TENTATIVE AND FINAL MAP WITHDRAWAL
CARLSBAD TRACT 79-10
STATEMENT OF THE MATTER
The City Council approved the tentative map for this five-unit condominium project on
November 20, 1979 and the final map on April 15, 1980. At the owner's request, the
County stopped processing the map for recordation and has returned it to the City.
The owner wishes to withdraw both the tentative and final maps, obtain a refund of
park-in-lieu fees and have the public facilities fee agreement released. The project
has no easements, no dedications, no bonds and no improvements (except street trees)
are required. City Code Section 20.40.070 permits the return of fees.
FISCAL IMPACT
Probably insignificant as a new application will likely be received on this" property.

RECOMMENDATION
1. Adopt Resolution No.^:? 77 .
2-. Cancel the Agreement for the Payment of a Public Facilities Fee dated 2/28/80.
3. Direct the Engineering Department to destroy the Final Map.
4. Approve the refund of the park-in-lieu fe,e in the amount of $10,162.00 and the
duplicate tracing deposit in the amount of $50.00.
Council Action:
8-19-80 Council adopted Resolution 6277, rescinding CT 79-10.and CP-14. and directed staff
to proceed with actions outlined in the above stated Recommendation.

Dear Richard:
Please take this letter as written notice that we wish to have both
the tentative map and final map for this project withdrawn from
processing. It is our understanding that this will void the agree-
ment between the owner and the City of Carlsbad for the public
facilities fee and the park fees, paid in lieu of dedicating land;
and therefore these fees can be refunded.
Enclosed is a check for $100.00 to cover the processing of this
request.

RESOLUTION NO. 6277
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARSLABD, CALIFORNIA, RESCINDING TENTATIVE MAP
CT79-10 AND CONDOMINIUM PERMIT CP-14 FOR A FIVE-
UNIT CONDOMINIUM PROJECT AND RESCINDING THE FINAL
MAP FOR SAID PROJECT ON AN APPROXIMATELY 19,000
SQUARE FOOT PARCEL, GENERALLY LOCATED ON THE NORTH
SIDE OF NAVARRA DRIVE, THREE LOTS WEST OF VIEJO
CASTILLA WAY, IN LA COSTA. APPLICANT: HSIU.
WHEREAS, the City Council of the City of Carlsbad, on November 20,
1979, adopted Resolution No. 5990 approving Tentative Subdivision Map CT79-10
and Condominium Permit CP-14; and
WHEREAS, the City Council of the City of Carlsbad on April 15, 1980
approved the Final Map for CT79-10; and"
WHEREAS, the owners of the property have requested that both the
tentative map and final map be rescinded;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows: .
A. That the above recitations are true and correct.
B. That the approval of Tentative Subdivision Map (CT79-10) and
Condominium Permit (CP-14) and Resolution No. 5990, dated November 20, 1979
are hereby rescinded.
C. That the approval of the Final Map for CT79-10, granted on
April 15, 1980, is hereby rescinded.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad, California, held on the 19th day of August, 1980 by
the following vote, to wit:
AYES: Council Members Packard, Casler, Anear, Lewis and Kulchin
NOES:None
ABSENT: None
