commercial and industry was one. Most applicants did not know at the time of application what type of building they would build. Therefore staff determined an average cost of building per category and multiplied that by the square footage. This gives a rough approximation of value. Another problem is a conflict in information relative to proposed employees vs. EDUs requested in the industrial categories. EDU requirements for industrial buildings is determined by the City Engineer, based on the use of the buildings. To do this with accuracy the City Engineer needs floor plans to determine areas in offices, production (and kind), storage, etc. This gives an approximation of the number of employees and what they will be doing. This information was not required or submitted as part of the allocation application. For allocation application the City Engineer and applicants had to roughly approximate the EDU demand. The rating is based on this estimate. Also, the industrial category gives points based on the number of employees. The higher the employee count, the higher the points. Again, because some applicants didn't know the future employee counts or, for that matter, the use of the buildings, employee counts were guesses. In some applications the EDUs requested are far short of the employees projected. While staff evaluated the applications based on the information as submitted, Council should be aware that, in some instances, this oversight of equating the number of employees to the number of EDUs could result in an advantage to those applications containing such conflicting information. Following is a synoposis of the rating of each category. It contains a recommendation, which is based on the most literal interpretation of the allocation system and past allocations. No attempt was made to resolve any of the issues noted above. Attached are the standings of the ratings. These standings list the applications only by their file number. A cross reference rating the applications will be available at the hearing. JCH:BP:ms 11/15 RATINGS BY CATEGORY: See attached Rating Forms 1. Single Family Residential - Four or Less Units There are 100 EDUs available in this category. Forty-two applications were submitted for 56 EDUs, giving a remainder of 44. All applications meet the qualifications. There was no reason to rate this category since there are excess EDUs available. Instead the requests are listed in order of submittal. Staff recommends that all applications for Single Family Residences, with four units or less, be granted sewer capacity as requested and the remaining 44 EDUs be placed in reserve. 2. Sinqle Family Residential - More than Four Units There are 100 EDUs available in this category. Fourteen ap- plications were submitted for 345 EDUs, for a deficit of 245. All applications qualified and were rated. The first five applications are for 76 EDUs, leaving a remainder of 24. The next three applications are tied. Application S-28 is the completion of a project with an approved tentative subdivision map, therefore it is rated above the other two as per the tie breaker criteria. However, S-28 is for 35 EDUs, which exceeds the remaining 24 EDUs. The Ci.ty Council could grant the remaining 24 EDUs, transfer 11 EDUs to complete the project, or deny sewer. The other two tied applications are for less than 24 EDUs. One applicant claims that his application is for the continuance of an existing project (S-53), because it is an extension of an existing development (Laguna Rivera) built by the applicant. However, the extension has not been approved by a tentative map. Even if the City determines that this application was a completion of an existing project, it would still be considered lower in standing than S-28 since it was submitted later. Staff recommends that applications S-23, S-6, S-2, S-1 and S-35 be granted sewer capacity as requested and the remaining 24 EDUs be placed in reserve. 3. Multiple Family Residential There are 100 EDUs available in this category. Seventy-two applications were submitted for 714 EDUs, for a deficit of 614. All applications meet the qualifications, however, one application was submitted twice. Staff only evaluated one. The rating has 12 applications, for 99 EDUs, receiving allocation, with one EDU remaining. Staff recommends that applications M-41, M-39, M-55, M-57, M-20, M-25, M-26, M-46, M-60, M-11, M-39, and M-8 be granted sewer capacity as requested and the remaining one EDU be placed in reserve. 4. Commercial Office There are 100 EDUs available in this category. Thirteen requests were submitted for 87.6 EDUs for a remainder of 12.4 EDUs. There was no reason to rate this category since there are excess EDUs available. The applications are listed in order of submittal. Staff recommends that all applications for office-commercial be granted sewer capacity as requested and the remaining 10.4 EDUs be placed in reserve. 5. Commercial - General There are 150 EDUs available in this category. Nine applications for 378.3 EDUs were submitted, for a deficit of 228.3 EDUs. However, as submitted, two applications, with a total EDU request of 272.3, did not qualify since their requests were over the maximum 20 EDUs permitted for this category (C-16 and C-19). By deleting these non-qualified applications, there are 7 qualified applications for 106.0 EDUs, giving an excess of 44 EDUs. Because there is sufficient EDUs, staff did not complete the rating. Staff recommends that all qualified applications be granted sewer capacity as requested, and the remaining 44 EDUs be placed in reserve. 6. Industrial - New There are 150 EDUs available in this category. Twenty- one applications were submitted for 657.4 EDUs. Staff has recommended that six applications for 111.6 EDUs be granted sewer. This gives a remainder of 38.4 EDUs. The next application in standing is for 42.0 EDUs, which would put the count over the 150 EDUs by 3.6 EDUs. The following application is tied, but was submitted later. It's only for 30.0 EDUs. Unless Council directs that staff reconsider this category because of the problems of conflicting information, the staff recommends that applications 1-13, 1-4, 1-5, 1-15, 1-22, and 1-17 be granted sewer capacity as requested and the remaining 38.4 EDUs be placed in reserve. 