Subject: MOBILEHOME PARKS — MORATORIUM ON CONVERSIONS Statement of the Matter The City Council, at your February 5, 1980 meeting, directed the City Attorney to prepare an interim ordinance as an urgency measure prohibiting the conversion of existing mobile- home parks to other uses. "The City Clerk has properly noticed a public hearing on the matter. If adopted by the requisite 4/5ths vote, the ordinance would take effect immediately and the prohibition on conversions would be effective for a period of one year unless earlier repealed. Exhibit Ordinance No. Recommendation If the City Council is satisfied the draft ordinance accurately recites the facts of the matter and wishes to proceed to prohibit the conversion of mobilehome parks pendincr consideration of exclusive mobilehome park zoning, your action is to adopt Ordinance No. 9^^/y (4/5ths vote is required) . WHEREAS, the City Council, at their meeting of February 5, 1980, heard expressions of concern-from the public about the potential for converting the existing mobilehome parks to other uses; and WHEREAS, existing mobilehome parks in the City of Carlsbad constitute a significant percentage of the City's stock of low and moderate income housing; and WHEREAS, the City Council has determined that the public interest requires preservation of the City's existing stock of low and moderate income housing to the extent reasonably feasible; and WHEREAS, the City Council has directed a study and consider- ation of a zone to be applied to mobilehome parks, and other measures which would regulate the conversion of existing mobile- home parks to other uses; and . WHEREAS, the City Council has set a public hearing on the question of whether or not the public interest requires the temporary prohibition of conversions of mobilehome parks to other uses until 'said zone can be considered; and WHEREAS, on February 19, 1980 a duly noticed public hearing was held at which time all interested persons were heard. At the conclusion of said hearing the City Council determined that the public interest requires the temporary prohibition of GO ~w fo 1 2 3 4 5 6 7 8 9 10 11 12 13 o-: -1 14Q o 2 ^2 v § oi£s? 15O ^ -I<o o tt •" mZ O w>£. ^ >- u H U . 16 17 18 19 20 21 22 23 24 25 26 27 28 conversions of mobilehome parks to other uses; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Carlsbad, California, as follows: SECTION 1: Notwithstanding any other provision of the Carlsbad Municipal Code to the contrary, applications for any subdivision permit or other developmental approval for property which would involve the conversion of an existing mobilehome park to. some other use, shall not be accepted, processed or approved within the City of Carlsbad. SECTION 2: The use of all land in the City of Carlsbad, which presently underlies an existing mobilehome park, for any other purpose, is hereby prohibited. SECTION 3: This Interim Ordinance is adopted as an urgency measure pursuant to California Government Code Section 65858 for the reasons set out in the recitals hereto and shall take effect immediately. The ordinance has been adopted after a properly noticed public hearing and shall be in effect for one one year unless earlier repealed. NOTICE OF PUBLIC HEARING Moratorium NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing on Tuesday, February 19, 1980, at 6:00 P.M. in the City Council Chambers, 1200 Elm Avenue, Carlsbad, California, to consider the following: Adopting an interim ordinance, as an urgency measure, prohibiting changing the usage of land underlying currently existing mobile home parks in the City of Carlsbad.
