GENERAL'MUNICIPAL ELECTION
Statement of the Matter
The date established for the General Municipal Election is April 8, 1980.
It is necessary that Council, by resolution, call the election for the pur-
pose of filling 3 Council seats. Also included in the resolution, per
Council action on December 5, 19\78, are the measures pertaining to making
the offices of City Clerk and City Treasurer appointive. ,
Attached is Resolution No. {0Q*/3 , which calls the Election on April 8,
1980. Please note the time set for the polls is 7:00 A.M. to 7:00 P.M.
Council may change that time, if desired.
Also attached is Resolution No. 6>Q*/£/ , directing the City Attorney to pre-
pare an impartial analysis of the measures. This action is optional.
In addition, attached is Resolution No. (jotf-^T , authorizing Council to
file written arguments in favor of the measures. Once again, this action is
optional. The suggested last day for filing arguments is February 5, 1980.
Resolution No. &OV6 , adopts regulations for candidates pertaining to
materials and costs. In accordance with previous action, the limit for
candidates' statements is maintained at 200 words.
The remaining Resolutions, No. (ffOyj , and No. /oOV(f , request the Board
of Supervisors to permit the Registrar of Voters to render specified services;
and order the canvass of the Election to be made by the City Clerk.
Council, in the past, has established a $25.00 filing fee for candidates. If
a change is desired to a lesser fee, Council should so instruct the Clerk.
Further documents will be presented to Council, as required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, CALLING AND GIVING
NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL
ELECTION TO BE HELD IN SAID CITY ON TUESDAY,
APRIL 8, 1980, FOR THE ELECTION OF CERTAIN
OFFICERS OF SAID CITY AS REQUIRED BY THE
PROVISIONS OF THE LAWS OF THE STATE OF
CALIFORNIA RELATING TO GENERAL LAW CITIES AND
FOR THE SUBMISSION TO THE QUALIFIED ELECTORS
OF SAID CITY QUESTIONS RELATING TO MAKING
THE OFFICES OF CITY CLERK AND CITY TREASURER
WHEREAS, under the provisions of the laws relating to
general law cities in the State of California, a regular municipal
election shall be held on April 8, 1980, for the election of
3 members of the City Council of said City for the full term of
four years; and
WHEREAS, the City Council of said City also desire to •
submit to the qualified electors of said City at said election
the questions relating to making the offices of City Clerk and
City Treasurer appointive as hereinafter set forth;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER
AS FOLLOWS:
SECTION 1. That pursuant to the requirements of the laws
of the State of California relating to General Law Cities
within said State, there shall be, and there is hereby called
and ordered, held in the City of Carlsbad, California on
Tuesday, April 8, 1980, a regular municipal election of the
qualified electors of said City for the purpose of electing
3 members of the City Council of said. City for the full term
of four years.

SECTION 2. That said City Council, pursuant to its right
and authority so to do, does hereby determine that there shall be
and there is hereby ordered submitted to the qualified electors
of said City at said regular general municipal election the
following questions, to wit:

A cross- (+) placed in the 'voting square after the word
"YES" in the manner herebefore provided shall be counted in
favor of the adoption of the questions. A cross (+') placed in
the voting square after the word "NO" in the manner hereinbefore
provided shall be counted against the adoption of the questions.
SECTION 3. That the ballots to be used at said election
shall be, both as to form and matter contained therein, such
as may be required by law to be used thereat.
SECTION 4. That the City Clerk of said City is hereby
authorized, instructed and directed to procure and furnish
any and all official ballots, notices, printed matter and all
supplies, equipment and paraphernalia that may be necessary in
order to properly and lawfully conduct said election.
SECTION 5. That the polls for said election shall be
open at seven o'clock a.m. of the day of said election and
shall remain open continuously from said time until seven o'clock

1 p.m. of the same day when said polls shall be closed, except as
2 provided in Section 14301 of the Elections Code of the State of
3 California.
4 SECTION 6. That in all particulars not recited in this
5 Resolution, said election shall be held and conducted as provided
6 by law for holding municipal elections in said City.
7 SECTION 7. That notice of the time and place of holding
8 said election is hereby given and the City Clerk is hereby
9 authorized, instructed and directed to give such further or
10 additional notice of said election, in time, form and manner
11 as required by law.
12 SECTION 8. That the City Clerk shall certify to the
13 passage and adoption of this Resolution; shall enter the same
14 in the book of original Resolutions of said City; and shall
15 make a minute of passage and adoption thereof in the records
16 of the proceedings of the City Council of said City, in the
17 minutes of the meeting at which the same is passed and adopted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, DIRECTING THE CITY
ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS OF
WHEREAS, a General Municipal Election is to be held in the
City of Carlsbad on April 8, 1980, at which there will be submitted
to the qualified voters of said City, the following measures:
SHALL THE OFFICE OF CITY CLERK BE APPOINTIVE?
' SHALL THE OFFICE OF CITY TREASURER BE APPOINTIVE?
WHEREAS, the City Council desires to have an impartial
analysis prepared showing the effect of such Measures on the
existing law and showing the operation of such Measures;
NOW, THEREFORE, IT IS HEREBY RESOLVED, DECLARED, DETERMINED
AND ORDERED by the City Council of the City of Carlsbad as
follows :
SECTION 1. Pursuant to the provisions of Section 5011
of the Elections Code of the State of California, this City
Council does direct the City Attorney to prepare an impartial
analysis of the Measures .

