SUBdCCT: COMPLETION OF ELM AND APPIAN WAY
STATEMENT OF THE MATTER
Prior to May 6,- 1930, Elm Avenue will be extended from Avenida de'Anita, easterly to a point 200 feet east of Appian Road. The present alignment of Appian Road at Elm Avenue is not consistent with the proposed ultimate location. Carlsbad Development Corporation has indicated an interest in
vacate the present alignment. The City also has on file an agreement with the property owner on the west side of the proposed Appian Road alignment which requires installation of improvements on notice by the City. These conditions wil.1 allow the City to complete the proposed intersection of Elm Avenue and Appian Road. .

That the City Council authorize staff to:
(1) Notify Carlsbad Development Corporation that the street vacation process for abandonment of the present alignment of Appian Road will be initiated in accordance with the California Streets and Highways Code coincident with construction of the new street a1 ignment.
(2) Notify John and Duane Frazee that they should make arrangements to install street improvements along their 4ppian Road Frontage.
