SUBJECT: QUITCLAIM OF EASEMENTS FOR DRAINAGE STRUCTURES AND SLOPE RIGHTS
IN CARLSBAD PLAZA SOUTH (PS230)
STATEMENT OF THE MATTER
Hughes Investments, developer of Carlsbad Plaza South (Handyman Shopping Center) h;
requested the City quitclaim various easements for drainage structures and slope r
along the westerly right-of-way of El Camino Real. These easements were originall>
dedicated to the County of San Diego, but were acquired by the City along with the
Camino Real right-of-way. Since that time the site has been filled and regraded.
Because of this the &lope easements are of no further use to the City. The drainac
easements have been replaced by new easements and the old drainage structures have
been either abandoned or removed.

RECOMMENDAT I ON
If Council concurs, authorize the Mayor and City Clerk to execute a quitclaim deer
of subject easements. -

Dear Vr. Evans:
At the request of Tom Purcell of Hughes Investments, we are requesting that
certain easements over Parcels 1 and 2 of P.V. 8585 for slopes and drainage be quit
claimed. The easements in question are:
Easement for drainage structures and slope rights recorded October 19,
1966 as file/page number 167629.

b. Easement for slope purposes recorded January 9, 1970 as file number
b279.
The site is now graded and landscaped in Parcel 1 and rouqh graded in Parcel 2. No
further grading of any significance only F,l Camino Real is anticipated.
The easements for drainage structures have been replaced by the "Public Utility,
Storm 9rain and Access" easement recorded Varch 24, 1978 as file number 78-
11 6596.
Enclosed are several documents which will assist you in analyzing and approving
this request, as follows:
1. A copy of the approved Parcel Uap No. 8586, with the easements in
question colorec' in yellow.
A copy of the title report prepared for the above parcel map, with the
appropriate easemeqt j terns qarked in yellow.
A copy of the ALTA survey dated 11/16/78, with the same easements marked.