5 FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING
TO MATERIALS SUBMITTED TO THE ELECTORATE AND
4 THE COSTS THEREOF FOR THE GENERAL MUNICIPAL
ELECTION TO BE HELD IN SAID CITY ON TUESDAY,
5 APRIL 8, 1980.

V WHEREAS, Section 10012 of the Elections Code of the State
8 of California provides that the governing body of any local
9 agency adopt regulations pertaining to materials prepared by any
10 candidate for a municipal election, including costs thereof;
11 NOW,. THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD,
12 CALIFORNIA. DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER
13 AS FOLLOWS: -
14 SECTION 1. GENERAL PROVISIONS. That pursuant to Section
15 10012 of the Elections Code of the State of California, each
16 candidate for elective office to be voted for at the General
IV Municipal Election to be held in the City of Carlsbad on April
18 8, 1980, may prepare a candidate's statement on an appropriate
19 form provided by the City Clerk. Such statement may include
20 the name, age and occupation of the candidate and a brief
21 description of no more than Two Hundred (200) words of the
22 candidate's education and qualifications expressed by the
23 candidate himself. Such statement shall not include party
24 affiliation of the candidate, nor membership or activity in
25 partisan political organizations. Such statement shall be
26 filed in the Office of the City Clerk at the time the candidate's
27 nomination papers are filed. Such statement may be withdrawn,
28 but not changed, during the period for filing nomination papers

and until 5:00 P.M. of the next working day after the close of
the nomination period.
SECTION 2. SPANISH LANGUAGE. The City Clerk shall provide
a Spanish translation of the candidate's statements to be made •
available to any voter upon request, and shall so indicate its
availability in the Voter's Pamphlet.
SECTION 3. ADDITIONAL MATERIALS. No candidate will be
permitted to include additional-materials in the sample ballot
package.
SECTION 4. PAYMENT. Each candidate filing a candidate's
statement shall be billed for the services rendered, a sum not
greater than the actual prorated costs of printing and handling;
and such bill" shall be due and payable immediately upon receipt
thereof.
SECTION 5. That the City Clerk shall provide each
I candidate, or the candidate's representative, a copy of
this Resolution at the time nominating petitions are issued.
SECTION 6. That the City Clerk shall certify to the
passage and adoption of this Resolution; shall enter the same
in the book of original Resolutions of said City; and shall
make a minute of passage and adoption thereof in the records of
the proceedings of the City Council of said City, in the
minutes of the meeting at which the same is passed and adopted.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, REQUESTING•THE BOARD
OF SUPERVISORS OF THE COUNTY OF SAN DIEGO,
TO RENDER SPECIFIED SERVICES TO SAID CITY
RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL
ELECTION TO BE HELD IN SAID CITY ON TUESDAY,
APRIL 8, 1980.
WHEREAS, a General Municipal Election is to be held in the
City of Carlsbad, California, on April 8, 1980; and
WHEREAS, in the course of conduct of said election and in
relation thereto it will be necessary to mail sample ballots and
polling place information to the registered voters of the City,
and it will facilitate such mailing if the Registrar of Voters
of the County of San Diego will make available to said City the
computer record of the names and addresses of all eligible
registered voters in order that labels may be printed for
attaching to self-mailer sample ballot pamphlets; and
WHEREAS, all necessary expense in performing this service
shall be paid by the City of Carlsbad;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to the provisions of Section 22003 of
the Elections Code of the State of California, this City Council
hereby requests the Board of Supervisors of said County to permit
the Registrar of Voters to prepare and furnish to said City for^use
in conducting said election the computer record of the names and
address of all eligible registered voters in said City in order
that the City may print labels to be attached to self-mailer

sample ballot pamphlets ; and will also furnish to the City printed
indices of the voters to be used by the precinct board at the
polling place; and will make available to the City additional
election equipment and assistance according to state law.
SECTION 2. That said City shall reimburse said County
services performed when the work is completed and upon
presentation to the City of a properly approved bill.
SECTION 3. That the City Clerk is hereby directed to

3 OF THE GENERAL MUNICIPAL ELECTION TO BE HELD
ON TUESDAY, APRIL 8, 1980, TO BE MADE BY THE

6 WHEREAS, a regular general municipal election will be held
7 and conducted in the City of Carlsbad, California, on Tuesday,
8 April 8, 1980, as required by law; and
9 WHEREAS, the City Council of said City desires the canvass
10 of said election to be made by the City Clerk of said City;
11 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD,
12 CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER
