The applicant is requesting a 5 unit airspace tentative tract map and condominium permit on property located on the west side of Madison Street between Pine Avenue and Walnut Avenue. The Planning Commission is recommending denial of this project because it exceeds the density allowed by the General Plan and does not meet development standards and design criteria of the condominium ordinance. Specifically, the project's density is 31 dwelling units per gross acre. The General Plan designation of the site is medium.density which allows 10 dwelling units per gross acre and up to 20 dwelling units per gross acre if certain criteria are met as specified in the General Plan. The project's density, thus, is 11 units per gross acre above the maximum allowed on his site. With respect to development standards, the project is deficient in open recreational space and accessible storage. Further, parking design standards and setbacks are not met by this project, as detailed in the staff report dated June 25, 1980. At the Planning Commission public hearing, Mr. Jeff Crisman opposed the decision because he believed the project to meet city require- ments. No other members of the general public spoke on. this item. FROM : Mike Howes, Assistant Planner SUBJECT: CT 80-13/CP68 - MAHIN AND CRISMAN - Request for a Tentative Subdivision Map and Condominium Permit for 5 units of the west side of Madison Street between Pine Avenue and Walnut Avenue. I. PROJECT DESCRIPTION The applicants are proposing to construct a 5 unit as described above, The subject property is vacant and surrounded by older single family and multi-family residences, - condominium project on a level, .16 acre parcel, located, This project will consist of two story condominiums with a parking garage located underneath the units as shown on Exhibits A and B. Approximately 615 square feet of open space will be provided on a open deck area above the parking garage. All of the proposed units will have two bedrooms and vary in size from 924-956 square feet, 11. ANALYSIS ! Planning Issues 1, Is the proposed condominium project consistent with the Land Use Element of the General Plan? 2, Does the proposed project conform with all of the development standards and design criteria of the condominium ordinance? Discuss ion The site of the proposed condominium project is located in an area that is designated as RMH by the Land Use -Element of the CarlsbaZl General Plan. This designation, allows a density of 10-20 dwelling units per acre. Since the subject parcel has a total area of .16 acre the maxi- mum number of condominium units permitted according to the General Plan would be three, The applicant plans to construct five condominium units which would result in a density of 31 dwelling units per acre, exceeding the maximum density allowed by the General Plan by 11 units per acre. In fact, the highest density allowed by the General Plan in any section of the city is 30 dwelling units per acre. With a density of 31 dwelling units per acre, the staff cannot find that the project is consistent with the General Plan and therefore can not recommend approval. This project also does not meet all of the development standards and design criteria of the condominium ordin- ance. According to the condominium ordinance, at least 200 square feet of open recreation space must be provided for each unit. Also the minimum lineal dimension of any of these areas must be 10 feet except for balconies which may have a minimum lineal dimension of six feet. Based on these figures this project has a total of 807 square feet of open recreation space counting the decks above the garage and the balconies on the three A units. result in approximately 161 square feet of open space per unit, 39 feet less per unit than is required. This would Also, each unit must-have a total of 480 cubic feet of storage area conveniently accessible to the outdoors. Much of the storage area is located at the head of the parking spaces. If cars were parked in these parking spaces it would.be necessary to remove the cars to gain access to the proposed storage areas. This situation would affect over 30% of the proposed storage area and is undesirable because of possible blockage of driveway vehicular movement. With respect to parking requirements, all parking spaces must have a minimum width of 83i feet. Exhibit "A" indi- cates that four parallel parking spaces with a width of 8 feet will be located along the southerly edge of the parking garage. These parking spaces would protrude approximately 6 inclies into the minimum width 12 foot driveway for the parking area. Further, the condominium ordinance requires that the building be setback at least five feet from all open parking spaces. Two partially open parking spaces are located against the western edge of the building thus not meeting the setback requirement. These spaces cannot be relocated further away from the building because of the location of an alley to the rear of the property, and the narrowness of the site. -2- This project also fails to meet all of the design criteria of the condominium ordinance. The purpose of the design criteria is to ,create a comprehensive, well designed, and livable project. Most of the proposed open space for this project will be located on an open deck directly above the parking garage. The residents of this building will have to walk across this deck’to gain access to their units. This will tend to greatly reduce the amount of area on the deck which could be used for recreational purposes. Staff believes it to be poorly designed and that it will not be used for recreational purposes. The design criteria also require that adequate circulation and off-street parking be provided by the proposed project. As shown on Exhibit A the proposed parking for this project does not meet these requirements. The circulation could be impeded by the three parallel parking spaces along the north side of the building. Basically it appears that this project, as .designed is just too large for this parcel. If the project was redesigned for three units rather than five it probably could be fit on this parcel with a minimum amount of effort. 111. RECOPIBIENDATION It is recommended that the Planning Commission ADOPT Resolution No. - 1662, recommending DENIAL of CT 80-13/CP-68 to.the City.Counci1 based on the findings contained therein.
