STATEMENT OF THE HATTER

Oak Communications Inc. has requested that the City Council allocate 55 equivalent
dwelling units (EDUs) from the unappropriated reserve. Their request is for the
development of a high employment electronic assembly industry within the Palomar
Airport Business Park. Because they are a new industry with high employement base,
they did not fare well in the allocation process which tended to favor smaller
projects in an effort to spread existing capacity as far as possible.
The attached staff report describes the project and issues in greater detail.

RECOMMENDATION
It is recommended that Council allocate to Oak Communications Inc. 55 EDUs for
development of facilities on Lot 18 in the Palomar Airport Business Park. If Council
concurs, direct the City Attorney to prepare the necessary documents.
Council Action:
11-20-79 Council directed the City Attorney to prepare the necessary
documents allocating the requested 55 EDU's to Oak Communications.

Pursuant to the directions of the City Council, Oak
Communications hereby requests the granting of 55
equivalent dwelling units of sewer capacity from
discretionary capacity for Lot 18 in Palomar Airport
Business Park.
Oak Communications intends to construct divisional
offices, research, engineering and manufacturing facilities
on the subject property. If the City Council approves
our request, Oak will commence operations in leased space,
also in Palomar Airport Business Park, pending completion
of permanent facilities.
The products to be manufactured in the facility include
converters and decoders for the cable and broadcast
television market. The production of such products involves
high technology methods and produces no air, water, or noise
pollution, with requested sewer capacity to be used exclusively
for the sanitary needs of our employees.
Employment levels will reach 400 by the end of the first year
and will reach approximately 1000 by the end of the fifth
year, based on current projections.
Oak Communications is confident that our project provides the
type of industrial development sought by the City of Carlsbad
and hopes for a favorable response to our request.

MEMORANDUM

SUBJECT: REQUEST FROM OAK COMMUNICATIONS INC.
Oak Communications Inc. has, by letter dated October 31, 1979, requested
special consideration from the City Council regarding their need for 55
equivalent dwelling units (EDUs) of sewer capacity from unallocated re-
serves. In analyzing their request, staff has based their conclusions on
interpretation of Council's intent regarding both the establishment of
the second phase allocation procedures and with regard to overall City
developmental goals.
As we are all aware, industrial developmental proposals are unpredict-
able in their occurrence. Council has indicated their desire to be able
to respond to such proposals as they occur on the basis of the merits of
the proposal and its overall benefit to the City. The allocation proce-
dure, on the other hand, was established with the implied intent of
spreading the capacity made available for allocation to as many potential
users as possible. Emphasis in allocation regulations was, therefore,
towards a greater number of smaller projects. Council, in establishing
the allocation procedures, did indicate their concern about maintaining
a viable atmosphere capable of responding to industrial growth by their
establishment of a special category dealing with the expansion of exist-
ing industrial facilities. The case at hand is a new industry in town
and, therefore, does not come under this provision, but was required to
compete in the other industrial category. Because Oak Communications'
program incorporated a large employment base, it suffered in the alloca-
tion process from its attendant demand for more sewer capacity. The
request for 55 EDUs is sufficient capacity to accommodate 500 shift em-
ployees. While this may be considered an admirable goal, as a project
it suffers in comparison with smaller projects that would only employ
100 employees. They would both gain maximum benefit under the employ-
ment category, but the application under consideration would accrue a
significantly larger number of negative points because of its demand for
more sewage treatment capacity. It is because of this that the appli-
cant has requested special consideration from the Council.
The proposal outlined by Oak Communications is a clean industrial use.
It would produce only sanitary wastes and no industrial wastes with its
attendant potential of upsetting our treatment system because of acci-
dents that could happen. It is a more efficient use of sewer capacity
than other types of uses. As an example, residential uses use from
80 to 100 gallons per day per capita. This type of industrial use uses
27 gallons per employee per shift. Their proposal would produce 400 jobs
at the end of the first year with expansion to 1000 after five years.
The project is within existing development; therefore, no additional de-
mand would be created to expand existing public facilities to serve the

project. As stated, their request is for 55 EDUs, which is enough to
serve up to 500 employees.
RECOMMENDATION
It is recommended that Council allocate to Oak Communications Inc. 55 EDUs
for development of facilities on Lot 18 in the Palomar Airport Business
Park.
