Statement of the Matter
The sewer committee met on February 14, 1980 and reviewed applications for allocation of discretionary permits. The attached report reflects the recommendations of the committee.

Approval of allocations as recommended by the committee
Council Action:
2-19-80 Council accepted the recommendations 1, 2, 3, 4, and 5 of the subcommittee as contained in their report dated February 15, 1930, and directed the attorney prepare the necessary documents to revise the allocation system and make the requested allocations.
Council directed that half of all reclaimed sewer go into a discretionary category for Council allocation.
Council directed that the other half of all reclaimed sewer go into a category for random drawing to include those projects which were passed over in Phase I and Phase I1 allocations, and those who have all discretionary approvals and have applied one time.

The reason for favoring Pea Soup Andersen are:
-- Annual sales tax revenues of $85,000 -- Annual room tax revenues of $57,000 -- Employment of 350 people
The reason for favoring Sunset Pacific is:
-- Completion of the missing link in Tamarack Road between Skyline Road and El Camino Real which will alleviate traffic congestion and provide additional east-west access between El Camino and downtown.
This allocation should be conditioned on the bonding of an agreement
by developer to construct Tamarack Road.

': Sewer Permit Allocations
In addition, the Sewer Committee recommends that the Council make a commitment to Sunset Pacific to allocate an additional 86 sewer permits when and if the Lake Calavera Hills satellite sewer plant becomes available. Assurances conditioned upon: 1) Completion of Tamarack to satisfaction of City Council; 2) The developer will acquire no rights
to complete the project. The project will be subject to all applicable
laws and ordinances at the time of final map or building permits; 3) That the action will not establish a precedent for later Council decisions relating to the Calavera plant; 4) That Council will have some discretion to determine when sewer is available from the Calavera plant.
These two allocations total 228 EDU's. It is proposed that 212 EDU's
be allocated from the Discretionary Reserve and 16 from the Contingency
Reserve. Because of the forfeiture of permits allocated in Phase I1
it is anticipated that as many as 175 EDU's may become available in April which would allow the Contingency Category to be repaid.
RECOMMENDATIONS
1. Allocate 180 sewer permits to Pea Soup Andersen, subject to filing application for zoning/planning approvals within 90 days.
2. Allocate 48 sewer permits to Sunset Pacific Tract 76-15, subject to filing final subdivision map within 90 days and taking out building permits within 45 days after approval of final map.
3. Provide a commitment to Sunset Pacific to allocate an additional
86 sewer permits when and if the Lake Calavera Hills satellite sewer plant capacity becomes available, subject to appropriate discretionary actions of the City Council at the time.
4. Instruct City Engineer to notify those Phase I1 allottees who fail
to meet deadlines and recommend appropriate action to the Council.
5. Direct the Council Sewer Committee to review appeals, if any, from
those allottees who fail to meet deadlines and recommend appro- priate action to the Council.
6. Create two allocation procedures for additional sewer permits which become available in the immediate future:
a) Random Drawing. To allocate half of forfeited permits to those applicants who were passed over in both Phase I and Phase I1 allocations (9 applicants, 114 EDU's)
b) Discretionary. To allocate other available permits to new
applicants.

SEWER PERMIT ALLOCATION GUIDELINES - DISCRETIONARY CATEGORY
1t:shall be the policy of the City Council to allocate limited sewer
system capacity to those projects which produce maximum benefit to the City as a whole. When allocating permits from discretionary reserves "maximum benefit" will be construed to mean one or more of the following benefits:

Increases sales tax revenues.
Increases transient occupancy taxes.
Improves the employment base significantly with emphasis on those skills available or that can be made available in the Carlsbad area.
Makes a significant contribution to the attainment of downtown redevelopment objectives.
Provides low and moderate income housing in the infill areas. This
benefit attains even greater significance when that housing is
located in the old downtown business district or meets the unique
requirements of senior citizens. modular units, are included in this category of housing. Manufactured housing, mobile-or
Adds to the rental housing stock in the infill area (apartments)
when agreements can be reached to preclude condominium conversion.
Rental unit construction is particularly desirable in the redevelop-
ment area.
Improves traffic circulation by the completion of important segments
of major streets in the infill area or completes other major capital
improvement projects in the infill area.
Hardship circumstances will not be considered. Applications for projects which would require significant expenditure for public service and for facilities are not desired.
Council retains for itself the widest latitude in determining how benefits
are calculated and projects are prioritized.
RANDOM DRAWING CATEGORY
It shall be the policy of the Council to give preferential treatment to
those projects which did not receive sewer permits during both the Phase I and Phase I1 allocations. Drawings shall be made for award of sewer permits as additional allocations become available. The Random Drawing Category shall be replenished from time to time by assigning half of the permits forfeited by applicants who do not meet the time
deadlines imposed by the Phase I1 allocations. The remaining half of
the forfeited permits shall be placed in the Discretionary Category.
The Council reserves the right to establish additional or modified
policies for allocating sewer capacity which may become available because of Encina nlant exDansion or annroval of satellite nlants.

PROPOSED DEVELOPMENT
Pea Soup Andersen's Restaurant and Inn proposes to develop
a major commercial tourist complex on 12.3 acres at the
northeast quadrant of Interstate 5 and Palomar Airport Road
in the City of Carlsbad. The property is currently owned by
Mr. Paul Ecke and street improvements have been completed by
Mr, Ecke from the south side of Car Country to Palomar
Airport Road. The project will consist of a 600 seat Pea
Soup Andersen's Restaurant including banquet rooms, a bakery
shop, a wine tasting cellar, a country store, a 125 seat
Danish Inn Gourmet Restaurant, a 100 room motel complex and
Service Center including a gasoline station and convenience
store.
Andersen's was founded in Solvang in 1924 and has become a
well-established enterprise with a national reputation for
excellent food and friendly service. Three facilties are
currently owned and operated by Andersen's including the
most well-known location in Buellton, California, one in
Mammoth Lakes and the newest facility in Santa Nella, California,
Pea Soup Andersen's takes great pride in not only serving
the traveling public but also the communities in which their
facilities are located, It is the desire of Andersen's to
develop a similar relationship with the City of Carlsbad.

MAJOR ADVANTAGES OF THE PROPOSED
PEa SOUP ANDERSEN'S COMPLEX TO THE CITY OF CARLSBAD
Tourist business: Andersen's has established a reputation for bringing to a community the type of business so widely
sought after today, and additionally generates a high percentage of return business.
Restaurant sales: projected to be $4.5 million the first
year of operation; of which $4 million would he subject
to sales tax or approximately $40,000 would accrue to the
City of Carlsbad.
Motel sales: forecast to be $958,000 the first year of
operation based upon an occupancy rate of 75% at a room
average of $35.00 per night. Bed tax (6% in City) would
generate $57,480 of revenue to the City of Carlsbad.
Gasoline sales: Service Center sales are projected to be
3.75 million the first year and the convenience store is projected to be $800,000 the first year. Total sales tax accruing to the City would be $45,500.
Real Estate taxes: estimated cost of construction is pro-
jected to be $4 million with land valued at $2 million for
a total project value of $6 million. Appropriate real estate taxes will be assessed.
Employment: Pea Soup Andersen's Carlsbad would provide new jobs for approximately 350 people with a total annual payroll exceeding $2.5 million. As a matter of policy, Andersen's
hires local people for their operation.
Civic affairs: Andersen's takes pride in serving the com- munities where their restaurants are located. Participation
in many of the local civic projects has been a long standing
policy. donated annually. Sponsorships include the Children's Home Society, Santa Ynez Valley Historical Society, Buellton Business Associations, Santa Ynez Hospital Fund, Santa Nella Hospital Fund, United Way, and many others. Over $100,000 has been generated by banquets with the total proceeds going to various local organizations.
Benefits for numerous community organizations are

8. Banquet facilities: Andersen's complex will provide
banquet facilities for over 300 persons. In addition, the restaurant design provides excellent flexibility
to accommodate more than one group at a time.
9. Indirect benefits: in excess of $10 million of sales would be generated from Andersen's operations each year. These are dollars which would otherwise have been spent in other communities since Andersen's is not generally in competition with existing business. Andersen's policy is to establish banking relationships as well as buying
relationships in the local community. Therefore, many of
the above mentioned sales dollars would flow into the local economy.

We have just been informed that the Council, in its meet-
ing of February Tth, will consider giving its approval
for proceeding with the development of the area to the
west of our complex; to be known as Palisades Point.
We are much in favor of this permission being granted,
This area has been an eyesore ever since work was stopped.
In addition, each rainfall creates a hazardous condition,
resulting from the flow of silt, You may be aware of the
substantial cost to the City for removing earth from the
sewers and blocked drainage lines, as well as major and
minor repairs to the street surfaces.
We do not have sufficient time to poll our Homeowners in
regard to Mr, Michael Roston, the developer. However the
Board does vdh to express our satisfaction with his
performance in regard to the flcommon areas". In particular,
Mr. Roston has continued to assume responsibility for the
El Camino Real slopes, an area that has experienced many
costly landslides.

In regard to the proposed Third Sewer Allocation under the
Second Phase Sewer Allocation Program, the owners of the Cape
Bristol Condominium project respectfully request that the
proposed 16-unit condominium project be given priority in your consideration of projects which will be allocated sewer
hook-ups out of t'ne City's remaining 200 EDUS. Priority is
being requested based on the long history of governmental permit
processing accomplished on the project and the worth of the
project to the City of Carlsbad and the consumer.
As evidenced in the attached July 23, 1979 Memo to the City
Council in regard to the First Allocation under the Second
Phase Sewer Allocation Program, the governmental permit
processing requirements for the development of the Cape Bristol
Condominium project have been in process since Fay 1972; Final
Nap iio. 72-16 was recorded in August 1973. The project has
also received two extensions of the second Coastal Permit issued
for the project in December 1977( see attached Exhibit# 1).
Additionally, the project has qualified under both the Plarch 1978 Second Icevision to the First Phase Sewer Allocation System
and the December 1979 Second Phase Sewer Allocation System( see
Exhibits# 2 and 3).
Considerable time and money has been expended, to date, by both
the owners of Cape Bristol and the City of Carlsbad for
the development of the project. Because a minimum of governmental
processing requiremerits remain, the City's costs to provide 16
additional units of varied housing ownership opportunities in the
infill area of the City will be minimal compared to newly proposed
condominium projects. Also, the sooner the owners are able to
build the proposed units, the moreaffordable the housing units
will be for the consumer due to the minimization of the holding
costs and of the ever increasing construction costs.

by Mr. Penn Thayer, respectfully request that the City Council does not adopt a lottery-type sewer allocation program, but
rather consider adopting a priority system of allocation which
would give precedence to projects such as Cape Bristol Condo-
miniums which qualified for the last sewer allocation program
in March 1978.
Sewer Allocation Program, qualified requests were submitted
for 119 Equivalent Dwelling Units (EDUs) from the Multi Family
Residential category; only 11 EDUs were available for allocation
from the Multi Family Residential category. Cape Bristol Condo-
miniums , which requires 16 EDUs, did not have an opportunity to secure any sewer permits under the 1978 sewer allocation
program.
Under the Second Revision of the First Phase
The Cape Bristol Condominium project has been in the develop-
ment process since 1972 and has secured all of the required
discretionary governmental approvals with the exception of
City building and sewer permits,

WHEREAS, the Planning Commission of the City of Carlsbad
on the 27th day of June, 1972, recommended to the City Council that
the tentative map of Carlsbad Tract 72-16, Cape Brfstol, be approved
and;
WHEREAS, the City Council of the City of Carlsbad on the
5th day of July, 1932 considered the recommendation of the Planning
Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad that the City Council does hereby approve said
tentative map for Carlsbad Tract 72-14, comprising one (1) lot, sub-

We have been allocated Sewer Permit #M-36 and you informed us we must have an application for 8 Building Permit in, on or before February 1F(, 1980.
We have run into difficulty with building plans, as it is almost impossible to build three units and five carports, as planned, and have decent sized units. We are now going to build two units on the lot and this will require new plans, This is valuable property and we do want to give this careTul consideration.
We a going to build. However, your deadline is putting us under a lot of pressure. We are meeting with our builder on February 8 and hope to get the problems resolved then,
It is extremely difficult for a person not in the construction field, to start from scratch and get building plans, construction loan, etc. in the time you have designated, Zombined with this is the added disadvantage of being a distance from Carlsbad and every- thing has to be done "long distance".

Dear Mayor and Members of the City Council:
I respectfully request an allotment of three EDUs of sewer capacity from discretionary capacity to permit the development of a bank building on Lot #1 in Palomar Airport Business Park. The property is located on the southeast corner of Palomar Airport Road and Yarrow Drive.
For a minimum number of EDUs, this development will provide employ- ment for between 20 and 30 people. The facility will serve the immediately adjacent industrial community, and will provide amen- ities which will encourage continued and expanding industrial usage in the area.
A major domestic bank has confirmed its desire and intention to
occupy the site in a class A structure which will contribute sig-
nificantly to the high calibre development of the area.
The contemplated usage is in the general office category which is permitted under a conditional use permit in the Planned Industrial Zone in which the property is located. There will be no production of air, water, or noise pollution. The requested sewer capacity will be used exclusively for the sanitary needs of bank employees.
The intended occupants were prepared to proceed on the basis of the Council's earlier action adopting Alternative #2 contained in the

City Engineer's report of December 31, 1979 on new Industrial
Sewer Allocation. They are still prepared to proceed immediately
upon our receipt of an allocation of the three EDUs necessary for
the project (calculated in accordance with the formula provided
by the City Engineer).
The timing element for the bank has become extremely critical, and the selection of our Carlsbad site has resolved into a ques-
tion of now or never. We obviously would like to avoid the sub- stantial economic loss that we will suffer by being unable to accommodate this excellent tenant.
We believe this project provides a type of development sought by
the City of Carlsbad, and I trust we will receive an early favor-
able response to our request.
