The planning staff and the Planning Comnission found. that this project met all devel-
opnent standards and design criteria of the Condminium Ordinance.
Through staff review and Planning Ccarmission hearing, all issues on this mtter have been satisfactorily resolved.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A FIVE UNIT CONDOMINIUM DEVELOPMENT ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE
OF JEREZ COURT, LA COSTA. APPLICANT: R. SPEARE CASE NO: CT 80-7/CP-57
WHEREAS, a verified application for certain property to, wit:
Lot 364 of La Costa South Unit No. 5, City of Carlsbad, according to Map No. 6600 filed in the County of San Diego, on March 10, 1970
3as been filed with the City of Carlsbad, and referred to the
?lanning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 11th day of June,
1980, hold a duly noticed public hearing as prescribed by law to
zonsider said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to the
Tentative Tract Map and Condominium Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of CT 80-7/CP-57, based on the following findings and subject to the following conditions
Findinss :
1) The project is consistent with the city's current general plan
since it is within the density range established for this site, and due to the unique configuration of the property, qualifies for a density somewhat below the suggested range. Also, as
conditioned, the project is consistent with all other elements of the general plan.

The site is physically suitable for the type and density of development since the site is adequate in size and topography to accommodate residential development at the proposed density and still meet all of the city's condominium and subdivision
regulations without creating any significant environmental impacts .
The project is consistent with all city public facility
policies and ordinances since:
The Leucadia County Water District has allocated sufficient sewer connections for the project.
The applicant has agreed and is required by the inclu- sion of an appropriate condition to pay a public
facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the general plan.
School fees to mitigate conditions of overcrowding are required at the time of building permits pursuant to Chapter 21.55 of the Carlsbad Municipal Code.
The Planning Commission has, by inclusion of an appro-
priate condition to this condominium permit and tentative
subdivision map, insured that the final map will not be
approved unless the City Council finds that sewer service
is available to serve the project. In addition, the Planning Commission has added a condition that a note be placed on the final map that building permits may not be issued for the condominium project unless the City Engineer determines that sewer service is available.
Since the final map cannot be approved unless sewer service is available, and building cannot occur within thc project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have
been met insofar as they apply to sewer service for this condominium permit and tentative map approval.

The proposed condominium project meets the criteria of Chapter 21.47 (Condominiums) since:
a) The condominiums meet the design criteria of Chapter 21.47.110 since the overall plan is comprehensive, embracing land, building, landscaping and their relation- ships, the driveway is not dominant feature, and suf- ficient circulation and on-site amenities are provided.

Conditions
Approval is granted for CT 80-3/CP-51 as shown on Exhibits
A and C to CT 80-3/CP-51, dated 5/27/80, on file in the
Planning Department and incorporated by reference. Develop- ment shall occur substantially as shown on these exhibits unless otherwise noted in these conditions,
Prior to the issuance of building permits, the applicant
shall prepare a reproducible copy (Mylar) of the final condo-
minium site plan incorporating all requirements of the condo-
minium permit approval and shall be subject to the approval of the Planning Director.
The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application,
These fees shall be based on the fee schedule in effect at the time of building permit application.
The applicant shall pay park-in-lieu fees to the city prior to the approval of the final map.
This subdivision and condominium plan is approved upon the
express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision.
This subdivision condominium plan is approved upon the express
condition that building permits will not be issued for development of the subject property unless the City Engineer determines that such sewer facilities are available at the
time of application for such permits and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building
permits will not be issued,
This approval is expressly conditioned on the payment by the applicant of a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and
according to the agreement executed by the application for
payment of said fee. A copy of that agreement, dated 5/5/80, is on file with the City Clerk and incorporated herein
by reference. If said fee is not paid as promised, this
application will not be consistent with the general plan and the project. cannot proceed and this approval shall be void,

PROJECT DESCRIPTION
The applicant is proposing a five unit condominium development on the west side of Jerez Court in La Costa.
The units will be arranged in two separate clusters, with access off of a common drive. Each dwelling will have two bedrooms and an attached two-car garage, with a maximum height of 31 feet. Since the site is essentially flat, a relatively minor amount of additional grading is proposed.
ANALYSIS
Planning Issues
Is the project comprehensively designed and have adequate on-site amenities been provided?
Discussion
The plans presently before the Commission represent
several significant modifications to the plans originally submitted by the applicant. Specifically, the initial submittal had the two units which are located nearest
to Jerez Court oriented so that only one unit had access off of the interior driveway. The other unit
took access directly off of Jerez Court via a separate
driveway. Staff felt that a design utilizing two separate driveways was inefficient in terms of providing landscaping along Jerez Court and in terms of creating a cohesive development with ample on-site amenities.
By redesigning the two units, the applicant was able to eliminate one of the driveways. As a result, all
visitor parking could be located on-street directly
adjacent to the site, and an essentially unusable on-
site visitor space could be deleted. Since the site is relatively narrow, these on-street spaces will be conveniently accessible to all of the units.

Also, by eliminating the driveway, the yard area along
Jerez Court could be devoted almost entirely to land- scaping.
As proposed, the development is comprehensively designed. emphasizing the interrelationships between the units and the on-site amenities. In addition to the recreation
area adjacent to Unit #4, each unit will have individual recreation areas in the form of private balconies. Also, substantial landscaping will be provided throughout the development, and Units 1-3, which abut the La Costa Golf Course, will have major views of the course.
Further, this project meets all development standards of
the Condominium Ordinance as they relate to parking,
storage, open recreation space, laundry facilities and setbacks.
It is important to note that the unusual shape of the site precludes developing a project which would have a
much higher density.
RECOMMENDAT I ON
Staff recommends that the Planning Commission adopt Resolution No. __. 1643, recommending APPROVAL of CT 80-7/
CP-57, based on the findings and conditions contained
therein.
