Mgr SUBJECT: 9 IDT TENTATIVE TRACT MftP APPLICANT: Vforley CASE NO: CT 80-33 STATEMENT OF THE MATtTR;~ The applicant is requesting approval of a 9 lot industrial tentative tract map located on the south side of Camino Vida Roble in the Palomar Airport Business Park in the ' P-M zone. The Planning Commission found this project to meet all requirements of both the zoning ' ordinance and the subdivision ordinance. The Commission added a condition requiring the applicant to participate in the Palomar Airport Road bridge widening study because they felt the proposed project would contribute to the traffic impact on Palomar Air- port Road. No public opposition was expressed during the public hearing. Through staff review and Planning Commission hearing, all issues on this matter have been .satisfactorily resolved. EXHIBITS 1. Exhibit "A", dated August 15, 1980 RECOMMEMDATION Both the planning staff. and Planning Commission recommend that this application be APPROVED and that the City Attorney be directed to prepare documents APPROVING CT 80-33, per Planning Commission Resolution No. 1697. City Manager Comment • Condition 17 requires applicant to install water reclamation improvements if required by Council. This condition may be premature. Condition 18 requires applicant to pay for a study to widen Palomar bridge over 1-5. Suggest Council delete this requirement until -a-policy decision is made by Council on how to fund the $10,000 CALTRANS study. Council Action: - - 1,0-28-80 Council directed the City Attorney to prepare documents approving CT 80-33 per Planning'Commission Resolution 1697, with the. deletion of conditions 17 and 18.. 1 PLANNING COMMISSION RESOLUTION NO. 1697 2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING 3 APPROVAL FOR A 9 LOT TENTATIVE TRACT MAP ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE 4 OF CAMINO VIDA ROBLE. APPLICANT: HENRY WORLEY 5 CASE NO: CT 80-53 _ 6 WHEREAS, a verified application for certain property to, 7 wit: 8 Lot 16 of Carlsbad Tract 73-49, Unit No. 2, according to Map No. 8418, filed on November 19, 1976, County 9 of San Diego 10 has been filed with the City of Carlsbad, and referred to the 11 Planning Commission; and 12 WHEREAS, said verified application constitutes a request as 13 provided by Title 21 of the Carlsbad Municipal Code; and 14 WHEREAS, the Planning Commission did, on the 24th day of 15 September, 1980, hold a duly noticed public hearing as prescribed 16 by law to consider said request; and 17 WHEREAS, at said public hearing, upon hearing and considering 18 all testimony and arguments, if any, of all persons desiring to 19 be heard, said Commission considered all factors relating to the 20 Tentative Tract Map. 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 22 Commission as follows: 23 A) That the above recitations are true and correct. 24 B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of CT 80-33, based on 25 ! the following findings and sifbject to the following conditions 26 27 1) The proposed tentative map is consistent with the city's General Plan since it is located within an area designated 28 for industrial development by the Land Use Element of the Genera] Plan. o? 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17. 18 19 20 21 22 23 24 25 26 27 28 c 2) The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate industrial development at the proposed density and still meet all the requirements of the city's subdivision ordinance. 3) The project is consistent with all city public facility policies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that building permits may not be issued for the project unless the City Engineer determines that sewer service is available. Since the final map cannot be approved unless sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have been met insofar as they apply to sewer service for this project. b) All necessary public improvements have been provided or will be required as conditions of approval. c) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the general plan. 4) The proposed project is compatible with surrounding and future land uses since it is being developed as industrial property and the surrounding uses are or will be industrial. 5) The design of the project will not cause any significant environmental impacts since based on an initial study of the project (including a field investigation of the site and archaeological survey) the Planning Director has determined that the project will not result in any adverse environmental impacts and therefore has issued a declaration of negative environmental impact on September 2, 1980, Log No. 749. Conditions: 1)Approval is granted for CT 80-33, as shown on Exhibit "A", dated August 15, 1980, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherxvise noted in these conditions. PC RESO #1697 - 2 - 1 2) This subdivision is approved upon the express, condition that the final map shall not be approved unless the City 2 Council finds as of the time of such approval that sewer service is available to serve the subdivision. In the event 3 that sewer is not available and the planning moratorium is still in effect, the provisions of Section 66452.6(b) of the 4 Subdivision Map Act shall apply. 5 3) This subdivision is approved upon the express condition that building permits will not be issued for development of the 6 subject property unless the City Engineer determines that sewer facilities are available at the time of application 7 for such permits and will continue to be available until time of occupancy. If the City Engineer determines that sewer 8 facilities are not available, building permits will not be issued. This note shall be placed on the final map. 9 4) This project is approved upon the express condition 10 that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 11 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement 12 executed by the applicant for payment of said fee a copy of that agreement dated August 4, 1980, is on file 13 with the City Clerk and is incorporated herein by reference. If said fee is not paid as promised, this 14 application will not be consistent with the General Plan and approval for this project shall be void. 15 5) The applicant shall install street trees to city spec- 16 ifications at 40 foot intervals along all public street frontages prior to final occupancy of any building. 