ZCA 118 AMENDMENT TO PLANNING MORATORIUM
FOR MASTER PLAN REVISIONS
STATEMENT OF THE MATTER:
On October 2, 1979 the City Council directed the City Attorney to
prepare an ordinance amending the planning moratorium to allow the
processing of revisions to approved master plans. The City Council
felt that such revisions to approved master plans would not create
further demand on sewer service and would allow the up-dating of
master plans.
The Planning Commission on October 24, 1979 approved ZCA 118 as
contained in their resolution 1560.

RECOMMENDATION
Both the Planning Staff and the Planning Commission have recommended
that the City Council direct the City Attorney to prepare documents
APPROVING ZCA 118 as per Planning Commission Resolution 1560.

MUNICIPAL CODE, CHAPTER 21.49, SECTION 21.49.020
4 BY THE ADDITION OF SUBSECTION (12) TO ALLOW THE
PROCESSING OF REVISIONS TO APPROVED MASTER PLANS

8 WHEREAS, the City Council at their October 2, 1979 meeting,
9 directed that an ordinance be prepared amending the planning
10 moratorium to allow the processing of revisions to approved
11 master plans; and
12 WHEREAS, the Planning Commission of the City of Carlsbad,
13 did hold a duly noticed, public .hearing as prescribed by law
14 on October 24, 1979 to consider the subject amendment; and
15 WHEREAS, the Planning Commission received all testimony and
15 arguments, if any, of all persons desiring to be heard, and
17 upon hearing and considering all factors relating to Zone
18 Code Amendment 118, found the following facts and reasons to
19 exist:
20 1- The project is administrative in nature and additional
discretionary and environmental review is necessary on
21 a project by project basis.
22 2. The proposed amendment would permit changes to previously
approved master plans which themselves have been processed
23 through an environmental review.
24 3. The proposed amendment would have no significant impact
on any flora, fauna or any unique or historical environmental
25 features.
26 4. Processing and approving modifications to existing Master
Plans will not place further demands on sewer service.

WHEREAS, the Planning Commission, by the following vote,
2 recommended approval of ZCA-118 as per attached Exhibit A, dated
3 October 3, 1979, as follows:
4 SECTION 1: That Title 21, Chapter 21.49, Section 21.49.020
5 of the Carlsbad Municipal Code is amended by the addition of
6 Subsection (12) to read as follows:
7 " (12) Applications for revisions to approved Master
Plans in the planned community zones may be
3 accepted and processed."

10 NOES: None
ABSENT: None
12 NOW, THEREFORE, BE IT HEREBY RESOLVED that the foregoing
13 recitations are true and correct.

TITLE 21, CHAPTER 21.49, SECTION 21.49.020
OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SUBSECTION (12) TO ALLOW *
THE PROCESSING OF REVISIONS TO APPROVED

The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21, Chapter 21.49, Section
21.49.020 of the Carlsbad Municipal Code is amended by the
addition of Subsection (12) to read as follows: .
"(12)- Applications for revisions to approved master
plans in the planned community zone may be accepted and
processed." '
EFFECTIVE DATE.: This ordinance shall be effective
thirty deiys after its adoption, and the City Clerk shall
certify to the adoption of this ordinance and cause it.=.to be
published at least once in the Carlsbad Journal within
fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the

The City Council, at their October 2, 1979 meeting, directed
the City Attorney to prepare an ordinance amending the
planning moratorium to allow the processing of revisions
to approved master plans. A copy of the ordinance is
attached.

Staff recommends that ZCA-118 be APPROVED as contained in
Exhibit "A", dated October 3, 1979, for the following
reasons:
