At the City Council's direction, staff prepared an ordinance amendment that would lift the planning moratorium €or General
Plan Amendments and to allow acceptance of minor annexations if necessary to accommodate a revision to an approved master
plan or specific plan. The ordinance was heard by the Planning
Commission on April 23, 1980, and has been forwarded to the
City Council tor your adoption.

A RESOLUTION OF TEE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA , RECOMIIENDING
TITLE 21, CHAPTER 21.49, SECTION 21.49.020 OF THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION OF SUBSECTIONS (13) AND (14) TO ALLOW THE PROCESSING OF GENERAL PLAN AMENDVENTS AND
MINOR ANNEXATIONS NECESSARY FOR REVISIONS TO
APPROVED MASTER PLANS.
APPROVAL OF A ZONE CODE AMENDPlENT, AMENDING
APPLICANT: CITY OF CARLSBAD CASE NO: ZCA-124
WHEREAS, the Planning Commission did, on the 23rd day of
hpril, 1980, hold a duly noticed public hearing as prescribed
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering
sll testimony and arguments, if any, of all persons desiring
to be heard, said Commission considered all factors relating to
the Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
lomission as follows:
4) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZCA-124, according to
Exhibit A dated 2/28/80, attached hereto and made a part

Allowing general plan amendments and annexation of property to accommodate revisions to approved master and specific plans will place insignificant demand on future sewer service.
There is viable evidence that sewer service will be
available in the near future and therefore some processing
can proceed.
Allowing the city to do, advanced planning and annexation will allow the city to provide better guidance for future land use decisions.

.CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21, CHAPTER 21-49, SECTION 21.49.020 OF THE CARLSBAD :?UNICIPAL CODE, BY THE
ADDITION OF SUBSECTIONS (13) AND (14)
TO ALLOW THE PROCESSING OF GENERAL PLAN
AMENDMENTS AND MINOR ANNEXATIONS NECESSARY
FOR REVISIONS TO APPROVED MASTER PLANS.
The City Council of the City of Carlsbad, California does
ordain as follows:
SECTION 1: That Title 21, Chapter 21.49, Section 21.49.020
of the Carlsbad Municipal Code is amended by the addition of
Subsections (13) and (14) to read as follows:

" (13) Applications for general plan amendments
may be accepted, processed and approved.
-- (14) Applications for minor annexations may be accepted, processed and approved, provided the City Manager finds that such annexation is Eecessary to accommodate a . revision to an approved master plan or specific plan."
EFFECTIVE DATE: This ordinance shall be effective

SUBJECT: ZCA-124, AP?IENDMENT TO PLANNING MORATORIU?I
The City Council on February 26, 1980, directed the Planninq
Commission to hold a hearing to lift the planning moratorium in general plan amendments and- to allow acceptance of pinor annexations if necessary to accorlmodate a revision to an approved master plan*or specific plan. The ordinance has
been drafted and 2s ready for your approval. (Exhibit "A"
date February 28, 1980).
Allowing the processing of general plan amendments will permit necessary advanced planning to continue. This vi11 be especially important in the Eon-Residential Reserve (l?XiR)
areas where no specific land use is presently designated.
Originally all planning processes inclucling general plan amendments and znnexations were placed in the moratorium. since n1os.t amendments and annexations add demand for Further
sewer service. However, many changes have occurred since
the beginning of the moratorium. For example, there may
soon be sewer available from the Lake Calavera Hill's Plant, the re-rating and/or expansion of the Encina Tlant and the possible construction of satellite treatment plants.

The moratorium, it appears, has created a build-up of projects requiring discretionary action. Allowing some applications to go forward will relieve some of this build-up.
Recommendation
It is recommended that the Planning Conmission adopt
Planning Commission Resolution No. 1625, APPROVING ZCA-124,
as per Exhibit "A" dated February 28, 198B.
