SUBJECT: REQUEST FOR ALLOCATION OF SEWER CAPACITY FROM THE
COUNCIL RESERVE. - PIO PICO NORTH
STATEMENT OF THE MATTER
The Council has 241.27 EDUs remaining in reserve from the 300
permits they originally set aside. PIO PICO NORTH has
requested 5.6 EDUs from this reserve. The Council has indicated
that the EDUs held in reserve are to be utilized to benefit the
community.

RECOMMENDATION
If the Council wishes to grant this request, their action is to
direct the City Attorney to prepare documents allocating 5.6 EDUs
to PIO PICO NORTH.

Honorable City Hivor and Council Members,
This letto." constitutes a formal reouest that I may address your membership
at the February 5th Council meeting regarding hardship sewer problems we
are having on the above referenced project.
I had purchased this property in .Time of 1979 after having receiver! -from the
seller documented -engineering studies for a proposed seepage pit system. Prior
to close of escrow I met with several city staff members to verify all alleper1
facts, in order to avoid future problems and to protect a sizable investment.
On September 13, 1^79 final plens were submitted and plan check fees were paid
for. At this time T inquired as to the possibility of obtaining a sewer perm.it
in order to avoid building a septic system find wan told that none were available.
On or about September ?1, 1979, R.V/. Vatson Jr., my contractor, delivered the
engineering reports to the engin<=erinr department and arain inquired as to the
availability of sewer permits and he was told that none were available. V.Te
since found out that the city did in fact allocate permits during the period of
September 1 Pth thru October 25th and that a notice o^ such availability was
published in a local newspaper. Unfortunately for me, I did not read these
notices since 1 don't live here a.ll the time. I have since discussed this
problem with many members of the city staff and ca.n certainly understand how
difficult their task in in notifying everyone abotit such things. In fact, T
find it hnd to see how much progress takes nlace all the time in spite of
your many changer in staff personnel r-r.d your attempts to faitly distribute
sewer allocation with r,o little supply and such a great demand. T would not
wish to '• "• i" th'it position day to day.
In the cou^e of developing and testinr our seepare pits we ran into a severe
problem. T'he seepage pits were dup (M to a depth of nine feet, as reouired
by the health department a.nd tented (positive) on december 2U, 197^. T'he
County he]f;th department indicated in a memo prior to thst date that if such
a test proved positive thev would ^i ve us a neptic tank permit, f.inc-e the
tests proved positive I went out and mnde a substantinl loan commitment to
build the project. However, after <]<^1 iverirr- the test results to the county
health depprtmen.t, they decided they wanted an additional test to determine

if the water table was still at 'he 1*4 foot level. Apparently they need to
have the water'table at least five feet be low the bottom of the seenape pit,
which is nine :'eet deep. This water tnble bar! been tested prior to my purchasing
the property, j.lmost one year apo, and the level war: at lU feet at tha.t time.
Now, since the water level is only thro~ fee + below the bottom of the pit this
becomes a water -i>.- lity control proMT and the health department will not
issue a septic permit. Thin additional testing of" the water level wan something
which nobody mentioned n.s beinr '' potential probV'm or requiring further study
at time of construction. However, it raker sense to r.e as to why the health
department would wish to run sue1' a tent a/rain. I .lust wish I had known that
this potential problem, existed so 1 eorl d have better protected my investment.
At this time to not be able to complete this project would create a severe
financial hardship on me because of loan commitments T have made. It would
take 5-6 EDU's to complete this project, now. It is my understanding that
under certain circumstances the council may allocate sewer permits. I also
would appreciate the councils consideration of the additional benefits which
would be derived if this project were built at this time. First of all it
helps to promote inner city p.rowth and would not create any extraordinary
expense in time or labor for the city since the existinp sewer lines run alone
side this property. The property is located only a stone's throw from city
hall, an area in which there are no vacancies in anv of the existing office
spaces. This would indicate a stronp demand for consumer services in the
immediate area for the citizens of Carlsbad. Furthermore this size project
would create approximately 9^ additional jobs for Carlsbad residents.
Naturally, the city would receive additional tax revenues, as well.
In closing, I would like to just say t>",nk you for kird .consideration' of
this request and any help or support you can pive re would be very much
appreciated.

SUBJECT: REQUEST FOR ALLOCATION OF SEWER CAPACITY
FROM THE COUNCIL RESERVE
By memorandum of August 28, 1979, the Sewer Committee recommended
to the City Council that 1000 EDUs of the 1300 EDUs available be
allocated and the remaining 300 EDUs be held in reserve. The
Council adopted a process for allocating 1000 EDUs on September 18,
1979.
On November 20, 1979, Oak Communications requested and was granted
55 EDUs from the Council reserve. On January 2, 1980, the Council
approved the allocation of 3.73 EDUs to the Aguaculture Farm on the
Agua Hedionda Lagoon.
The Council has received a request for sewer allocation from the
remaining reserve from PIO PICO NORTH. The Pio Pico North office
building has been known to the City Engineering Department since
September, 1978, when the City addressed a letter to the County
Health Department asking for an evaluation of a septic tank system.
Evidently the property changed hands in June, 1979 prior to the final
approval of a septic tank system by the Health Department. Since the
Health Department reviews engineering reports independently of the
City Engineering Department, we were not aware of any problems with
the proposed septic tank system until last week. The office building
is proposed for the corner of Pio Pico and Stratford.
