Mgr. is/ DEPARTMENT: SUBJECT: ELM AVENUE EXTENSION - IMPROVEMENT BONDS STATEMENT OF THE MATTER The City holds bonds for the complgtion of Elm Avenue between Avenita de Anita and Santa Clara Way. Tract Development ‘Devel oper Time of Completion CT 74-25 Tang1 ewood High1 and Company January 18, 1979 CT 74-14 Temp1 in Heights McMillin Development May 19, 1980 The bonds secure improvement agreements as follows: CT 76-2 Royal Homes Carlsbad Development May 6, 1980 Two of the Improvement Agreements specify dates of completion which have passed. The Highland Company has requested an extension of time until they are permitted to build additional units on their lots. a two-year extension of time. Carlsbad Development Company is ready to proceed with their portion of the improvements. The City could proceed against the appro- priate bonds or allow extensions of time. An extension of time should recognize the upcoming rainy season and the time of expiration of the Carlsbad Development Company agreement. ($20,000. Labor and Materials) until Hay 22, 1981. McMillin is currently working with other developers, who are commonly bonded for the Elm Avenue improvement, to finalize a joint effort to complete that portion of Elm Avenue. No. 77-16 Dear Members of the Council: After meeting with the City Ebgineer and representatives of McPIillin Development and The Highland Company, we wish to advise that we stand ready, willing and able to pay our share for improving Elm Avenue east of El Cdno Real. Also, we are opposed to releasing the bond on Tract 74-I4 until these improvements are completed. The time Limit has already passed for the Elm Avenue improvements but should be extended a reasonable time. He had plans to complete the whole street some time ago, but one of the participants can not perform now because of finsncia.1 difficulties. Our main reason to complete the 28 ft. street is to get the big trucks off from Appian Road at all hours of the night and day and eliminate the traffic hazard at El Camino Real and Aopiari Road. In addition, we have agreed to improve the southwest corner of Appian Woad and Elm Avenue if we secure Parcel A of Partition Map 823 from The Highland Company and the City of Carlsbad will vacate Appian Road between this parcel and OUT Lot 1 of Tr. 76-2.
