Statement of the Matter
During the next several months the City will be required to do
substantial staff work concerning the proposal to create a
subsidiary district of Costa Real Municipal Water District. The
type of work to be done includes:
-- research into the pros and cons of the proposal
— preparation of various written reports
— undertaking a public information program to
inform the voters
— representation at public agency hearings
— coordinating staff and citizen committee activities
— negotiation with water districts over terms of
settlement agreements .-
— assist in the conduction of a special election
In my judgment the time required for these tasks would overburden
regular city staff. It is my recommendation that the City Council
authorize the hiring of a consultant to work with the City Manager
to coordinate and carry out the city's effort.
Fiscal Impact
An election will most likely be held in March, 1981. For 9 months
the consultant contract plus expenses would total about $15,000.
This amount could be appropriated from the water fund.

RESOLUTION NO. 6251
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN AGREE-
MENT BETWEEN THE CITY OF CARLSBAD AND GLENN E.
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
, 1. The certain agreement between the City of Carlsbad and
Glenn E. McComas for consulting services for the reorganization
of water services, a copy of which is attached hereto marked
Exhibit "A" and made a part hereof, is hereby approved.
2. The Mayor of the City of Carlsbad is hereby authorized
and directed to execute said agreement for and on behalf of the
City of Carlsbad.
PASSED, API-ROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad held the 15th day of
July , 1980, by the following vote, to wit:

CONSULTANT EMPLOYMENT AGREEMENT FOR
PERSONAL SERVICES BETWEEN THE CI^
OF CARLSBAD AND GLENN E. McCOMAS

THIS AGREEMENT made and entered into this 15th day of
July, 1980, by and between the CITY OF CARLSBAD, California, a
Municipal Corporation, hereinafter referred to as "City" and GLENN
E. McCOMAS, hereinafter referred to as "Consultant".
•7 WIT. NESSETH:
8 WHEREAS, the City of Carlsbad desires to engage Consul-
tant to provide consulting services on matters relating to the
10 reorganization of water service within the City of Carlsbad as
11 assigned by the City Manager of the City of Carlsbad and to submit
12 oral or written reports on same; and
13 WHEREAS, Consultant, acting as an independent Contractor
14 performing consulting services, desires to accept employment as a
15 Governmental Consultant.
16 NOW, THEREFORE, it is mutually agreed between the parties
17 hereto as follows:
18 SECTION 1. City hereby retains and engages Consultant
19 to perform expert and professional services for the City of Carls-
20 bad as a Government Consultant, to advise the City Manager and
21 City Council and co-ordinate all aspects of the proposed reorgani-
22 zation of the Costa Real Water District (formerly Carlsbad Muni-
23 cipal Water District) as a subsidiary District of the City of
24 Carlsbad. The scope of Consultant's duties shall include:
25 . 1. Pursuit of the reorganization at all stages of
26 "the process through LAFCO, the Board of Super-
27 visors and, if necessary, to an election.
28 2. Represent the City at meetings.
29 3. Report regularly on the progress of the
30 reorganization to the City Manager and City
31 Council.

1 4. Co-ordinate efforts of the City staff and citi-
g zens groups.
3 5. Prepare and distribute materials to inform the
4 public.
5 SECTION 2. Consultant shall perform said services in
6 his own way as an independent Contractor and in pursuit of his
7 independent calling and not as an employee of the City, and he
8 shall be under control of the City only as to the-results to be
9 accomplished and not as to means or manner by which such result is
10 to be accomplished. The City Manager may refer or direct assign-
11 ments to Consultant for professional processing. The City Manager
12 shall take necessary steps to assign staff cooperation with Con-
13 sultant on such assignments.
14 SECTION 3. The City agrees that the Consultant be
15 retained on a month-to-month basis at $ 1.200.00 Per month and
16 for this retainer fee, Consultant will work a maximum of 40
17 hours per month on specifically assigned projects relating to the
18 reorganization. Consultant will keep a record of time worked on
19 such projects and submit it to the City Manager at the end of each
20 month. Any work by the Contractor in excess of 40 hours per
21 month will be approved in advance by the City Manager and will be
22 paid for by City to Consultant at the rate of $ 30.00 per hour.
23 SECTION 4. The Consultant will be reimbursed by City
24 for any travel expense incurred in connection with travel involved
25 and such reimbursements to be subject to approval of the City
26 Manager.
27 SECTION 5. This agreement shall begin on July 15, 1980 ,
28 1980, and shall terminate by mutual agreement.
29 SECTION 6. This agreement may be terminated at any time
30 by either party upon thirty (30) days written notice. In the

event of a termination during a month, compensation will be paid
on an "hours worked" basis for
