Atty DEPARTMENT: Engineering C> MSr* SUBJECT- REQUEST FOR MODIFICATION OF THE CONDITIONS OF APPROVAL FOR THE LAKE CALAVERA HILLS STATELLITE WASTEWATER TREATMENT FACILITY STATEMENT OF THE MATTER The Lake Calavera Hills developer has requested a modification of the conditions of the precise development plan for the wastewater reclamation plant. Both the Planning Commission and the City Council approved a condition limiting grading of the treatment plant site to the dry season (April 16 to October 31). The developer has asked for the removal of that condition. The Engineering Department is satisfied that erosion and siltation danger to adjacent properties can'be mitigated through the installation of siltation basins along drainage channels above and below the treatment plant site. With these protective facil- ities the Engineering Department would not object to removal of. the condition limiting grading to the April 16 to October 31 time period. RECOMMENDATION The Council may choose to make a finding that the modification of conditions is simply a substitute mitigation measure and grant the developers request, or may refer the matter to the Planning Commission. Specifically, we are interested in proceed- ing on grading, prior to April 15, which would not be permitted under the original conditions of approval. .As I understand, your department has reviewed our grading plans and have determined that adequate safe- guards have been incorporated that would prevent erosion or siltation due to storm runoffs during this period. Modification of this condition would require a hearing before the City Council. Accordingly, we would like to request consideration of this matter before the City Council at their next meeting.
