SUBJECT: LAKE CALAVERA HILLS SEWER SERVIC£ AR£A MORATORIUM STATEMENT OF THE MATTER Standard Pacific is the developer of the 225-lot Quail Ridge Subdivision. The tract is located along Elm Avenue east of El Camino Real, and is included in the Lake Calavera Hills Sewer Service Area. McMillin Develop- ment, Inc. is the developer of the Templin Heights subdivision which has 108 lots in its final two phases. Both subdivisions are in the Lake Calavera Hills Sewer Service Area and cannot receive final map approval from the City Council until the Lake Calavera Hills Sewer Service area moratorium is lifted by a finding that sewer is in fact available. The Council has previously determined that the sewer moratorium in Lake Calavera Hills area will be lifted at such time as (1) the Lake Calavera Hills Sewage Treatment Plant is complete; (2) the right-of-way for the effluent disposal line has been acquired; and (3) the construction of > the effluent disposal line is guaranteed. The Lake Calavera Hills developer has projected a completion date of January 1, 1981 for these items. Therefore, both subdivisions could receive final approval on this date. However, Standard Pacific and McMillin Development want to start construction immediately and have asked that they be assigned temporary capacity from Encina in order that the Council can make the finding that sewer service is available and give final approval to the tract maps. The Council previously "loaned" the Lake Calavera Hills developer 142 EDU's of Encina capacity in order that Tract 76-12 could be finaled. It appears that Quail Ridge, Templin Heights and CT 76-12 are the only approved tentative subdivisions in the Lake Calavera Hills Sewer Service Area, so it is unlikely there will be any further requests for a loan. FISCAL IMPACT Should the Lake Calavera Hills Sewage Treatment Systems not be in operation at the time of completion of the Quail Ridge and Templin Heights homes, sewage flows would be diverted to Encina, but 95% of the connection fees for capacity would be paid to Lake Calavera Hills. The Quail Ridge Development will require a small pump station with an annual operating cost of about $2000 per year. EXHIBITS 1. Staff Report. 2. Location Map. 3. It appears that Quail Ridge, Tempi in Heights and CT 76-12 are the only approved tentative subdivisions in the Lake Calavera Hills Sewer Service Area. When the Council "loaned" the Lake Calavera Hills developer (CT 76-12) 1A2 EDUs they concluded that it would be at least a year to 18 months before homes could be built and occupied in the 1A2 lot development. They also found that the Lake Calavera Hills Sewage Treatment Plant was essentially complete and only the effluent disposal line construction needed to be accomplished. The number of EDUs of sewage capacity remaining at Encina is over 2500 connections which is projected to last for over two years. The completion of the Encina Treatment Plant expansion is almost two years away and the proposed Palomar Airport Sewage Treatment Plant could also be avail- able in two years. Based on this information, staff would recommend to Council that the Quail Ridge and Tempi in Heights subdividers be granted a temporary assignment of 333 EDUs of Encina capacity in order to final their tentative subdivision maps and proceed with developing their property. As an alternative to the "loan" of Encina capacity the Council could lift the moratorium in the Lake Calavera Hills Sewer Service Area, since there are no approved tentative maps remaining in the service area other than Quail Ridge, Tempi in Heights and CT 76-12. There is no reason to continue the moratorium. WHEREAS, the conditions of approval of the Quail Ridge and Templin Heights Subdivisions include provisions that the final maps will not be approved unless the City Council finds that sewer service is available to serve the project; and WHEREAS, the Lake Calavera Hills Reclamation Facilities are under construction and scheduled for completion within six months; and WHEREAS, the City Council has recently acquired 1800 EDU'S of Encina sewage treatment capacity of which only a small part has been issued; and WHEREAS, the actual completion and occupying of homes in the two subdivisions will not occur until after the Calavera Plant is completed; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That 225 EDU'S of Encina Treatment Capacity is found to be available for the Quail Ridge Subdivision and 108 EDU'S of such capacity is found to be available for the Templin Heights subdivision, 3.
