The applicant.requests approval of a seven unit tentative tract map and condominium permit on property located on the east side of Lincoln Street, between Pine Avenue and Walnut Avenue in the R-3 zone. The Planning Commission added a condition requiring that the visitor parking spaces be signed and labeled to ensure that visitors to the project would use them. As conditioned, the Planning Commission found this project to meet the development standards and design criteria of the Condominium Ordinance and the requirements of the Subdivision Ordinance. Through staff review and Planning Commission hearing all. issues on this matter have been satisfactorily resolved. APPLICANT: LATITUDE 33 CASE NO: CT 80-22/CP-101 WHEREAS, a verified application for certain property to, wit: The northwesterly 100 feet of Tract 219 of Thumlands, in the City of Carlsbad, according to Map thereof No. 1081, filed Decamber 9, 1915 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 23rd day of -. The Planning Commission has, by inclusion of an appropriate condition to this condominium permit and tentative subdivision map, insured that the final map Will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that building permits will not be issued for the condominium project unless sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have been met insofar as they apply to sewer service for this tentative map and condominium permit approval. School facilities will be provided by the Carlsbad Unified School District. Park-in-lieu fees are required as a condition of approval All necessary public improvements have been provided or will be required as conditions of approval. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Conditions Approval is granted for CT 80-22/CP-101, as shown on Exhibit (s) "A", "B" , and "C", dated June 27,. 1980, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that building permits shall not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. This project Ls approved upon the express conditicAi that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated April 17, 1980, is on file with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. The applicant shall prepare a reproducible mylar of the' final condominium site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Department prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Department prior to final map approval. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Department prior to final map approval. In addition, adequate fire hydrants with required fire flows shall be installed on and off site as required by the Fire Department. The applicant shall install street trees to city spec- ifications at 40 foot intervals along all public street frontages prior to final occupancy of any building. The variety of said trees shall be subject to the approval of the Parks and Recreation Department. The applicant shall pay park-in-lieu fees to'the city, prior to the approval of the final map as per Chapter 20.44 of the city's subdivision regulations. Any signs' proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval by the Planning Department prior to installation of such signs. All landscaped areas shall be maintained in a healthy and thriving condition, free from.weeds, trash, and debris . Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to city standards. Location of said receptacles shall be approved by the Planning Director and Fire Marshall prior to final map approval. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Department. Approval of this request shall not excuse compliance with all sections of the zoning ordinance and all other applicable city ordinances in effect at time of building permit issuance. a The developer shall receive the approval of the City Engineer for a site grading plan and obtain a grading permit prior to issuance of building permits if grading quantity exceeds 250 cubic yards. Drainage improvements shall be constructed in accordance with an approved plan, and the work shall be coordinated . with the overall plan for grading to the satisfaction of the City Engineer. The developer shall ikiprove Lincoln Street to city standards and subject to the approval of the City Engineer based on a centerline to curb face width of 20 feet prior to the occupancy of any units. Prior to final occupancy of any units, the visitor parking spaces shall be signed and labeled to the satisfaction of the Planning Director. I. PROJECT DESCRIPTION .- The applicant is proposing to construct a seven unit condominium on the east side of Lincoln Street between Pine Avenue and Walnut Avenue on a .35 acre parcel. The subject property is zoned R-3. This project will result in a net density of 21 dwelling units per acre, which is in conformance with the General Plan designa- tion of 20-30 dwelling units per acre for this site. The proposed project will consist of four residential buildings which will be connected by breezeways and third floor balconies. The site of the proposed condominium project is level and occupied by an older single family residence. Several newer multiple family dwellings have been constructed in the vicinity of the proposed project. 11. ANALYSIS PLANNING ISSUES 1) Does the proposed condominium project conform with the development standards of the conominium ordin- ance? 2) Does the proposed condominium project conform with the design criteria of the condominium ordinance? DEVELOPMENT STANDARDS 5 The applicant proposes to provide two parking spaces per unit within an enclosed garage. Most of the parking spaces will be located underneath the units which they serve. Parking for units 3 and 7 will be located in a garage located at the rear of the property and although it would be more preferable to locate these garages underneath the structures they serve, the garages will be within 120 feet of the units and therefore staff is satisfied that they are adequately accessible to the units. Two covered guest parking spaces will be provided on site and two additional guest parking spaces will be available on Lincoln Street. As proposed, the project meets all parking requirements. A spa and open recreation deck will be located to the rear of the property. Each of the units will have either a second or third story balcony ranging in size from 77 square feet to 117 square feet. With both, the balconies and the common recreational facilities, each unit will have substantially more than the 200 square feet of open space required by the condominium ordinance. Each of the units will have between 480 and 572 square feet of storage,area accessible to the outdoors, located in the garages and balconies, fulfilling the storage requiremc. :-s of the condominium ordinance. A condition has been r?ed requiring that all units provide space for laun: facilities to accomodate a washer and dryer. i ), separate utility meters will serve the units as ,.dicated on Exhibit "A". As shown on the attached exhibits, this project meets all other development standards af the condominium ordinance. I DESIGN CRITERIA This project meets all of the requirements of the design criteria of the condominium ordinance. The driveways will provide adequate access to the units and the parking yet will not dominate the project. The open space and recreational areas are readily acces- sible to each of the dwelling units. Pedestrian access has been designed to allow safe, convenient access between the units, recreation area and garage. Also, the second and third story balconies have been designed to provide private recreational space. This project is surrounded by older duplexes and single family homes at the present time, however, there are a number of newer multiple family dwellings located within a block of this project. Therefore, the project will be compatible with the existing and future develop- ment in this area. All other design criteria have been met by this project. 111.
