SEWER ALLOCATION—OAK COMMUNICATIONS, INC.
Statement of the Matter
The City Council, at your November 20, 1979 meeting, has
directed the City Attorney to prepare a resolution
allocating 55 EDU'S from the Phase II reserve to Oak
Communications, Inc. for a divisional office and for
research, engineering and manufacturing facilities. A
resolution, making the allocation, is attached. Based
on a memorandum from the Public Works Administrator,
dated November 26, 1979, the resolution makes the alloca-
tion subject to the permit and fees provisions of the
Second Phase Sewer Allocation System.

MEMORANDUM

SUBJECT: Sewer Allocation - Oak Industries
The City Council, on November 20, 1979, acted, as a discretionary matter,
to allocate 55 EDUs to Oak Industries subject to the same time constraints
applicable to allocations made as part of the phase two process.
In discussions with Oak it is apparent that certain discretionary approv-
als are necessary before they can commence their project. It will be
necessary to secure a minor subdivision of lot 18 as well as Coastal Com-
mission approval for their project.
For purposes of preparing the resolutions which formally grant the 55
EDUs, the applicable time constraints appear to be: (1) application for
discretionary action within 60 days of adoption of the resolution; and
(2) submittal of application for building permit within 60 days of final
City action on discretionary action. The other time constraints are not
affected by the need for discretionary permits.
Oak indicates that their program calls for construction to commence in
April, 1980.
If you have any questions or need further information during the next

RESOLUTION NO. 6011
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING
THE ALLOCATION OF 55 EDU'S TO OAK
COMMUNICATIONS, INC. FOR PROPOSED
DIVISIONAL OFFICES, RESEARCH, ENGINEER-
ING AND MANUFACTURING FACILITIES.
WHEREAS, Chapters 18.05 and 21.49 of the Carlsbad Municipal
Code impose a moratorium on the processing of discretionary
approvals and on issuance of sewer permits and building permits
due to a lack of sewage treatment capacity; and
WHEREAS, said chapters authorize the City Council to adopt
an allocation system which provides for the issuance of a limited
number of sewer and building permits and the processing of some
discretionary approvals as an exception to said moratorium; and
WHEREAS, as a part of the adoption of the Second Phase
Sewer Allocation System, the City Council determined to reserve
approximately 300 EDU'S from the 1,312 available for allocation
to be used on a case by case basis, depending on benefit to
the community; and
WHEREAS, Oak Communications, Inc. has applied for 55 EDU'S
for a divisional office and for research, engineering and
manufacturing facilities to employ 400 persons by the end of
the first year, increasing to approximately 1,000 persons by
the end of the fifth year, and after considering the merits of
said applications, the City Council has determined to approve
said allocations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.

2. That the City Council hereby authorizes allocations
of sewage treatment capacity from the Second Phase Reserve as
follows:
(a) Sewer connection permits for 55 EDO'S to Oak
Communications, Inc. for a proposed divisional
office and research, engineering and manufacturing
facilities to be constructed in Palomar Airport.
Business Park.
(b) This allocation is conditioned upon compliance
with the permits and fees provision of the Second
Phase Sewer Allocation System as adopted by
Resolution No. 5933.
3. That this resolution shall constitute authorization
pursuant to Carlsbad Municipal Code Sections 18.05.030 and
21.49.030 to exempt said project from the building permit and
Planning moratoria imposed by Chapters 18.05 and 21.49 of the
Code. Pursuant to that exemption, the City Manager is authorized
to accept applications for said project and to process them in
accordance with the provisions of the Carlsbad Municipal Code as
modified by the Second Phase Sewer Allocation System.
PASSED, APPROVED AND'ADOPTED at a regular meeting of the City
Council of the City of Carlsbad, California on the 4th day of
December / 19 79 by the following vote, to wit:
