A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A TENTATIVE TRACT MAP AND CONDOMIN-
IUM PERMIT FOR 14 UNITS LOCATED ON THE NORTH
SIDE OF GIBRALTAR STREET, LA COSTA.

WHEREAS, a verified application for certain property, to
dit:
Lots 376 and 377, La Costa South, Unit No. 5, in the City of Carlsbad, State of California, being Assessor's
Parcel No. 216-290-20 & 21.
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 9th day of
April, 1980, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to the
Tentative Tract Map and Condominium Permit; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Com-
mission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of CT 80-3/CP-51 based on
the following findings and subject to the following

The project is consistent with the city's General Plan Land
Use Element since the scale and intensity of the development conforms to the land use designation for this site.
The site is physically suitable for the type, density and
design of the development since the property is adequate in size and topography to accommodate the project and still
meet all of the city's condominium and subdivision regula-
tions without any significant environmental impacts.
The project is consistent with all city public facility policies and ordinances since:
The applicant is on the Leucadia County Water District's
sewer allocation list, and 15 sewer hookups have been
reserved for the project.
The applicant has agreed and is required by the inclu- sion of an appropriate condition to pay a public facil-
ities fee. Performance of that contract and payment of
the fee will enable this body to find that public facil- ities will be available concurrent with need as required
by the General Plan.
School fees to mitigate conditions of overcrowding are
required at the time of building permits pursuant to
Chapter 21.55 of the Carlsbad Municipal Code.
All necessary public improvements have either been pro-
vided or will be required as conditions of appraval.
The Planning Commission has, by inclusion of an appro- priate condition to this condominium permit and tenta-
tive subdivision map, insured that the final map will
not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condi-
tion that a note be placed on the final map that build- ing permits may not be issued for the condominium pro- ject c-riless the City Engineer determines that sewer service is available. Since the final map cannot be approved unless sewer service is available, and build- ing cannot occur within the project unless sewer ser- vice remains available, the Planning Commission is satisfied that the requirements of the public facili-
ties element of the General Plan have been met insofar
as they apply to sewer service for this condominium permit and tentative map approval.

5) The proposed condominium project meets the criteria of Chapter 21.47 (Condominiums) since:
a. The condominiums meet the design criteria of Chapter
21.47.110 since the overall plan is comprehensive,
embracing land, building, landscaping and their rela-
tionships, the driveways are not dominant features,
and sufficient circulation and on-site amenities are
provided.
b. Storage space, laundry facilities, open recreation
areas, parking facilities, refuse areas, separate utilities and requirements of Section 21.47,130 have been met or will be conditions of approval.
6) The design of the subdivision and type of improvements will
not conflict with easements for public use of public access
through the subject property.
Conditions
Approval is granted for Ct 80-3/CP-51 as shown on Exhibits
A & B to CT 80-3/CP-51, dated March 31, 1980, on file in the Planning Department and incorporated by reference. Development shall occur substantially as shown on these
Exhibits unless otherwise noted in these conditions.
The applicant shall establish covenants, conditions and restrictions for the project and subject to the approval of the Planning Director prior to the issuance of building permits. Said CC&R's shall restrict improvements within
the front yard setback for units 8-14 as follows: No fences
greater than 42 inches may be permitted around any deck area; only wood decks up to 6 inches in height above the ground shall be permitted for these units and they may not encroach more than 3 feet into the front yard setback.
In addition, said CC&R's shall prohibit the placement of any
structure within the easements located along the eastern
and western property lines, unless approval for such struc-
ture is granted by the holder of the easement.
Prior to the issuance of building permits, the applicant
shall prepare a reproducible copy (Mylar) of the final condo-
minium site plan incorporating all requirements of the condo-
minium permit approval and shall be subject to the approval
of the Planning Director.
The applicant shall provide school fees to mitigate condi-
tions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application.

This subdivision and condominium plan is approved upon the express condition that the final map shall not be approved
unless the City Council finds-as of the time of such approval
that sewer service is available to serve the subdivision.
This subdivision condominium plan is approved upon the express condition that building permits will not be issued for devel- opment of the subject property unless the City Engineer
determines that such sewer facilities are available at the
time of application for such permits and will continue to be
available until time of occupancy. If the City Engineer
determines that sewer facilities are not available, building
permits will not be issued.
This approval is expressly conditioned on the payment by the
applicant of a public facilities fee as required by City
Council Policy No. 17, dated August 29, 1979, on file with
the City Clerk and incorporated herein by reference, and according to the agreement executed by the application for payment of said fee. A copy of that agreement, dated 3/18/80,
is on file with the City Clerk and incorporated herein by
reference. If said fee is not paid as promised, this appli-
cation will not be consistent with the General Plan and the project cannot proceed and this approval shall be void.
The developer shall receive the approval of the City Engineer
far a site grading plan and obtain a grading permit prior to
issuance of building permits.
Automatic garage door openers shall he installed by the
applicant on all garage doors prior to final occupancy of any unit.
The applicant shall submit a detailed landscape and irriga-
tion plan subject to the approval of the Planning Director prior to final map approval. Said plan shall indicate the utilization of drought tolerant plant species, with an emphasis on screening units 8-14 located along Gibraltar
Street. Said landscape plan shall also delineate pedes-
trian pathways on both sides of the entry driveway connect- ing the on-street parking with the units.
The applicant shall pay park-in-lieu fees to the city prior to the approval of the final map.

PROJECT DESCRIPTION
The applicant is proposing a 14 unit condominium develop-
ment on two parcels totaling 30,785 sq.ft. The property is located on-the north side of Gibraltar Street, adjacent
to the south of the La Costa Golf Course. The buildable area of the property is limited by two easements which run
along the eastern and western property lines, in addition to the narrowness (north-south) of the lots.
The dwellings will be arranged in four clusters, with each cluster containing three to four units. The units will be two stories b.ith a third level loft, (maximum height of 30
feet). each with two bedrooms and an attached two-car garage.
The living area for each unit will range from 1,461, to 1,608
sq.ft.
ANALYSIS
Plannina Issues
1) Have adequate on-site amenities, including private areas, open recreation and landscaping, been provided?
2) What can be done to maximize privacy for the units
proposed along Gibraltar Street?
Discussion
Originally the applicant submitted plans for 15 units.
The additional unit was proposed at the center of the site, connecting both buildings along the northern half of the property. On staff's recommendation, the Appli-
cant dropped a unit in order to break up the long row
of attached units and also provide an additional land- scaped pathway to the picnic area. This change not only improved the aesthetic appearance of the development, but it also ensured a more convenient and efficient pedestrian circulation system.
Planning issues raised by the project relate primarily
, to the adequacy of the proposed on-site amenities. Such
amenities include open recreation area, landscaping, and private areas.
With regard to open recreation area, the city's condomin-
ium regulations require 200 sq.ft per unit. The Applicant
has met this requirement through the use of both private patios and balconies located at each unit. Since the
front yard setback cannot count towards the recreation
area requirement, the Applicant redesigned the balconies
to meet the 200 sq.ft. requirement.
In addition to the patios and balconies, the applicant has entered into a revocable agreement with the La Costa Land
Co. which allows the applicant to improve and utilize a portion of land adjacent to the subject property and dir-
ectly above the golf course (see attached letter dated March 19, 1980). This parcel of land would be planted and utilized as a picnic area. The residents of the pro- ject would have access to this area via on-site pedestrian pathways.
The preliminary landscape plan indicates that all common
areas will be well landscaped (see Exhibit "B"). The addi-
tional landscaping provided at each cntryway increases the privacy and individuality of each dwelling, in addition to breaking up the paving and thus reducing the dominance of the driveway.
Since the buildable area of the property is limited by
both the narrowness of the lots and two existing easements,
the units along Gibraltar Street observe a setback of only 12 ft. from the property line. In order to ensure adequate privacy for these units, and still provide the necessary landscaping required by the RDM zone, a condition has been
included requiring additional landscaping in this area.
Also, decks and fences for these units are restricted by
condition in order to ensure that the maximum amount of
landscaping available along Gibraltar Street.
All of the required visitor parking will be provided on- street, directly in front of the subject property. In order to ensure safe pedestrian access from these spaces to the units, a condition requires the applicant to pro- vide pedestrian pathways along the entry driveway. This
will minimize potential pedestrian/vehicular conflicts.

Considering the constraints of the property, the project, as conditioned, is well designed and meets the design
criteria and development standards of the condominium ordinance. It should be noted. that the property is desig-
nated for high density developm.ent (20-30 du/ac.) . However, the applicant was able to only meet the loh7er limit.of this range (20 du/ac) in order to provide the amenities required
by the condominium regulations.
111. Recommendation
Staff recommends that the Planning Commission ADOPT Zeso- 1uti.on No. 1619, recommending APPROVAL -- of CT €!0-3/CP-51, based on the findings and subject to the conditions con-
tained therein.
