FEE AS CONDITION OF SECOND PHASE SEWER ALLOCATION
Statement of the Matter
The City Council at its November 6, 1979 meeting directed staff
to prepare documents that would delete the requirement to pay
a Public Facilities Fee as a condition of the Second Phase Sewer
Allocation. The attached Resolution will delete the requirement to pay the fee as a condition to a sewer allocation.

A FUEOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDIRG RESOLUTION NO. 5933 TO DELETE THE REQUIREMENT TO PAY A
PUBLIC FACILITIES FEE AS A CONDITION OF THE
ISSUANCE OF A SEWER ALLOCATION PERMIT IN THE
SECOND PHASE SEiJER ALLOCATION.
WHEREAS, Chapter 18.05.030 of.the Carlsbad Municipal Code
imposes a moratorium on the issuance of sewer permits and building
permits due to the lack of sewer treatment capacity; and
WHEREAS, said Chapter authorizes the City Council to adopt
an allocation system, which provides for the issuance of a
limited number of sewer and building permits as an exception to
said moratorium; and ..
WHEREAS, the City Council adopted Resolution 5933 at its
September 18, 1979 regular meeting which established the Second
Phase Sewer Allocation Systzm; and
WHEREAS, the City Council desires to amend Resolution 5933
by deleting the requirement to pay a special fee (Public Facilitie
Fee) as a condition of the issuance of a sewer allocation permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2, That the Second Phase Sewer Allocation System,
Resolution 5933 is hereby amended by the deletiqn
of paragraph 5 of said resolution.
PASSED, APPROVED AND ADOPTED at a-regular meeting of the City
Council on the 20th day of
