SUBJEfl': STORM DRAIN ON OCEAN STREET AND CEDAR AVENUE CONTRACT NO; 1086
Owing to the failure of an existing drainage pipe at the subject site, staff has prepared plans and specifications for the construction of a replacement drainage facility. 'The
downstream portion of the proposed storm drain is to be constructed by the developer of
a motel which' is currently being plan checked by the Building Department. The upstream
portion and the inlets will be constructed by the City under contract. Attached is the
necessary easement for the construction of the storm drain and for public access to the
beach. Coastal Commission approval for the project is expected on October 17, 1389.
The Planning Department has issued a negative declaration on the' Environmental Impact
Assessment for this project.
F I SCAL IMPACT
The engineer's estimate for the City's portjon of the work is $15,000.. Funds from the
Unappropriated Reserves must be appropriated.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING AN EASEMENT FOR REAL PROPERTY FROM
TOBO INVESTMENTS
WHEREAS, TOBO Investments has submitted an Easement for Real Property
to the City of Carlsbad for storm drain and public access purposes, a copy
of which is'attached hereto, marked Exhibit 1 and
.reference; and
WHEREAS, the City Council of the City of Car

in the public interest to accept said Easement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Easement conveying Real Property to the City of Carlsbad
for storm drain and public access purposes is hereby accepted.
3. That the City Clerk is hereby authorized to cause the original Ease-
ment to be recorded in the Office of the County Recorder of San Diego County,
State of California, with the appropriate Certificate of Acceptance attached.

CALIFORNIA, APPP.OVING PLANS AND SPECIFICATIONS AND AUTHOR-
IZiNG THE CITY CLERK TO INVITE BIDS FOR THE CONSTRUCTION OF A STORM DRAIN ON OCEAN STREET AND CEDAR AVENUE - CONTRACT
NO. 1086
WHEREAS, the City Council of the City of Carlsbad has determined it is
necessary and in the public interest to construct a storm drain on Ocean Street
and Cedar Avenue; and '
WHEREAS, plans and speeifications-for the furnishing of. all .labor, materi
als, tools, equipment, transportation and other expenses necessary or inci-
dental for said project, Contract No. 1086, hsve been prepared and are on file
in the Engineering Department and are incorporated by reference herein;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carls-
bad as follows:
1. The above recitations are true and correct.
2. The plans and specifications as presented are hereby approved.
3. The City Clerk of the City of Cailsbad is hereby authorized and di-
rected to proceed to-publish, in accordance with law, notice to contractors
inviting bids for Contract No. 1086, in accordance with the plans and specifi-
cations hereinabove referred to.

CALIFORNIA, AUTHORIZING THE TRANSFER OF FUNDS FOR THE CON-
STRUCTfON OF A STORM DRAIN ON OCEAN STREET AND CEDAR
AVENUE
BE IT RESOLVED by the City Council of the City of Carlsbad as follows:
1. That the transfer of Fifteen Thousand Dollars ($15,000) from the
Unappropriated Reserves of the General Fund, Account No. 01-090-0900, to the
Ocean StreetjCedar Avenue Storm Drain Project Account, No. 01-170-3095, is
hereby authorized and approved.
2. That Department of Finance Fund Transfer No. 9 on file in said de-
. partment and incorporated by reference herein is approved.
