Statement of the Matter
The city's present POLICE CHIEF is scheduled to retire as of
January'l, 1980. As recruiting continues for a permanent POLICE
CHIEF it is considered desirable to employ an Interim POLICE CHIEF.
This action would permit the new permanent CITY MANAGER the option
of selecting the chief with whom he will serve. Therefore, staff
recommends the hiring of an Interim POLICE CHIEF.

RESOLUTION NO. 6042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A PERSONAL SERVICES AGREEMENT WITH RICHARD 0. BAUGH.
WHEREAS, the present POLICE CHIEF is scheduled to retire
on January 7, 1980; and
WHEREAS, it is desirable to employ an Interim POLICE CHIEF
pending recruitment of a Permanent POLICE CHIEF;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:

That the above recitations are true and correct.
That the City Yanager is hereby authorized and
directed to enter into a Personal Services Agreement, a copy of
which is attached hereto and made a part hereof, with RICHARD 0.
BAUGH as an Interim POLICE CHIEF.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the
Carlsbad City Council held on the Znd day of January #

SUBJECT: APPOINTMENT OF AN INTERIM CHIEF OF POLICE
The retirement of Chief Kundtz becomes effective January 1,
1980. Under the Carlsbad Municipal Code, the City Manager
is responsible for appointing the Chief of Police. This
responsibility should be exercised by the newly appointed
City Manager. If the City Council appoints a City Manager
immediately, a period of a few months would be necessary for
the Manager to become sufficiently familiar with the depart-
ment and its needs in order to make a reasoned selection.
The selection of Chief of Police should be based upon a thorough and careful recruitment and evaluation of the best available
candidates. I have recommended the City hire Ralph Andersen
and Associates to assist in that effort. The recruitment and
evaluation process will require 3 to 4 months to complete.
During the interim period, while the recruitment and evaluation process is underway and as the new City Manager assumes the
responsibilities of that office, the continuity of qualified and capable leadership of the Police Department is of utmost importance. On an interim basis, this leadership and direction can be provided best by one who is experienced and has proven capability in the position of Police Chief.
Based on suggestions received from several sources, I am prepared to appoint an individual who has the experience and proven capability considered necessary for the position on an interim basis. However, this appointment would call for entering into a personal services agreement with the individual for a three month period. The City Council's authorization is required in order for me to enter into the personal services agreement.
Timing is important. Though Chief Kundtz's retirement is effective
January 1, 1980, I have arranged with him to continue as Police
Chief through January 6th so that the City Council might consider
this matter at next Wednesday's meeting. If the Council does
authorize the personal services agreement, the appointment of the
interim chief would be made effective Monday, January 7th.

I recommend, therefore, the City Council consent to consider
AB 6124 at your January 2, 1980 meeting and approve Resolution
No. 6042, authorizing me to enter into the personal services
