Henthorn; Director, Housing & Redevelopment SUBJ: HOUSING AND REDEVELOPMENT ADVISORY COMMITTEE APPOINTMENTS INTRODUCTION At its meeting of November 6, 1979, Title 2 of the Carlsbad Municipal Code was amended to create the Carlsbad Housing and Redevelopment Advisory Committee (ordinance 1224). This Committee was required as the result of the formation of the Carlsbad Housing and Redevelopment Commission which resulted from the combination of functions previously carried out by the Housing Authority and Redevelopment Agency and replaces the advisory boards of those entities. The basic purpose of the new Committee is to advise the newly formed Commission on all matters to come before it. MEMBERSHIP CATEGORIES In order to avoid duplication of effort, it was decided that the Advisory Committee would fulfill the role previously filled by the Village Redevelopment Project Area Committee. This approach, in order to satisfy the requirements of State law necessitated establishment of the following six categories. a. TWO members of existing orgainzations within the redevelopment project area. b. One residential owner/occupant from within the redevelopment project area. c. Two business persons from within a redevelopment project area. d. Two persons trained or experienced in architecture or urban design, real estate, human relations, housing, urban development, building construction, social services, or other relevant businesses or professions. e. One tenant of the housing authority. f. One tenant of the housing authority 62 years of age or older. -. . APPLICATIONS Upon expiration of the initial application period, only 8 applications had been received. The period was then extended administratively to January 28, 1980. During the application period, notices were posted at Commission offices and City Hall. In addition, media coverage was provided by the local newspapers as well as the Chamber of Commerce. Finally, informal personal notification was made to several individuals who had expressed interest in serving on a redevelopment related committee. Attachment I contains all thirteen (13) applications received and is provided to ensure that Council has the benefit of all information provided by the applicants. Attachment I1 lists the twelve (12) applications filed by the January 28 deadline and includes one filed on January 31. The late application is provided due to the limited number of applications received. These applications are also categorized. As of February 8, 1980 an application had not been filed for the 62 years of age or older tenant slot. Staff will continue to contact tenants in an effort to permit appointment of a full committee. As you will note, all applicants fulfill more than one category. However, there is a relative scarcity of applicants in the following three areas: a. Housing tenants - 1 b. Housing tenants over 62 - 0 c. Residential Owner Occupant - 2 d. Businesses within Redevelopment Area - 6 It is recommended that these categories be appointed early so as to ensure that those eligible are not inadvertently appointed to categories with larger fields. TERMS As you will note from the resolution included with the Agenda Bill, three terms of appointments have been established. This permits the staggering of re-appointment consideration. The terms of initial appointment range from 18 months to two years and are assignable at the discretion of the Council. At its meeting of February 19, 1980, Council was provided an agenda packet to enable them to make appointments to the Carlsbad Housing and Redevelopment Advisory Committee. The Council's action at that time was to continue the item to the meeting of March 4, 1980. At the time the agenda material was distributed to Council the only appointment category having no eligible applicants was "housing authority tenant over 62 years of age?. The item was presented recognizing that this appointment could be made at a later date. Subsequent to the distribution of the agenda packet the attached application was received. The applicant meets the age and tenancy requirement of the category noted above. NOTICE OF PUBLIC HEARING ON ADOPTION OF CONFLICT OF INTEREST CODE FOR THE CARLSBAD HOUSING AND REDEVELOPMENT ADVISORY COMMITTEE NOTICE IS HEREBY given that the Carlsbad Housing and Redevelopment Advisory Committee will hold a public hearing on April 28, 1980 at 7:OO P.M. in the Council Conference Rom of the City of Carlsbad, 1200 Elm Avenue, Carlsbad, California, pursuant to the Political Reform Act of 1974 (Title 9, commencing with Section 81000, of the Government Code) to consider adoption of a Conflict of Interest Code for an agency of the City of Carlsbad as specifically required by Section 87300, et seq of the Government Code. The proposed Conflict of Interest Code will require each member of the Carlsbad Housing and Redevelopment Advisory Committee to disclose investments, interests in real property, and income as required under Section 87200 of the Government Code, and also will require each such person to disqualify him- self or herself from making or participating in the making of any decision which will foreseeably have a material financial effect, distinguishable from its effect on the public generally, on any financial interest, as defined in Government Code Section 87103. Under the Proposed Code, no such person would be pre- vented, however, from making or participating in the making of any decision to the extent his participation is legally required for the decision to be made. Section 87311 of the Government Code requires that the review and preparation of Conflict of Interest Codes by local government agencies shall be carried out under procedures which guarantee to residents of the jurisdiction adequate notice and a fair opportunity to present their views. Accordingly, any interested party may appear at the date and time stated above and be heard concerning the Conflict of Interest Code. A copy of the proposed code and rules of procedure for the conduct of the public hearing are available for inspection at the office of the City Clerk, City of Carlsbad, 1200 Elm Avenue, Carlsbad, CA.