17 The variety of said trees shall be subject to the approval of the Parks and Recreation Department. 18 6) Any signs proposed for this development shall be 19 designed in conformance with the City's Sign Ordinance and shall require review and approval by the Planning 20 Department prior to installation of such signs. 21 7) Prior to issuance of any building permits a uniform sign program for this development shall be submitted to the 22 Planning Department for its review and approval. 23 8) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and 24 debris, 25 9) All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from 26 view and sound-buffered from adjacent properties and streets to the satisfaction of the Planning Department 27 and Building Department. 28 //// PC RESO #1697 -3- •*N 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 10) ID • 12) 13) 14) 15) 16) 17) 18) 19) PC Approval of this request shall not excuse compliance with all sections of the zoning ordinance and all other applicable city ordinances in effect at time of building permit issuance. Lots 3 and 4 shall be permitted to have only one driveway access each onto Camino Vida Roble subject to the approval of the City Engineer. In order to provide for fire protection during the construction period, the applicant shall maintain passable vehicular access to all buildings. In addition, adequate fire hydrants with required fire flows shall be installed on and off site as required by the Fire Department. The location of access driveways to all lots shall be reviewed and approved by the Fire Department prior to final map approval. The developer shall receive the approval of the City Engineer for a site grading plan and obtain a grading permit prior to issuance of building permits. Grading shall occur in accordance with an approved grading and erosion control plan, city standards, and an approved soils and geologic investigation report which shall include slope stability calculations and construction specifications. All exposed slopes shall be hydromulched or otherwise stabilized immediately upon completion of grading subject to the approval of the City Engineer. Drainage improvements shall be constructed in accordance with an approved plan, and the work shall be coordinated with the overall plan for grading to the satisfaction of the City Engineer. The applicant shall comply with all regulations and requests of the Costa Real Municipal Water District within which this property is located. If the city adopts a policy and standards relating to waste water reclamation prior to the issuance of a building permit for the first unit, the applicant shall install improvements to accommodate water reclamation on the property pursuant to said policy and standards. The applicant shall agree to participate in the funding of a study to be performed by Caltrans to determine the feasibility of widening the Palomar Airport Road bridge over Interstate 5. The amount of said funding shall be determined by the City Engineer and shall be paid prior to the approval of the final map. The applicant shall comply with all applicable conditions of CT 73-49. DATE: September 24, 1980 TO: Planning Commission FROM: Planning Department • SUBJECT: CT 80-33 - WORLEY - Request for a nine lot tentative tract map on the south side of Camino Vida Roble in the Paloraar Airport Industrial Park in the P-M Zone. I. PROJECT DESCRIPTION The applicant proposes to subdivide a triangular shaped 16.6 acre parcel into nine lots, one of which will be an open space easement under a San Diego Gas and Electric power line. The property is part of a previously approved sub- division; CT 73-49. The eight buildable lots created by this subdivision will vary in size from .1.15-2.18 acres. Las Palmas Drive will be extended through the subject property to Camino Vida Roble. Tha extension of Las Palmas Drive is necessary to provide access to five of the eight lots that will be created by this subdivision. The subject property generally slopes to the north. Most of the rite is covered with low-lying native vegetation consisting of scrub oak, brush and weeds. Approximately 20% of the northeasterly portion of this site has been partially graded and has been used as a disposal site for excess material from adjacent grading operations. The applicant proposes • approximately 75,000 cubic yards of grading for the subject property which will result in an 84% alteration of the present land form. None of the slopes created by this grading will exceed a slope of 2:1 or be higher than 30 feet. II. ANALYSIS • Planning Issues 1. Does the proposed tentative map meet the requirements of the Carlsbad Zoning Ordinance? 2. Does the proposed tentative map meet the requirements of the Carlsbad Subdivision Ordinance arid the State Subdivision Map Act? Discussion All 9 of the lots created by this subdivision will have an area greater than the.one acre minimum required by the P-M 7 zoning standards. All 8 of the bnildable lots, except lot ifl, have frontage on Las Palmas Drive. As proposed, this subdivision meets all of the requirements of the Carlsbad Subdivision Ordinance and the Subdivision Map Act. The proposed map and improvements are consistent with the Carlsbad General Plan. The site is physically suited for the type and. density of development proposed by the applicant and the proposed subdivision should not cause substantial environmental damage. Also, the proposed sub- division and its required' improvements should not cause serious public health problems nor will the design of the subdivision conflict with any easements. III. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 1697, APPROVING CT 80-33, based on the findings and subject to the conditions contained therein.
