STATEMENT OF THE MATTER '.
The applicant is requesting a change of zone from L-C to CT-Q on
property located on the northwest corner of Paseo Del Norte and
Palomar Airport Road. The applicant's intent is to provide zoning
to allow the development of a motel, 2 restaurants, service station
and retail commercial stores.
The Planning Commission found this application to be consistent
with the Travel Service (TS) land use designation of the General
Plan. Further, the Commission found that uses allowed in the
proposed CT-Q zone are consistent with surrounding land uses and
zoning.
Through staff review and Planning Commission hearing, all issues
on this matter have been satisfactorily resolved.

RECOMMENDATION
Both the planning staff and Planning Commission recommend that
this application be APPROVED and that the City Attorney be directed
to prepare documents APPROVING ZC-213, per Planning Commission
Resolution No. 1669.
Council Action:
9-2-80 Council directed the City Attorney to prepare documents approving ZC-213 as per

SUBJECT: ZC—213 - ECKE - Request for a change of zone from
L-C (Limited Control) to CT (Tourist Commercial) on
property generally located on the northwest corner
of Paseo Del Norte and Palomar Airport Road.
As the Planning'Commission will recall, this item was continued
from the July 9, 1980, meeting pending the approval of a
General Plan Amendment on the property by the City Council.
This amendment changed the land use designation of the property
from NRR (Non-Residential Reserve) to TS (Travel Service
Commercial) and was approved on August 5, 1980. The proposed
zone change to CT is consistent with the TS land use designation,
RECOMMENDATION
It is recommended that the Planning Commisrion ADOPT Resolution
No. 1669, recommending APPROVAL of ZC-213 to the City Council
changing the zone from L-C to CT based on the findings contained
therein.

CONTROL) TO CT-Q (TOURIST COMMERCIAL WITH Q OVERLAY) ON THE
PROPERTY LOCATED ON THE NORTHWEST CORNER OF PALOMAR AIRPORT
ROAD AND PASEO DEL NORTE.
I. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting a change of zone from L-C (Limited
Control) to CT-Q (Tourist Ccimmercial) on property as described
above. The applicant's intent is to provide a zone to allow the
development of a motel, two restaurants, service station and
related commercial uses. The Q overlay designation will require
the submittal oE a Site Development Plan for Planning Commission
approval prior to the construction of any buildings on the site.
As the Planning Commission will recall, a General Plan Amendment
(GPA 50 (B)) was recommended for approval to the City Council on
June 19, 1980 changing the existing NRR (Non-Residential Reserve)
designation to TS (Travel Services). The requested zone change to
CT-Q is consistent with the TS designation of the General Plan.
II. ANALYSIS
PLANNING ISSUES
1) Is the CT-Q zone consistent with the TS General Plan desig-
nation?
2) Is the site suitable in size and shape to accomodate uses
allowed in the C-T zone?
3) Are the allowed uses and proposed zoning compatible with
surrounding land uses and zoning?
DISCUSSION
The TS (Travel Services) designation of the General Plan is intended
to provide for travel oriented uses on major regional corridors.
The C-T zone also allows for travel and tourist oriented uses and
is the- most compatible zone with the TS designation. Given the
intent of the applicant to develop Ms property as a motel, rest-
aurants, service station and related commercial facilities and the
General Plan designation of TS, the CT zone would be the most
ideally suited for the site and is consistent with the General
Plan.

The site is 15.31 acres in size and relatively flat. As shown on
the location map, there are two buildable areas on the lot. The
smaller of the two to the north abuts the southern boundary of Car
Country, and the other located to the south is adjacent to Palomar
Airport Road. The applicant has submitted a preliminary site plan
indicating the use of the northern portion of the site as a dinner
oriented restaurant and the southern portion as a 108 unit motel, a
restaurant (Pea Soup Andersons) and a service station. A pre-
liminary site plan will be on display at the Planning Commission
meeting for the Coimiission's information. Staff has found that the
site is suitable in size and shape to accommodate the proposed
uses.
In terms of adjacent land uses, the Dixon Ford Car Dealership abuts
the site to the north, a vacant parcel and flower field are to the
east, 1-5 and a mixture of industrial and commerical uses are to
the west, and a restaurant and service station to the south. Most
uses in the vicinity of 1-5 and Palomar Airport Road are travel
service oriented, thus the proposed use of the applicant's site as
a motel and restaurant is compatible with surrounding land uses.
Surrounding zoning includes C-2 to the north, R-A-10,000 to the
east, C-2 to the south, and P-M and C-2 to the west. A C-T zone
district would allow uses which are compatible with uses allowed in
the surrounding zones. Staff has found that the CT zone and land
uses allowed under the CT zone are compatible with adjacent land
uses and zoning.
III. REO3MMENDATION
It is recommended that the Planning Commission ADOPT Resolution No.
1669 , recommending APPROVAL of ZC 213 to the City Council based on
the findings contained therein.

WHEREAS, said application constitutes a request as provided

by Title 21 of the Carlsbad Municipal Code; and

WHEREAS, the Planning Commission did on the 9th day of July,

1980, and the 13th day of August, 1980, hold a duly noticed public

hearing as prescribed by law to consider said request; and

WHEREAS, at said public hearing, upon hearing and considering

the Commission recommends APPROVAL of ZC-213, based on the

2) The site is physically suitable for the type of uses
allowed in the CT-Q zone for the reasons stated in the
staff report.
3) The applicant has agreed and is required by the inclusion of
an appropriate condition to pay a public facilities fee.
Performance of that contract and payment of the fee will
enable this body to find that public facilities will be
available concurrent with need as required by the General
Plan.
4) The proposed change of zone will not cause any substantial
environmental impacts, and therefore, the Planning Director

as shown on Exhibit "A" dated May 20, 1980.
2) This project is approved upon the express condition that
the applicant shall pay a public facilities fee as required
by City Council Policy No. 17, dated August 29, 1979, on
file with the City Clerk and incorporated herein by
reference, and according to the agreement executed by the
applicant for payment of said fee a copy of that agreement
dated June 11, 1980, is on file with the City Clerk and is
incorporated herein by reference. If said fee is not paid
as promised, this application will not be consistent with
the General Plan and approval for this project shall be void.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 13th day of August, 1980, by the following vote, to'wit:
