SUBJECT:CHANGE OF ZONE FROM L-C TO THE PUBLIC UTILITY WITH
FLOODPLAIN OVERLAY.

STATEMENT OF TKL MATTER
The subject property is the site of the existing San Marcos County
Water District inactive sewage treatment facility which is located
at the head of the San Marcos Canyon, west of Rancho Santa Fe Road
in the La Costa area. The General Plan indicates utility for this
site. .
The property was annexed to the City as L-C Zone. The L-C Zone
is an interim zone pending- future land use planning. The applicant
is preparing to reactivate and enlarge the plant and therefore a
development zone is necessary. The P-U Zone is the proper zone
for the implementation of the General Plan as well as the proposed
land use. The Floodplain Overlay is required on property
designated by the Corp of Engineers as a floodplain area.
Precise Development Plan 3 is a companion application, Please see
that item for staff report. The City Council must approve this
Change of Zone prior to taking action on PDP-.3.

RECOMMENDATION
The Planning Commission and Planning Staff recommend that the
City Council direct the City Attorney to prepare documents
APPROVING ZC-207, as per Planning Commission' Resolution No. 1576.
Council Action:
1-15-80 Council directed the City Attorney to prepare documents
approving ZC-207 as per Planning Commission Resolution 1576.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A ZONE CHANGE FROM
L-C (LIMITED CONTROL) TO P--U (PUBLIC UTILITY) AND
F-P (FLOOD PLAIN OVERLAY) FOR A FIVE ACRE SITE
LOCATED WEST OF RANCHO SANTA FE AT THE ENTRANCE TO
APPLICANT: La Costa Land Company and
WHEREAS, a verified application for certain property,
t.o-wit :
A parcel of land lying within the northeast quarter
of Section 30, Township 12 South, Range 3 West,
San Bernardino Meridian, in the County of San Diego,
State of California12
has been filed with the City of Carlsbad, and referred to the13.
Planning Commission; and

WHEREAS, said application constitutes a request as provided

by Title 21 of the Carlsbad Municipal Code; and16
WHEREAS this project complies with the requirements of the
City of Carlsbad's Environmental Protection Ordinance of 1972,

and the State Environmental Quality Act, in that the project

has been processed through Environmental Review and the pro-
posed change of zone will not cause any substantial environ-
mental impacts,- and an environmental impact- report has been
certified by the San Marcos County Water District for this
project. Appropriate mitigating measures will be taken on
subsequent actions to approve development of the site.

WHEREAS the Planning Commission did on the 12th day of
December, 1979, hold a duly noticed public hearing as prescribed
by law to consider said request; and

WHEREAS, at said public hearing a staff .report was presented
and all persons desiring to speak on the subject zone change
request were heard;
NOW, THEREFORE BE IT RESOLVED, by the Planning Commission of
the City of Carlsbad as follows:
A. That the above recitations are true and correct. .
B, After consideration of all evidence presented at the public
hearing, the Planning Commission finds the following facts
and reasons to exist:
1) The proposed change of zone is consistent with the General
Plan since the P-U Zone specifically allos public
facilities as indicated on the General Plan Land Use Map.
2) The P-U Zone requires a Precise Development Plan of
development. Conditions may be placed on the Precise
Development Plan to meet requirements of the General
the site is adequate in size and shape to accommodate a
sewer treatment plant.

4) The project is consistent with all City public facility
policies and ordinances since the reactivation of this
facility will provide sewer service in the service area.
17 5) The proposed change of zone will not cause any substantial
environmental impacts, and an environmental impact report
has been certified by the San Marcos County Water District
for this project. Appropriate mitigating measures v/ill
be taken on subsequent actions to approve development of
the site.
6.) The floodplain overlay zone will require an engineering
report on impacts of construction on flooding.

C. That the Planning Commission recommends APPROVAL of ZC-207
according to attached Exhibit "A", dated December 12, 1979.

Planning Commission of the City of Carlsbad, California, held
