SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS
CARLSBAD TRACT 74-K(A) - Tempi in Heights, Unit 1
Statement of the Matter
MLM Development, Inc., has requested the acceptance of the public improvements
of the subject subdivision. A final inspection was conducted and the improve-
ments are found to be acceptable for maintenance. "As built" drawings are on
file in the Engineering Department, and final accounting is completed.
The City shall retain a $5,000 erosion control'bond for the slopes on Elm
Avenue. Release of this bond shall be at the discretion of the City Engineer";
Fiscal Impact
City Maintenance Department will be required to maintain publicly accepted
streets.

Recommendation
Council accept the Public Improvements as completed, direct the Utilities/
Maintenance Director to commence their maintenance, the City Clerk to record
the Notice of Completion and release the applicable .bonds, and the Finance
Director to refund the balance of the Trust Account of $2,602.24 to the
developer.

Dear Mr. Evans:
All requirements associated with Tempi in Heights Unit 1 of Tentative Map
74-14A have been completed. The twenty-eight foot wide section of Elm
Avenue west of Santa Clara Way has also been completed.
It is requested that the subdivision be reinstated on the Council agenda
for public acceptance and subsequent release of all bonds for maintenance
and public improvements.
The engineer of work has modified the Elm Avenue plan to conform to the
"as built" condition.
