The applicant requests a change of zone from S-90 (County) to R-l on property generally
located southwest of the intersection of Palomar Airport Road and Laurel Tree Road.
At the public hearing, the Planning Commission was concerned that an R-l zone could
allow a density of development which could overburden existing public facilities .
The Planning Commission, therefore, is recommending a zone change to R-1-lOOOOr-Q
instead of the originally requested R-l zone. With the R-1-10000-Q designation,
the Planning Commission found the project to be consistent with the General Plan
and also that uses allowed in the zone would not overburden existing public facili-
ties and would be compatible with surrounding land uses.
No public opposition was expressed at the public hearing.
Through staff review and Planning Commission hearing, all issues on this matter
have been satisfactorily resolved.

RECOMMEM3ATION
Both the planning staff and Planning Commission recommend that this application be
APPROVED and that the City Attorney be directed to prepare documents APPROVING
ZC 214, per Planning Commission Resolution No. 1676.
Council Action: •
10-7-80 Council directed the City Attorney to prepare documents approving ZC-214 to
include a hold-harmless clause re noise from the airport.1

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A ZONE
CHANGE FROM L-C TO R-1-10,000-Q ON PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF LAUREL
TREE ROAD, SOUTH OF PALOMAR AIRPORT ROAD.
APPLICANT: SUDAN INTERIOR MISSION
CASE NO; ZC-214
WHEREAS, a verified application for certain property, to
wit:
A portion of Lot "G" of Rancho Agua Hedionda, San Diego
County, Map No. 823, dated November 16, 1896
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provided
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 13th day of
August, 1980, August 27, 1980, and September 10, 1980, hold a
duly noticed public hearing as prescribed by law to consider
said request; and
WHEREAS, at said public hearing, upon hearing and considering
all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to
the Zone Change; and

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing,
the Commission recommends APPROVAL of ZC-214, based
on the following findings:

2) That the zoning designation of R-l-10,000 limits the
density so that existing public facilities can adequately
serve the property.
3) That the Q overlay designation will ensure that the
density, design and type of development will not create
an excessive demand on public facilities.

STAFF REPORT

SUBJECT: ZC-214 - SUDAN INTERIOR MISSION - Request for
prezoning from existing San Diego County S-90 zone
to R-l zone on property located southwest of the
intersection of Palomar Airport Road and Laurel
Tree Road.
I. PROJECT DESCRIPTION
The applicant is requesting to prezone the subject property
from the County zone of S-90 to R-l in order to allow subsequent
annexation and development in the city. The subject property
is a 12.36 acre parcel located off Laurel Tree Road approx-
imately a quarter of a mile south of Palomar Airport Road.
Most of the property consists of sloping land covered with
native vegetation, however, the southwesterly third of the
property has been previously graded and is devoid of any
native vegetation. A large single family dwelling is located
on the southwesterly portion of the property. In the past,
this, building was utilized as an office and heavy equipment
wa,s stored on the property. The house is being used a$ a
single family residence at the present time.
The properties to the east, west, and south are vacant at
the present time while the property to the north is being
utilized for agricultural purposes and has an agricultural
processing plant on it. The applicant has indicated that
his organization wishes to eventually construct a retirement
home on this property, consisting of cluster housing.
Construction of thi.s facility would require subsequent
approval of a Planned Unit Development by the Planning
Commission.
II. ANALYSIS
Planning Issues
1. Is the proposed R-l zone consistent with the RLM
General Plan designation?
2. Is the proposed R-l zone consistent with existing
surrounding zoning and land use?
3.. Is the proposed R-l zone premature at this time
and would another zone be more appropriate?
Discussion
The RLM (Residential Low-Medium Density, 0-4 du/ac) designation
of the General Plan is intended to allow the type of residential
development that would occur in the requested R-l zone.
Therefore, R-l zoning would be consistent with the General
Plan designation for this property. Staff is concerned,
however, as to whether the R-l zone would be consistent with
the existing surrounding zoning and land use in the area and
whether the requested R-l zone is premature at this time.
The subject property is rather isolated from the nearest
residentially developed property and approximately a mile
from the nearest existing R-l zone. The nearest existing
residential development is located at Alta Mira, approximately
a half mile to the west of the subject property. The
subject property is contiguous to the City of Carlsbad along
its northern boundary only. However, this property has a
zoning of E-A (Exclusively Agricultural) which has a minimum
lot size of 10 acres.
It is the staff's feeling that a zoning of R-l would not be
appropriate for this parcel at the present time. Approval
of the requested zoning would result in an isolated R-l
zoning district completely surrounded on all four sides by
zoning permitting a much lower density of development than
would be permitted in the R-l zone and requiring a much
lower level of public services.
Planning staff feels that a zoning of L-C (Limited Control)
would be the appropriate zoning for this property at t^iis
time. The L-C (Limited Control) zone is an interim type of
zoning which would allow the property to annex into the
city, but would not allow it to be used for other than
agricultural type purposes. At a future date, when the
surrounding area is also ready to develop at a more intense
level and a higher level of public services are available,
the applicant would be able to apply for a zone change from
L-C to R-l.
It should be pointed out that although the applicant has
indicated an intention to develop the property with a specific
use, the Planning Commission's consideration should focus on
the proper zoning for the property given the major planning
issues listed above.
III. RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolution
No. 1676, recommending to the City Council APPROVAL of ZC-
214 for the L-C zone rather than the requested R-l zone
based on the findings contained therein.
