Statement of the Matter
The City Council, at your meeting of January 2, 1980,
directed the City Attorney to prepare the necessary
documents approving Tentative Subdivision Map (CT 79-15)
and Condominium Permit (CP-18). The resolution of approval
is attached.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE SUBDIVISION
MAP (CT 79-15) FOR A 7--UN1T CONDOMINIUM
PROJECT AND APPROVING CONDOMINIUM
PERMIT (CP-18) FOR SAID PROJECT ON
APPROXIMATELY .40 ACRE, LOCATED ON THE
WEST SIDE OF JEREZ COURT, NORTH OF
GIBRALTAR. APPLICANT: LA FORTE.
WHEREAS, on November 14, 1979 the Carlsbad Planning Commission
adopted Resolution No. 1559 recommending to the City Council
that Tentative Subdivision Map (CT 79-15) and Condominium Permit
(CP-18) be denied; and
WHEREAS, the City Council of the City of Carlsbad held a
public hearing on November 20, 1979 to consider the recommendations
of the Planning Commission and to receive all recommendations
and hear all persons interested in or opposed to Tentative
Subdivision Map (CT 79-15) and Condominium Permit (CP-18); and
WHEREAS, at the conclusion of said meeting the City Council
directed the matter back to the Planning Commission for preparation
of findings and conditions consistent with approval of the
Tentative Subdivision Map and Condominium Permit and to
return the matter to them for further consideration; and
WHEREAS, on January 2, 1980, the City Council considered
said findings and conditions; and
WHEREAS, said Tentative Subdivision Map and Condominium
Permit have been declared to have a nonsignificant impact on
the environment and a Negative Declaration has been prepared
and filed in compliance with the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of Carlsbad as follows:
B. That the findings of the Planning Commission as contained
in the Staff Report, dated December 12, 1979 (Revised December 26,
1979) , on file in the Planning Department and incorporate by
reference, constitute the findings of the City Council with
the exception of Finding 6, which has been revised to read
as follows:
"6. The site is physically suitable for the type
and density of development because:
A. The lot is relatively level and little
is devoted to unusable slopes."
C. That said Tentative Subdivision Map, together with
the provisions for its design and improvement and subject to the
conditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D. That Tentative Subdivision Map (CT 79-15) and
Condominium Permit (CP-18) are hereby approved subject to all
applicable requirements of the Carlsbad Municipal Code and to
the satisfaction of the following conditions:
1. Approval is granted for CT 79-15/CP-18 as shown on
Exhibit A, dated October 8, 1979; B and C, dated September 12,
1979, on file in the Planning Department and incorporated by
reference herein. Development shall be substantially as shown
unless otherwise noted herein.
2. The applicant shall submit a reproducible copy of
the condominium plan prior to approval of the final map. The
reproducible shall include a note indicating that laundry
facilities and utility meters with the exception of the hot
water meter will be provided individually. This plan shall
incorporate all requirements of approval and shall be subject to
approval of the Planning Director.
3. The applicant shall comply with all rules and
regulations of the respective sewer and x^ater districts regarding

sewer to the property.
4, The applicant shall pay park-in~lieu fees prior to
approval, of the final map.
5. This subdivision is approved upon the express condition
that the final map shall not be approved unless the City Council
finds at the time of such approval that sewer service is available
to serve the subdivision.
6 . Street trees of a variety approved by the Parks and
Recreation Department shall be installed to City specifications
at 40 foot intervals along all public street frontages.
7. Prior to the final map approval, the applicant shall
pay a public facilities fee as established in City Council Policy
No. 17 as agreed by the applicant.
8. The applicant shall provide a minimum of eight square
feet per unit of containerized planters along the driveway and
shall provide embossed concrete and lighting as shown on
Exhibit A, dated October 8, 1979.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
15th day of January > 1980 by the following vote, to
wit:
