DATE: DEPARTMENT: CITY OF CARLSBAD JANUARY 2, 1990 CITY MANAGER Subject:PROPOSED REORGANIZATION OF THE COSTA REAL MUNICIPAL WATER DISTRICT (CRMWD, FORMERLY CMWD) Statement of the Matter At the December 4, 1979 City Council meeting, you accepted the Report from Ralph Andersen & Associates on Water Service in the Carlsbad Area, and you directed staff to prepare documents for initiating the recommended establishment of the CRMWD as a subsidiary district of the City. The pre- paration of those documents and review of procedures for application to the Local Agency Formation Commission (LAFCQ) are underway. At this time, the City Council may wish to appoint a steering committee of two of its members to work with staff in the application process. The participation of Council members will lend considerable weight to the City's presentations and will also ensure consistency with Council policy guide- lines throughout the proceedings. The attached letter dated December 13, 1979 from CRMWD indicates the Board of Directors have received the Andersen Report and suggests some informal discussions to clarify various points. The Council appointed steering committee would be available to meet with the CRMWD for such informal discussions. Dear Mr. Dernetz: Thank you very much for funishing to the Costa Real Municipal Water District five copies of the subject report, prepared by your Management Consultant, Ralph Andersen & Associates. The Costa Real Municipal Water District management and staff spent a considerable amount of time in working closely with your consultants in the preparation of the study as it relates to the Costa Real Water District functions and we are gratified that the report, in dealing with the Water District matters, reflects our input. Our Board of Directors have had an opportunity to review the subject report and has also referred the proposed program for the creation of a subsidiary district to our Special Committee, comprising Director Don MacLeod, Director Fred W. Maerkle, Legal Counsel Paul S. Swirsky, Special Consultant S.M. Schmidt, and the undersigned. The Special Committee's evaluation of the Andersen Report has brought forth several very prominent and important issues that we sincerely believe merit a specific discussion with a counter-part committee of the Carlsbad City Council. Inasmuch as the "Andersen Report" will be a substantive supplementary document in your application to LAFCO for the formation of a subsidiary district, we believe that the report should be responsive to some basic questions that the application and subsequent proceedings will bring forth in the form of public discussion. Accordingly, we are of the opinion that the City Council will want the benefit of our input at this preliminary stage, so that at such time there is public discussion, our various points of issue and the points of debate, can be based upon factual information and professional opinions, which have the benefit of background data and facts that would support those opinions. Page 2 Mr. Wayne Dernetz December 13, 1979 In summary, we firmly believe that our citizens, voters, tax payers, and water service customers of the entire Costa Real Municipal Water District, should have the full benefit of factual information and opinions so that the basic questions can be debated in a climate of diplomacy and statesmanship. To this end we would pledge our interest and availability to respond to the schedule of the City of Carlsbad so that our request to have this informal discussion with you does not impede your time schedule for action.
