Atty._V/5S DEPARTMENT: PLANNING ___ Cty. Hgr. SUBJECT: ZONE CHANGE FROM R- 1-7500 TO R-P APPLICANT: MALOY CASE NO: ZC-216 STATEMENT OF THE HATTER The applicant requests a change of zone from R-1-7500 to R-P on property located on the northeast corner of Madison Street and Arbuckle Place. The Planning Commission found that the proposed R-P zone is consistent with the-General Plan, and further, that uses allowed in the R-P zone are compatible to surrounding land uses. Since the General Plan land use designation for the rest of the properties on Arbuckle Place is also a combination of residential high density /of f ice professional (RMH/0), the Planning Commission directed staff to set a new zone change application for public hearing to consider rezoning all of these properties from R-1-7500 to R-P. No public opposition was expressed during the public hearing. Through staff review and Planning Commission hearing, all issues on this matter have been satisfactorily resolved. EXHIBITS 1. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 24th day of September, 1980, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST:EDWIN S. SCHICK, JR., Chairman CARLSBAD PLANNING COMMISSION JAMES C. HAGAMAN, Secretary CARLSBAD PLANNING COMMISSION PC RESO #1696 STAFF REPORT DATE: September 24,1980 : TO: Planning Commission FROM: Planning Department SUBJECT: ZC-216 - MALOY - Request for a Zone Change from R-l-7500 to R-P on property generally located on the northeast corner of Madison Street and Arbuckle Place. I. PROJECT DESCRIPTION The applicant is proposing a change of zone from R-l-7500 to R-P (Residential/Professional) on two 5000 square foot parcels of land making up the northeast corner of Madison Street and Arbuckle Place. The corner parcel, fronting on . both Madison Street and Arbuckle Place is presently occupied by a duplex. The adjacent parcel, fronting on Arbuckle Place is a graded vacant lot. II. ANALYSIS Planning Issues 1. Is the requested zone change consistent with the land use element of \_he general plan? 2. . Do the subject parcels meet the lot width and area requirements of the zone code for the requested zone? 3. Would the requested zone change adversely impact surrounding properties? 4. Is the street system serving the project adequate to handle any increase in traffic generated by the change of zone? Discussion The applicant is proposing a zone change from R-l-7500 to R-P (Residential/Professional). The requested change of zone would be consistent with the RMH/0 designation of the land use element of the general plan for this property. RMH/O denotes a combination district permitting residential development to a medium-high density and professional and related commercial uses. -y In order for the subject property to meet the lot width and area requirements of the zoning code, it will be necessary to combine the two parcels into one lot. Except for the southwest corner parcel on Arbuckle Place and Jefferson Street, all lots fronting on Arbuckle Place are presently zoned R-l-7500 cis shown on the attached exhibit. However, all other surrounding properties between Jefferson Street and Madison Street are zoned R-P. This area is an older neighborhood in transition from single family homes to multiple-family residences and office/ professional uses. Rezoning of the subject property to R-P would be compatible with surrounding uses and zoning except for the R-l zoning along Arbuckle Place. The Commission may wish to set the balance of the block to public hearing to consider rezoning the R-l properties on Arbuckle Place to R-P to bring the entire block into conformance w,ith the general plan and make it consistent with all the surrounding zoning. The R-P zone would permit the existing residential uses on Arbuckle while providing for future development and renovation of the neighborhood. As all surrounding zoning, (R-P, C-2., and R-3) permit development similar or compatible with those uses permitted by the requested zone change, no adverse impacts are anticipated to surrounding properties. The R-P designation would seem appropriate for this area as it serves as a transitionary zone between the C-2, Central Business District and to the southwest and higher density residential development, R-3 to the north and east. A slight increase in traffic generated to this area may be expected by uses allowed in the R-P zone. Both Madison Street and Arbuckle Place are specified as local streets. To conform with the standards established in the circulation element of the general plan, a condition of approval has been added to this resolution requiring dedication and a future improvement agreement of street frontage on Madison Street and Arbuckle Place. Staff feels that future improvements to these streets will mitigate any potential traffic concerns. It is staff's opinion that a rezoning of the subject property to R-P is appropriate and would not result in any adverse impacts to surrounding properties. The applicant should be aware that prior to the issuance of any building permit or business license to convert the existing use of the property, all applicable city ordinances will have to be complied.with and a plan for parking lot improvements will have to be approved by the Planning Director. -2- - III. RECOMMENDATION It is recommended that the Planning Commission ADOPT Resolution No. 1696, APPROVING ZC-216, based on the~findings and subject to the conditions contained therein. It is also recommended that the Planning Commission direct staff to set to public hearing consideration of rezoning the other lots along Arbuckle Place from the R-l to R-P zone.