7. Industrial - ExPansion There are 150 EDUs in this category. Three applications were submitted for only 52.6 EDUs, leaving a remainder of 97.4. There was no reason to rate this category since there is an excess available. They are listed by order of submittal. Staff recommends that all applications for industrial expansion be granted sewer capacity as requested, and the remaining 97.4 EDUs be placed in reserve. There is a total of 1000 EDUs in the Second Phase Sewer Allocation Program. The City Council made available a total of 850 EDUs for the sewer categories in this allocation. The remainder will be allocated later for community facilities, contingency and redevelopment areas. A total of 558.8 EDUs will be allocated per staff's recommendation. This leaves a reserve of 261.2 EDUs. The reserve of the First Phase Sewer Allocation Program was allocated at a later date as the Second Allocation of the First Phase. The procedure for the Second Phase Allocation requires a public hearing to consider this report. After completion of the hearing on the report, the Council shall resolve any discrepancies between applicants and staff in regards to qualifications. Staff disqualified only two applications (C-16, C-19). These disqualifications were because the applications were for more EDUs than the maximum permitted. However, in both cases it may be possible to make separate applications for phase development as other applicants did. This was discussed with both applicants prior to submittal. The Council shall eliminate from further consideration all projects they believe do no qualify. Next the Council shall review the point ranking and qualifying projects with each land use category. This will be in categories of Single Family more than 4 units (page 4 of Standings), Multiple Family (pages 5, 6, 7 and 81, and Industrial-New (pages 11 and 12). The Council has the prerogative of making its own policy interpretations of the rating system in reaching its decision on allocations. The Council may amend it as they consider necessary. The Council may wish to discuss some of the problems and inconsistencies noted in the report. When the Council is satisfied with the findings and ranking of the projects, they shall adopt a list of such projects, which shall become the basis for issuing sewer permits and building permits. It is possible for the Council to approve rating for some categories, but request further consideration on other categories. Recommend at ion Staff recommends that the Council: 1. Adopt the ranking of land use categories of Single Family - 4 or less units; Single Family - more than 4 units; Office; Industrial - Expansion, as indicated on the attached standing lists, and direct staff to prepare approved list and necessary documents. 2. Discuss issues noted in the report and those from the hearing as they relate to the categories of Multiple Family, Commercial and Industrial - New. If the Council is satisfied with the standing as submitted, you should adopt them, and direct staff to prepare approving list and necessary documents. If the Council does not agree with the standing or the method used by staff, you should direct staff to rerate these categories and return revised standings to a date certain. The date to be determined based on the amount of work necessary to complete the rerating. 3. Place the remaining EDUs in reserve to be allocated at a later date. Objectives The sewer allocation system contained herein is intended to provide a framework within which the City Council can make some judgments regarding the allocation of a limited amount of sewer capacity which may become available. This system is designed to meet the following City objectives: A. To fairly and equitably allocate a limited amount of sewer capacity among competing demands. To coordinate development with needed public improvements. i B. C. To maintain and enhance levels of City services (infilling). D. TQ preserve' and/or enhance the efficiency of service delivery systems to allow time to provide public facilities adequate to meet expanded service needs. E. To renew and maintain existing urban areas. F. To accommodate reasonable amounts of development of vacant land within existing urban areas. 11. Available Sewer CaDzrsitv: It is estimated that the second phase sewer allocation system will have 1,000 equivalent dwelling units and 246,000 gallons of sewer treatment capacity to be considered for allocation. This capacity may be distributed on the basis of the criteria contained within this document. The amount of sewer capacity required for any particular project shall be determined pursuant to Section 13.08.081 of the Carlsbad Municipal Code. 111. Purpose and Intent A. The guiding criteria for the application and interpretation of this system shall be to maximize the overall community benefits for the City of Carlsbad. B. This sewer allocation system is for those portions of the City of Carlsbad which are located within the Carlsbad sewer service area. 9/79 IV. Land Use Distribution: The following distribution of sewer capacity by land use cate- gory is established for the second phase sewer allocation system. Projects in the Redevelopment Area 88 1. This capacity will be reserved and no application for an allocation will be accepted until a plan is adopted for the Village Redevelopment Project Area. . 1 This system will be supplemented to provide for allocation. 