Statement of the Matter
At the June 17, 1980 Council meeting, a public hearing was held on handicapped parking requirements. All affected business owners were notified but none were in attendance. Council continued this item
until all Council members could be present.
Since this time, a series of three meetings was scheduled with the owners to discuss handicapped parking requirements in detail. Out of the twenty-two businesses contacted, only seven were represented.
The resolution to be considered by the Council provides that the
City Manager shall designate parking stalls or spaces for use by
handicapped persons and enables the police to enforce parking violations in properly designated handicapped parking spaces under
Vehicle Code Section 22507.8.
Staff is recommending the following:
One handicapped space for first 50 spaces
One handicapped space for each additional 50 spaces Qne space for each add.itional 100 saaces USE space for each additional 200 spaces
Staff is recommending approval of spaces already provided by Burrough$,
as they are already complying with regulations established by California
State Department of Rehabilitation; Hughes Aircraft, who has more
handicapped spaces than recommended; and Plaza Camino Real, who is
already royiding handicapped parking and ramping. City Manager is in agreement with staff recommendation and police can enforce violations.

At the meeting of June 17, 1980 a public hearing was held
on handicapped parking requirements. None of the twenty-two
owners who were notified were in attendance. The matter
was continued until a time when all members of the Council
were present as Council Member Anear was on vacation.
Staff contacted all twenty-two owners and scheduled three separate meetings but only six owners and one manager attended. The consensus of those who did attend was approval of Council
adopting the resolution as prepared by the Attorney's office.
Staff recommends establishment of a ratio of one handicapped
space per 50 spaces; one handicapped space for an additional
50 spaces; one space for each additional 100 spaces, plus one
space for each additional 200 spaces after initial requirements are met.
Staff recommends excluding Burroughs Corporation as they are
complying with regulations established by California State Department of Rehabilitation. is Hughes Aircraft, as they have more handicapped spaces than the staff recommendation, and Plaza Camino Real, as they are providing handicapped parking and ramping,

Re: HANDICAPPED PARKING SPACES
On August 26, 1980, the Carlsbad City Council adopted Resolution No. 6213. This Resolution establishes regulations pertaining to handicapped parking spaces and provides for the enforcement of such regulations in accordance with the California Vehicle Code.
A copy of Resolution 6213 is enclosed, together with a copy of Appendix "A" thereto. Sections 5 and 6 of this Resolution set forth the prescribed form for identifying handicapped parking spaces, as illustrated in Appendix A.
Should you desire that the City of Carlsbad Police Department enforce the restrictions of handicapped parking spaces, you must
fully comply with the provisions of Sections 5 and 6 of Resolution
6213.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
TO PRDVIDE PARKING FOR HANDICAPPED
PERSONS.
WHEREAS, the City Council of the City of Carlsbad, California
desires to provide adequate parking in the City €or handicapped
persons; and
WHEREAS, the City Council finds that there are .certain
privately owned and maintained off-street parking facilities
generally held open for use of the public for purposes of
v'ehicular parking; and
WHEREAS, the City Council has held a public hearing after
notice to the owners and operators of the privately owned
off-street parking facilities; and
WHEREAS, the City Council is authorized, by Vehicle
Code Sections 21107.8, 22507.8 and 22511.8 to enact this
resolution;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Carlsbad, California establishes the following
regulations pertaining to handicapped parking:
1. That the above recitations are true and correct.
2. That the City Manager shall designate parking stal-1s
or spaces on any street or on any publicly owned, leased or
controlled off-street parking facility for exclusive use by
handicapped persons.
3. That the City Council finds that the following
privately owned and maintained off-street parking' facilities
are generally held open for use of the public for purposes of

handicapped persons parking in handicapped. zones will be cited. Veh.C.Sec. 22507.8."
7. That any person who parks a vehicle not displaying
distinguishing placards or license plates issued for handicapped
persons in any parking stall or space designated according to this
reso1ut.ion shall be guilty of violating Vehicle Code Section 22507.E
