Subject: FIRST REVISION TO SECOND PHASE SEWER ALLOCATION SYSTEM Statement of the Matter The City Council, at your February 5, 1980 meeting, approved the recommendations of the Sewer Committee that the 189.6 EDU'S remaining from the Second Phase Sewer Allocation System should be made available to the single family residential (more than four) , rr.ultiple family residential and new industrial land use cate- gories. In order to utilize all of the available EDU'S and avoid unreasonable splitting of projects, the Council determined it was necessary to use 28.4 EDU'S from the discretionary reserve in making an allocation. In accordance with your direction we have prepared a resolution making a first revision to the second phase sewer allocation making the total of 218 EDU'S available to various land use categories. The City Council also determined to allocate all the available EDU'S to specific projects within each of the categories. generally in accordance with the point-ranking resulting"fron?. the initial allocation under the Second Phase Sewer Allocation System. WHEREAS, the City Council adopted the Second Phase Sewer Allocation System on September 18, 1979 by Resolution No. 5933, and amended it by Resolution No. 5479 on November 20, 1979; and WHEREAS, the City Council has, by Resolution Nos. 6011, 6013, 6035, 6040 and 6041, authorized the allocations of sewer capacity to certain projects; and WHEREAS, these allocations did not use all of the sewer capacity available to the City of Carlsbad; and hXEREAS, the City Council, on December 18, 1979, directed the Sewer Committee to report back to the Council with recommenda- tions on .how to use the remaining EDU'S; and WHEREAS, the Sewer Co'inmittee met and after study reported to the City Council at their February 5, 1980 meeting and recommended that the Second Phase Sewer Allocation System be revised to allocate the 189.6 remaining EDU'S to the single family residential (greater than fear) , multiple family residential and new industrial land use categories according to the rankings made pursuant to the Seco'nd Phase Sewer Allocation System; and WHEREAS, the City Council has determined that in order to avoid unreasonable splitting of a project and to make maximum use of the available capacity it is necessary to add 28.4 EDU'S from the discretionary reserve to the other EDU'S available for allocation; NOW, THEREFORE, BE IT RESOLVED. by the City Council of the 1 2 3 4 5 9 10 11 19 20 21 22 23 24 25 26 27 28 City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City Council finds that there are 189.6 EDU'S remaining from the initial allocation pursuant to the Second Phase Sewer Allocation System. 3. That the public interest requires that 28.4 EDU'S be taken from the discretionary reserve to be allocated together with the 189.6 for a total of 218 EDU'S. 4. That 68 EDU'S are hereby made available for allocation in the single family (more than 4) land use category. 5. That 58 EDU'S are hereby made available for allocation in the multiple family land use category. 6. That 92 EDU'S are hereby made available for allocation in the new industrial land use category. 7. That all EDU'S made available by this resolution shall be allocated by reference to the point-ranking of projects previously made for the initial allocation pursuant to the , Second Phase Sewer Allocation System subject to such revisions as the City Council may make in carrying out the purposes and intent of said system. . 8. That any allocations made.pursuant to this First Revision to the Second Phase Sewer Allocation System shall be subject to all the terms and conditions of this Resolution and Resolution No. 9533, as amended by Resolution No. 5973. '6084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AUTHORIZING ISSUANCE OF SEWER CONNECTION PERMITS PURSUANT TO THE FIRST REWISION OF THE SECOND PHASE SEWER ALLOCATION SYSTEM. WHEREAS, Chapters 18.05 and 21.49 of the Carlsbad Municipal imposes a moratorium on the issuance of sewer permits and Iuilding permits and the processing of discretionary approvals 3ue to a lack of sewage treatment capacity; and WHEREAS, said chapters authorize the City Council to adopt in allocation system which provides for the issuance of a --imited number of sewer and building permits and the processing If some discretionary approvals as an exception to said zoratorium; and WHEREAS, the City Council, by their adoption of Resolution 10.5933, as amended by Resolution No. 5979, has adopted a Second 'hase Sewer Allocation System to allocate certain additional Lreatment capacity which has become available; and WHEREAS, the City Council has by adoption of Resolution io. 6083 approved a First Revision to the Second Phase Sewer Jlocation System to make additional Capacity' available to the ;ingle family, multiple family and new industrial land use :ategories; and WHEREAS, pursuant to said system, applications have been -eceived and evaluated, a public hearing has been held and the lity Council has satisfied itself that the objectives, purposes .nd intent of the allocation system will be met by the allocations md other actions to be approved by this resolution; NOW, THEREFORE, BE IT RESOLVED by the City Council of the I 2 3 4 5 6 7 e 9 1c 11 12 0 19 20 21 22 23 24 25 26 27 28 Zity of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City Council hereby authorizes an allocation Df sewage treatment capacity to the projects contained on the - list marked Exhibit A, attached hereto and made a part hereof, in the amount shown thereon. Said allocations are subject to compliance with all the terms and conditions of the Second Phase Sewer Allocation System except that the time limits for permits to run shall begin to run on February 20, 1980. 3. That the inclusion of a project on Exhibit A shall constitute authorization pursuant to Municipal Code Sections 18.05.030 and 21.49.030 to exempt that project from the building permit or planning moratoria imposed by Chapters 18.05 and 21.49 of the Code. Pursuant to that exemption, the City Manager is authorized to accept applications for said projects and to process them in accordance with the provisions of the Carlsbad Municipal Code as modified by the Second Phase Sewer Allocation System. 4. The EDU’S allocated by this resolution are based on representations by the applicant as to the amount of sewage capacity necessary to serve his project. The City will determine the actual amount of capacity required at the time of building permits and if such capacity exceeds the amount allocated, the building permit will not issue. The applicant proceeding pursuant to this allocation does so at his own risk. 5. If discretionary approvals are required for a project, an allocation will allow them to-be processed but there is no assurance the project will be approved. If the project is 2. lot approved, the allocation is revoked and the capacity reverts to the City. If your project requires a discretionary permit (i.e., Tentative Tract Map, Planned Unit Development, Condominium Permit, Variance, Conditional Use Permit, etc.'),appli- cation for such permit shall be filed within sixty days from February 19,1980 (on or before 4:OO P.M., April 21, 1980).Applicant is required to diligently pursue his permit to a final decision. Please note that Coastal Permits are not City discretionary permits as referred to in the Second Phase Sewer Allocation. Application for Building Permit must be filed within forty- five days from February 19, 1980 (on or before 4:OO P.M. April 4, 1980) for those projects not requiring further dis- cretionary permits; or within sixty days after final City action on the discretionary permit. The applicant is re- quired to diligently pursue his permit to a final decision. The City Council may extend the time for building permit applications an additional sixty days €or major projects. The allocation will be by random drawing for the available EDUs. This drawing will be for (A) applicants who submitted applications for a project in both the First and Second Phase Sewer Allocation Systems; and (B) applicants who 1) submitted applications in either the First or Second Phase Sewer Allocation Systems, 2) have final action on all necessary discretionary permits, 3) are ready to file application for building permit within 45 days after award of allocation, and 4) are ready to commence con- struction within 120 days after issuance of building and sewer permits . You may be in category (B). If you meet all the provisions of this category, please complete and sign the attached form and return to the City by March 11, 1980. If no letter is received by March 12, 1980, it will be determined that you do not meet the necessary requirements.
