The request is for an eight unit condominium on 0.59 acres of land. The Planning Commission amended the staff recommendation by modifying Condition 9 by requiring the applicant to build a five foot fence rather than the forty-two inch decorative wall and deleting the term “block“ from the decorative wall. This will allow t.he applicant.to build a stuccoed wall more in keeping with the design of the buildings. The Planning Cormnission has added a Condition No. 6 requiring the applicant to submit plans for a trash enclosure. These modifications are to the satisfaction of the planning staff. Through the staff review and Planning Commission hearing all issues on this matter have been satisfactorily resolved. ATTACHMENTS 1. Planning Commission Resolution No. 1620 2. The site is physically suitable for the type, density and design of the development since the property is adequate in size and topography to accommodate the project and still meet all of the city's condominium and subdivision regulations without any significant environmental impacts. The project is consistent with all city public facility policies and ordinances since: The applicant is on the Leucadia County Water District's sewer allocation list, and eisht sewer hookups have been reserved for the project. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. School rees to mitigate conditions of overcroivding are required at the time of building permits pursuant to Chapter 21.55 of the Carlsbad Municipal Code. All necessary public improvements have either been provided or will be required as conditions of approval. The Planning Commission has, by inclusion of an appropriate condition to this condominium permit and tentative subdivision map, insured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Con-mission has added a condition that a note be placed on the final map that building permits may not be issued for the condominium project unless the City Engineer determines that sewer service is available. Since the final nap cannot be approved unless sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the General Plan have been met insofar as they apply to sewer service for this condominium permit and tentative map approval. //// //// -2- RES0 #1620 I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The design of the project grid all required improvements will not cause any significant environmental impacts, and a Declaration of Negative Environmental Impact has been issued by the Planning Director on March 4, 1980, Log No, 653. The proposed condominium project meets the criteria of Chapter 21.47 (Condominiums) since: a) The condominiums meet the design criteria of Chapter 21.47.110 since the overall plan is comprehensive, embracing land, building, landscaping and their relationships, the driveways are not dominant features, and sufficient circulation and on-site amenities are provided. b) Storage space, laundry facilities, open recreation areas, parking facilities, refuse areas, separate utilities and requirements of Section 21.47.130 have been met or will be conditions of approval. The design of the subdivision and type of improvements will not cause any serious public health problems. The design of the subdivision and type of improvements will not conflict with easements for public use of public access through the subject property. Zonditions Approval is granted for CT 80-4/CP-52 as shown on Exhibit(s) B, C, & D dated February 8, 1980, and Exhibit F & G dated April 1, 1980, incorporated by reference and on file in the Planning Department, Development shall occur sub- stantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that building permits will not be issued for developments of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that RES0 #1620 -'3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 agreement dated 4/1/80, is on file with the City Clerk and is incorporated herein by reference. Iff said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. The applicant shall prepare a reproducible mylar of the final condominium site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Department prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irrigation plan which shall indicate water conservation methods and include low maintenance plant materials which shall be submitted to and approved by the Planning Department prior to final map approval. The detailed landscape and irrigation plan shall include dense landscaping around the perimeter of the open recreational area to provide screening from both the driveway and Alga Road. Trees in this area shall be a minimum of 15 gallons in size. The applicant shall pay park-in-lieu fees to the city, prior to the approval of the final map as per Chapter 20.44 of the city’s subdivision regulations. The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application. The application shall build a 5’ fence around the swimming pool which shall consist of a 42” decorative wall base to match building and a wrought iron fence. Further, the applicant shall build a 5’ wrought iron fence around the spa. Plans for said fences shall be submitted to and approved by the Planning Director prior to the issuance of building permits. Further, said fence shall meet all the requirements of the Uniform Building Code. The developer shall receive the approval of the City Engineer for a site grading plan and obtain a grading permit prior to issuance of building permits. Applicant shall construct a sidewalk and a 4’+ retaining wall along the property line to eliminate the slope within the right-of-way along Alga Road. The applicant shall submit plans indicating the location of a 6’ high trash enclosure to the Planning Director for his approval prior to approval of the final map. SUBJECT: CT 80-4/CP-52 - EGIFJTOX - Reauest for an 8 unit condominium. permit and tentative airspace subdivision located on the southwest corner of Mga Road and Santa Isabel Street in I,a Costa. I. '. 11. PROJECT DESCRIPTION The applicant is requesting ar, 8 unit condominium permit and tentative airspace subdivision at the above described location. The site has been previously graded and the building pad is elevated approxiKately 10' above Alga Road. One driveway off of Santa Isabel Street will provide access to the units as shown on Exhibit "A". Each unit is two stories in height and! has a two car garage. The units range in area from 1064 to 1947 square feet. ANALY S I S Planning Issues 1. Does the project provide suffi.cient amenities to justify the proposed density of 15 d.u's/acre? 2. Does this project meet all design criteria? Discussion The major issue associated with this project is whether sufficient amenities have been provided to justj-fy the proposed density of 15 du/s/acre. The General Plan designates this site as medium-high density residential which allows 10 dwelling units per acre, and up to 20 Cwelling units per acre if certain criteria are met. The criteria include such things as slope of land, soil stability, corqmtibility with surrounding lar,d uses and on site amenities. The applicant has provided on site amenities over and above the requirements of the Condominium Ordinance. Specifically, he has prcvided a 1500 square foot common recreational area which includes a 336 square foot swinming pool and spa. Also, private patios have been provided for every unit. Staff feels that thc amount and type of on site amenities provided justify the proposed density of 15 du's/ncre. In terms of design criteria, staff’s major concern is the buffering of the recreational area from Alga Road and the driveway. Since the level of the recreational area is 10’ above Alga Road, the visual inpact of a major street will be minirriized. Staff is recopmending a condition, however, requiring a 42 inch decorative wall along the entire perimeter of the recreational area to serve both as a visual screen and noise buffer. Further, staff is recommending a condition requiring a detailed landscape and irrigation plan indicating planting materials to visually screen the recreational area from both the driveway and Alga Road. Vith these modifications, staff is satisfied that the recreational area is sufficiently buffered from any traffic impacts and that the project meets all design criteria. Recommendation It is recommended that the Planning Commission adopt Resolution No. 1620 reconmending APPROVAL - of CT 80-4/CP-42 to the City Council based on the findings and conditions contained therein.