80 Applications for sewer permits will be divided by use in accordance with the above categories and applicant is limited to one category for any one project. Projects in each category will be rated against other projects in the same category and seperate allocations - will be made within each category. The Community Facilities and Contingency categories are designed to reserve sewer capacity rather than allocating fixed amounts immediately as the other land use categories. It is anticipated that between now and when optimum sewer capacity is available, there will be a continuous Reed for capacity in the various land establish a separate allecation system for these categories if a high deman.2 occurs; howevzr, at this time, it is anticipated that these will be handled 02 an "as needed" basis by a case-by-case evaluation by the City Colmcil, The only exception to the City Council allocating these categories based on community need and the public welfare, is chat the City Manager shall have authority to issue sewer connection permits for failing septic tank systems. Procedgres for Apr,Iying for Sewer Permits Under the Second Phase Allocation System It is assumed that there will be more applications for sewer allocations than there is available capacity. Therefore, five qualificatisns are established which must be satisfied at the time of application in orzer for the application to be considered. It is the judgment of the City Council that only projects which can meet these qualifications should be eligible to participate in the allocation under the second sewer allocation. These qualifications are also intended to screen applications in a pre- liminary way to provide a reasonable guide to save unnecessary engineering and design costs for a proposed project where there is little chance of the project qualifying for a sewer allocation permit. The qualifications are as follows: 1, To be eligible residential projects must be within the infill area as shown on map marked Exhibit C, attached hereto, or be found to be a logical extension -3- 9/79 2. 3. 4. i 5. of developed areas located outside the infill area and must be proposed for development in a manner similar to the developed areas to which they are adjacent . No existing projects with septic tanks, may apply for sewer under the allocation system. The project shall be on property where all required public facilities are existing or can be satisfied by City Council Policy Number 17. In no case will a project create a need for public costs for City facilities to service the site such as streets, sewers, etc. Applications for a project under this system shall be limited as follows: Commercial Office, 10 EDUs Commercial General, 20 EDUs Residential, 35 EDUs The City Manager may authorize the acceptance and pro- cessing of applications which exceed the limits by no more than 10% upon a determination that it is necessary to avoid undue problems to the project in the areas of engineering or construction. Individual financing arrange- ments shall not be considered. Application will not be accepted for projects within-.the area covered by the settlement in the Grove litigation. No allocation in excess or' %lese limits stated in qualification number four will be made to any one project. For land use categories without limits the Council may Ciefer allocation if one or more applicant seeks a disproportionate share of the available capacity. In that event the Council may revise this system or otherwise proceed as they consider appropriate. Applicants fcr projects which apparently qualify under the cate- gories listed above, shall tsen prepare the following information as the official application for a second phase sewer allocation permit. 1. Docuaents Reauired for Submittal: The following documents are required to provide suffi- cient information to accurately rate the application, and to determine if the proposal meets Code requirements, Errors or omissions may cause disqualification. a) Application. (Exhibit D) b) Questionnaires for qualification. (Exhibit E) -4- 9/79 - c c) Location map of project site showing existing public facilities, or a letter indicating the degree of completion of the project, d) Application Fees: The submittal of a processing fee in the amount of: $25.00 for community facilities $25.00 for single family residence $50.00 for multiple family residence $50.00 for commercial or industrial uses. The deadline for filing applications is the close of the business day on October 19, 1979 , Applications shall be filed with the Planning Department, Applications may not be made for the contingency or redevelopment categories as a part of the initial allocation under the second phase system, VI. Staff Evaluation After the closing date for receipt of applications a staff com- mittee consisting of the Public Works Administrator, City Engineer, Director of Building and Housing and the Director of Planning, shall evaluate each application in accordance with the provisions of this section. The committee shall prepare a report for the City Council. The report shall show which projects in the judg- ment of the committee meet the qualifications of Section V. The project shall be placed within the appropriate land use categories. ! If applications in any category exceed the capacity available to that category, they shall. be evaluated and ranked by staff based on the point system as set out in the point rating system attached hereto as Exhibit F, G, H and made a part hereof. The report shall also show a point total for each project and a priority list of projects from the one with the highest total to the one with the lowest total for each land use category. Finally the report shall recome32 which projects in each category should receive a sewer allocation permit, The report of the stafl" connittee shall be mailed or otherwise made available to all a2plicants prior to the City Council hearing. VII. City Council Action The City Clerk shall set a public hearing before the City Council to consider the staff committee report. After completion of the public hearing on the report, the Council shall first consider and resolve any disagreements between applicants and staff in regard to the qualifications of