Appropriation of Funds for Street Lighting purposes
Statement of the Matter
On May 17, 1977, the City Council established the Street Lighting
Assessment District No. 1 in accordance with the Street Lighting
Act of 1919. In the resolution the Council indicated that the
City was to pay an annual fee x)f $8,120 for public property within
the district that was exempt from this assessment.
This fee was not paid in 1977-78, 1978-79 or 1979-80 and therefore
must be appropriated at this time and paid to the district. The
total amount due for these three years is $24,360.

MEMORANDUM
TO: Finance Director

SUBJECT: City Payments to Fund 15-206 "Street Lighting"
The Street Lighting Assessment District No. 1 was established by Council
by their Resolution No. 5091 of May 17, 1977. This District is set in
accordance with the Street Lighting District Act of 1919, Sections
18000-18193 of the Streets and Highways Code.
The Act provides that public property can be omitted and exempt from any
assessment, however the costs of these exemptions must be borne by the
City General Fund (paragraph 18014). The Council, in their Resolution,
exempted public property and in the Engineer's Report of the Assessment
District, there was an indication that the City contribution was to be
$8,120 per year. I requested Frank Rowlen to audit the fund recently
and he advised me that no City contributions have been recorded for 1977,
1978 or 1979 - thus, the fund is $24,360 short of receipts. In addition,
the City contribution for FY80-81 is projected at $11,306. I am unable
to determine where this "city cost" is to be budgeted and I fear it was
never included in any budget section.
It is recommended that $24,360 be appropriated from general fund
reserves to meet the City contribution for 1977, 1978 and 1979 and that
the appropriate non-departmental budget be designated/modified in order
that the City contribution can be included for the next fiscal year.

RESOLUTION NO.6209
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
THE TRANSFER OF FUNDS TO COVER THE COST
'OF PROVIDING STREET LIGHTING TO PUBLIC
PROPERTY.
WHEREAS, on May 17, 1977, the City Council of the City
of Carlsbad did establish the Street Lighting Assessment
JDistrict Number 1, and;
WHEREAS, the Council did establish the City's participation
in this assessment district at an annual fee of $8,120, and;.
WHEREAS, this fee has not been paid by the City into the
assessment district for a period of three years.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the amount of annual payments, $24,360, is
hereby transferred from the General Fund balance account
number 1-000-0900 to the Street Lighting account 1-206-2870.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on June 17, 1980 by the following vote, to wit:
