Statement of the Matter
The City Council, at your May 20, 1980 meeting, directed
the City Attorney to prepare an ordinance approving the
subject zone change. That action was taken in reliance
on a representation by the applicant that he would volun-
tarily record a restriction on the R-l-7,500 lot, limiting
the building to a one story structure. That action was also
dependent upon the applicant securing a parcel split of the
property as set out in Planning Commission Resolution No.1621,
The ordinance granting the zone change has been prepared and
is attached. If the Council concurs your action is to
introduce the ordinance. Consistent with Council's previous
expression of intent, your action to introduce the ordinance
will instruct the City Manager to not return the ordinance
to the Council agenda for adoption until the parcel map and
building restriction are of record.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE
BY AMENDING THE ZONING MAP TO GRANT A
CHANGE OF ZONE (ZC-209) FROM R-l-15,000
TO R-l-7,500 ON PROPERTY GENERALLY
LOCATED ON THE WEST SIDE OF SUNNYHILL
DRIVE, SOUTH OF MONROE STREET.
APPLICANT: SMITH.
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of the zoning map to grant a change
of zone (ZC-209) from R-l-15,000 to R-l-7,500 on property as
shown on map marked ZC-209, Exhibit "A", attached hereto and
made a part hereof. *"
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a meeting of the Carlsbad
City Council held on the 3rd day of June 1980, and thereafter
PASSED AND ADOPTED at a meeting of said City Council held on
the _}8th day of November/ 1980, by the following vote, to wit:
AYES: Council Members Packard, Casler, Anear, Lewis and Kulchin