Section V, The Council shall then eliminate from further consideration for permits under this second phase allocation all projects which do not meet the Section V qualifications, -5- 9/79 I The Council shall review the recommendations of the Staff Report in regards to the point ranking of qualifying projects within each land use category. The Council shall have the prerogative of making its own policy interpretations of the rating system in reaching its decision on allocations. If the Council is not satisfied that the results of the rating system meet the objectives and purposes and intent of the system, the Council may amend it as they consider necessary in the public interest. When the Council is satisfied with the findings and the ranking of the - projects, they shall adopt a list of such projects which shall become the basis for issuing sewer permits and building permits within the Carlsbad sewer service boundaries. Inclusion of a project on the approved list shall constitute authorization pur- suant to Municipal Code Sections 18.05.030 and 21.49.030 for the exception of that project from the building and planning.moratoria imposed by Chapters 18.05 and 21.49 of the Code. The Council is under no obligation to allocate all or any part of the available sewer capacity pursuant to this system. The Council may use unallocated capacity within a subcategory for another use within the same general category or may move capacity from cate- gory to category. The Council reserves the right to establish a cut-off within each land use category as they consider necessary in order to ensure the available capacity is used in the best interests of the citizens of Carlsbad. Any capacity which is not allocated as a part of this second phase or which is allocated but not used, shall remain in reserve to be reallocated as the Council may determine. VIII. Permits and Fees The successful applicazt within the allocation system shall be required to perform in the following manner in order to obtain and retain a sewer permit: A. For property requiriq discretionary permits, i.e., tenta- tive tract map, PbD, condo permit, variance, CUP, etc., application for such permit shall be filed within sixty days from City Cocncil action approving the list of projects eligible for sewer allocation. The applicant must dili- gently pursue his pe-zxits to a final decision. B. Applic.ztion for building permit must be filed within forty-five days after Cour.ci.1 action approving the list of eligible projects for those projects not requiring further discre- tionary permits, or within sixty days after final City action on the discretionary permit. The applicant must diligently pursue his permits to a final decision. The City Council may extend the time for building permit applications an additional sixty days for major projects. If the applicant cannot meet these deadlines, he should so indicate on the application for a sewer permit. -6- 9/79 C. Concurrently with the issuance of a building permit the applicant shall obtain a sewer connection and pay the required fee. Applicant shall also pay a Public Facility fee as may be adopted by the City Council. D. The applicant must take out his building, sewer and other necessary permits within 20 days after mailing of written notice by the City that plan check for the building permit is complete and that the building permit is ready for issuance. If revisions to the plans are required they shall be made within such time limits as the City Manager may establish, E, After issuance of a sewer permit by the Engineering Depart- ment, construction shall commence within 120 days and be diligently pursued without interruption until completed. If construction does not progress in a reasonably timely way, or is interrupted for any period in excess of 120 days the building permit and sewer permit will be void, All fees shall be non-refundable. F. If a building permit is voided, application for a new building permit may be made which will only be issued if the project qualifies for a new sewer allocation pursuant to such system that the Council may adopt in the future. G. Sewer permits shall not be transferred to another project. ! Failure to comply with these requirements will void the alloc.ation. NOTE TO APPLICANTS This second phase sewer allmation system is adopted based on an assumption that the City will have available some additional sewer capacity. This ass-mption is based on engineers' estimates and the resolution of litigation. The true facts are difficult to determine, the assumptions which underlie the system are sub- ject to change, and the litigation settlement may not be finally concluded. There is no guarantee that a project, which apparently qualifies for an allocation pursuant to this system, will actually receive a sewer permit. Further, there is no guarantee that the issuance of a sewer allocation permit will ensure that capacity will in fact be available at the time of building permit or occupancy, .Sewer which is available when an applicant applies for discre- tionary approval may not be available when application is made for building permit. in the plant, and must be governed by the City Councils' deter- mination of availability of capacity at the time the hookup is made. The fact that an allocation is made for a project requir- ing discretionary approvals shall have no effect on the City's consideration of such approvals, If the approvals are not given within the time limits of this section the allocation shall be The City may not exceed its capacity rights -7- 9/79 automatically revoked and the capacity shall be available for reallocation as the Council may determine. Except for events beyond the control of the City Council, it is the policy of the City Council that an allocation made to an applicant who complies with the requirements of the Second Phase Sewer Allocation System and all other applicable laws and ordinances will not be rescinded or reallocated to another person.
