The Planning Commission denied a variance request for a reduc of the front yard setback from 20' to 10' on the property- F of the four easterly units to eliminate the secondary entries Garfield. Avenue. At the public hearing, three citizens voiced opposition to th variance request, parking impacts, and the removal of two Tor Pine trees. Mr. John Todd. ind-icated that he represented appr 20 property owners in the vicinity who opposed the variance. OF A TENTATIVE SUBDIVISION MAP AND CONDOMINIUH ' TO DEVELOP 9 UNITS, AND A VARIANCE TO ALLOW A REDUCTION OF THE FRCNT SARD SETBACK TO TEN FEET PROPERTY LOCATED ON THE SOUTHWEST CORNER OF GAR STREET AND MAPLE AVENUE IN THE R-3 ZONE. I. PROJECT DESCRIPTION The applicant is requesting approval of a tentative subdivision map 2nd condominium permit to develop 9 units on .38 acres, located, as described above. Th. applicant is also requesting a variance to the zonin ordinance to reduce the required front yard from 20' to 10'. The subject property is a previously improved corner occupied by a single family residence. Eight of the proposed two-bedroom units would be two stories and range in size from 1285 square feet to 1484 square f The remaining unit would be a tri-level "owner's uni of 2058 square feet. 11. ANALYSIS PLANNING ISSUES: V-305 1, Can the four mandatory findings for approval of variance be made? a. Are there exceptional or extraordinary circumstances applicable to the property that do not apply to other property in thc \ vicinity? \ b- Do other properties in the vicinity share a similar property right which is denied to this property? c. Will this variance adversely affect the comprehensive General Plan? d. Will this variance be detrimental to the public welfare or injurious to property in the vicinity? .. e 0 DISCUSSION V-305 b Section 21,16,030 of the R-3 zone requires that every lot shall have a front yard of not less than twenty feet. Th applicant is requesting a variance from this section of t zoning ordinance to permit a 10' front yard. The applica intent is to provide increased useable recreation area in ' the rear yard. Staff is unable to make the findings required for approva of the variance. Specifically, no exceptional or extra- ordinary circumstances exist on the subject property whic do not apply to other property in the same vicinity and zone. The two parcels proposed for development are simil to the majority of lots in the area; relatively flat and regular in their rectangular shape and size. Secondly, other properties in the vicinity do not share a property right denied to this property. var'iance is not necessary to develop the lot at the re- shifted south 10' and still satisfy all development stand The only other development in the area identified by staf as constructed with a reduced front yard setback was a duplex on a key lot where a reduced setback is permitted the zoning ordinance (15' required per 21.16.030). Although approval of this variance would not by itself af the General Plan in an adverse manner nor be detrimental the public welfare or injurious to property in the vicini the zoning ordinance has attempted to maintain an uncrowc residential atmosphere by requiring the twenty foot setb; Approval of a reduction in the front yard may set a precc in a high density, sensitive beach area. Based on the inability to find sufficient facts to make I required findings, staff is recommending denial of the variance. This will create a den for use of this on-street parking at times by both resid,E and visitors to the project. By itself this project may not create a parking problem on this section of Garfield if other projects are approved with a similar design, a parking problem could develop, suggest that this secondary access not be provided and tl: area be blocked off and used to increase the private yarc area along Garfield for each of these four units.
