Subject: RECOMMENDING AWARD OF CONTRACT FOR LITTER REMOVAL TO THE
CARLSBAD BOYS AND GIRLS-CLUB
Statement of the Matter
. .
The City of Carlsbad contracted with the Boys and Girls Club in July 1979 for 1 i tter
removal services on a once-a-month basis from se 1 ected rights-of-way. Funding for this
program has been provided by SB650 grant funds (State Litter Control, Recycling and
Resource Recovery Grant Program). Indications are that funds will be made available
this year; however, thi_s allocation has not been made as yet.
Bids were.solici.ted from a large group of civic organizations in June and December 1979
but only the Boys and Girls Club responded on either occasion •. The Boys and Girls Club
has indicated their willingness to continue the program for another year.

The FY80-81 budget included $4800 for anti-litter efforts. Funds are to be funded
through the SB650 grant program; however,-these funds have not been appropriated by the
legislature nor is there any lndication of .the amount to be anocated, . Shbuld fund~
not·~e appropriated, costs of ~his contract would be $4800 to the ~eneral Fund,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT
BEn!EEN THE CITY OF CARLSBAD AND THE CARLSBAD
BOYS AND GIRLS CLUB FOR LITTER REMOVAL SERVICES.
WllEREAS, the City Council of the City of Carlsbad, California does
6 hereby resolve as follows:

8 1. That an agreement between 'the City of Carlsbad and the Carlsbad
9 Boys and Girls Club for services relative to removal of litter from City
10 l"ights-of-way, a copy of which is attached hereto, marked Exhibit 11 A11 and
ll made a part hereof, is hereby approved.
12 2. That the Mayor of the City of Carlsbad is hereby authorized and
13 directed to execute said agreement on behalf of the City of Carlsbad.
14 PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlsbad

This agreement entered into this ___ day of _____ , 1980
4 by and between the City of Carlsbad, a municipal corporation of the State of
5 California, hereinafter referred to as "Carlsbad" and the Carlsbad Boys and
6 Girls Club, hereinafter referred to as 11 Cl ub 11 •

·wnNESSETH:
WHEREAS, Carlsbad is engaged in various street maintenance programs
9 including street sweeping to promote the safety, health and general welfare
10 of its citizens and;
ll WHEREAS, Carlsbad has been awarded grant funds from the State of
12 California specifically designated for the purposes of litter removal and;
13 HHEREAS, it is deemed appropriate to accomplish litter removal from
14 the City rights-of-way by agreement with the Club and:
15 I-IHEREAS, the Club can provide litter removal service for just
16 compensation and in the public int1:.-est;

NOW, ntEREFORE, IT IS AGREED as fo 11 ows:
SECTION 1 DUTIES OF CARLSBAD
A. Provide appropriate warning signing, equipment and disposal of
collected litter.
B. Pro vi de appropriate ins pee ti on of the '-1 eared areas.
C. Reimburse the Club on a monthly basis in the amount of $400.00
on the conditio,, of faithful performance of litter removal.
SECTION 2 DUTIES OF THE CLUB
A. Provide litter removal from the rights-of-way on:
1. Palomar Airport Road -from El Camino Real cast to the
city limits (Linda Vista Lane).

2. Alga Road -Alicante to El Fuerte, including the median.
3. Coast Highway (Carlsbad Boulevard) from Palomar Airport
Road to the Batiquitos Bridge, including the median.
4. El Camino Real -Kelly Drive to Marron Road, including
the median from Chestnut to Marron.
5. El Cami no Real -south from Beckman entra11ce to end of
industrial area.
6. Cannon Road -Carlsbad Boulevard to east end.
7. Marron Road -El Camino Real to Avenida de Anita.
8. Chestnut -Monroe to El Cami no Rea 1.
9. Poinsettia Lane -Avenida Encinas to Batiquitos Lane.
on a once-a-month basis.
B. Provide adult superiision on the basis of one (I) adult per
four (4) youth members.
C. Take all necessary measures to ensure the safety of pe:-sonnel
involved in the litter removal efforts.
D. Conduct litter removal during the period 8:00 a.m. to 3:30 p.m.
on Saturday. Specific Saturday to be scheduled to the mutual
satisfaction of t,·,e Club and City.
SECTION 3 PAYMENT TO the Club on the basis of one comp1 ete litter
clean-up per month in the amount of $400. 00 per month during the
period of this agreement.
SECTION 4 IERM This agreement will be effectiva upon the date
of execution t\f this agrer.ment by the Mayor of Carlsbad, It shall
terminate on June 30, 1981. During saitJ term, this agreement may
be terminated at any time upon thirty (30) days written notice,
SECTION 5 .'.NSURANCE The C1ub shall provide City a certificate of
insurance 11aming City as additionally insured on their normal

liability policy.
SECTION 6 HOLD HARMLESS AGREEMENT Carlsbad, its officers and
employees shall not be liable for any claims, liabilities, penalties
or fines or any damage to goods, properties or effects of any person
whatever, or personal injuries to or death of them caused by, or
resulting from, or claimed to have been caused by, or resulting from,
any act or omission of Carlsbad, its ofif1ii:::er.s or employees. The Club
furth~r agrees to indemnify and save free and harmless Carlsbad and
its authorized officers and employees, against any of the foregoin~
liabilities and claims thereof, and any cost and expense that is
incurred by the City on account of any cl aim thereof.
SECTION 7 NOTICES All notices required herein shall be in writing
and delivered in person or sent by mail. Notices to Carlsbad shall
be addressed: City Manager, 1200 Elm Avenue, Carlsbad, Cal if orni a
92008. Notices to the Club shall be addressed: Executive Director,
P.O. Box·913, Carlsbad, California 92008.
IN \HTNESS WHEREOF, the parties hereto have executed this agreement
