A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPOINTING A MEMBER TO THE CITY OF CARLSBAD PERSONNEL BOARD.
WHEREAS, the term of DONALD WATKINS as a member of the
City of Carlsabd Personnel Board will expire in June, 1980;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitation is true and correct. .
2. That the following person is hereby appointed to serve
as a member of the Personnel Board in the position vacated:
for a term to
expire in June, 1984.

The Personnel Board in session 6:OO p.m. August 18, 1980,
heard the two part grievance of Firefighter FJILLImi
NIXON. Following is the finding of the board.
1. The Personnel Board of the City of Carlsbad finds that according to Rule x, Section 14, (b)
(3), of the Personnel Rules of the City of Carlsbad
and Section 4850 of the Labor Code of the State of California, the grievant is entitled to full holiday pay during the time he was off on temporary disability pursuant to Section 4850 of the Labor Code.
2. The Personnel Board finds that because the Fire
Chief was informed before the recertification was begun that overtime would be clairhed, the employee, in fairness, should receive overtime compensation for his emergency medical training
recertification during the time he was off for
'temporary disability pursuant to Section 4850 of the Labor Code of the State of California.

The Personnel Board in session 6:30 p.m., Dmer-L8., 1980 heard the similar grievances of Police Sergeant MICHAEL SHIPLEY and Senior Police Officer MARY STAPLETON. Following is the finding of the board.
"The Personnel Board has unanimously found that the current rules have been interpreted and applied correctly. The board further finds that the facts in this case show that Section 4; Rule IV, regarding anniversary dates, can result in unfair and unjust treatment of promoted employees.
Based on those findings the board recommends that the grievance requests, as presented in the December 15, 1980
communication of the Appellant Exhibit A, be resolved as follows .
Request No. I: Revision of the City of Carlsbad Personnel
Rules and Regulations to allow for a "fair and equitable" treatment of all employees with respect to pay increases realized by promotions be approved.
Request No. 11: That the attested officers' promotion and
anniversary dates be aligned with the provisions of that revision is denied because it should be included in meet and confer negotiations.
Request No. 111: That the effected officers be compensated retroactively for pay lost, in accordance with the amended
Personnel Rules and Regulations be denied.
The board further recommends that the appropriate procedure, to include meeting and conferring, be initiated by the city
by January 21, 1981, and completed by April 31, 1981, to implement the granted Request No. I."

PERSONNEL BOARD FINDINGS--January 18, 1980
The Personnel Board has unanimously found that the current rules have been interpreted and applied correctly. The board further finds that the facts in this case show that Section 4, Rule IV, regarding anniversary dates, can result in unfair and unjust treatment of promoted employees.
Based on those findings the board recommends that the grievance requests as presented in the December 15, 1980 communication of
the Appellants and marked as Appellant Exhibit A be resolved as follows.
Request No. I: Revision of the City of Carlsbad Personnel Rules and Regulations to allow for a "fair and equitable" treatment of all employees with respect to pay increases realized by promotions. This request has the approval of the board and is so recommended.
Request No. 11: That the attested officers' promotion and anniversary
dates be aligned with the provisions of that revision is denied because it should be included in negotiations.
Request No. 111: That the effected officers be compensated retroactively for pay lost, in accordance with the amended Personnel Rules and Regulations be denied.
The board further recommends that the appropriate procedure, to include meeting and conferring, be initiated by the city
by January 31, 1981, and comsleted by April 31, 1981, to
